心爱石兽不见 文物爱好者疑被盗

文物爱好者吴先生对这对石像的喜爱尤其深。2008年，他在碧云寺的金刚宝座塔看到了它们，形容其“造型怪异”，看着让他觉得很奇特。此后，几乎每次去碧云寺参观时，吴先生都会看看这对石兽，并为它们拍几张照片。

香山公园曾称石兽为明代物品
在很多文物爱好者看来，这对石兽不仅是样子奇特惹人关注，而且是有价值的文物，倘若被盗损失重大。2006年，香山公园管理处曾对媒体指出，2003年在碧云寺外也发现了一对明代石兽，当时也怀疑它们出自魏忠贤墓，2005年和2006年分别出土的文物“翁仲”石像印证了墓地的存在。
此后多年来，一对高3米的文武石翁仲和本次不见了的一对高1米的石兽，被并排摆放在金刚宝座塔的北侧。
而至今，在这排石像的旁边，仍竖立着园方对“石翁仲”的介绍牌，上面介绍，碧云寺曾是明朝天启权宦魏忠贤的生圹。而这对石兽则被文物爱好者界认为跟石翁仲一样，都是魏忠贤生圹在此的证据。北京青年报记者发现，在多位文物爱好者的博客中，只要涉及碧云寺，就会有这四个靠墙而立、摆成一排的石像的身影。在很多人看来，它们是碧云寺的一处标志性文物。

石兽为寄放 去年就已丢失
“石兽确实是丢了，发现这个情况后我们的安保部门一直在调查。”昨日，香山公园的相关工作人员对北青报记者证实。
昨日晚上，香山公园管理处为此作出了情况说明，表示这对石兽确实是此前新闻中提到的于2003年出土的物品，与石翁仲一起被怀疑是明代宦官魏忠贤生圹的附属物。但不同于石翁仲，石兽是在公园外的某单位施工时被发现的。园方介绍，该单位发现石兽后，认为它们是阴宅之物，不愿意保留，于是送至公园，并被园方暂放在金刚宝塔北侧的塔墙外，“一直都不是公园在册的物品。”
此前，园方也对此作出了回应，明确表示这对石兽是外界寄放在园内的物品，而园内没有任何物品丢失。
园方说，发现石兽丢失是在2013年年初左右。当时，工作人员在巡查时发现碧云寺后门被撬，而石兽丢失不见了，公园管理处立即开展调查，至今未果，公园还未正式报警。
园方表示，事后，公园立刻强化了安全管理工作，在全园范围内开展排查，防患于未然；强化安防技防举措，在罗汉堂内安装目前世界上最为先进的极早期空气采样火灾探测系统。在碧云寺围墙上加装铁丝网。在坚持做好电子监控管理、24小时不间断巡查的基础上，增加巡视人次及频次。

文物局：公安部门应介入
本报讯(记者 孟妍 赵婷婷)对于文物寄放的相关事宜，昨日北京市文物局的工作人员对北青报记者表示，目前国内在文物的寄放方面并无具体的法律法规来管控。而如果文物丢失，应该报警备案后，由公安部门介入调查。
目前，对于文物类物品的寄放，我国是否有相应的规范流程？对此，北京市文物局的工作人员对北青报记者说，文物的寄放在全国范围内并不多见，目前也没有一个可供执行的法律法规来监管。在寄放时，一般需要寄放方和被寄放单位签署相关协议。
而被寄放的文物丢失了该怎么办？市文物局方面说，不管文物类物品是否是被寄放还是文保单位自己所有，倘若是文物丢失，已经超出了文物局的管辖范围，应该备案，在发现情况后立刻报警，由公安部门介入调查。
疑问
质疑一：石兽是否为文物、具备价值？
香山公园表示石兽并非文物，只是“物品”。文物保护单位的工作人员陈爽(化名)对北青报记者表示，石兽到底有没有价值，可以参考国家文物局关于出入境文物管理的规定。
根据《中华人民共和国文物保护法》及其《实施细则》和《文物出境鉴定管理办法》，凡是在1949年以前中国和外国制作、生产的雕塑品、工艺美术品、各种质料的雕刻品等，均应进行文物出境鉴定。
“连出入境都需要被监管，说明有价值。”陈爽说。
作为疑似明代魏忠贤生圹附属物的这对石雕像，虽然距今近400年历史，但究竟是否是文物、是几级文物，陈爽表示很难说，涉及有关行政部门的认定手续。
质疑二：园方是否应对丢失石兽负责任？
同是文物保护工作者，陈爽认为，寄放物品丢失，那显然被寄放方应该负有责任。此外，如果是文物丢失，不光是被寄放方有责任，寄放单位也应该负有一定责任。他说，如果是文物的话，这就不只是属于某一单位的物品了，而是国家所有。丢失后，造成的损失也是国家的损失。而具体责任该如何划分，就要看当初寄放时签订的有效协议内，对双方在寄放期间担负的责任是如何划分的。
此外，陈爽认为，如果是文物丢失，也应该向上级报告，及时通报相关情况，尽力挽回损失。他表示，作为一个文保单位，不管是否是园内物品丢失，不管丢失的是否是文物，都应该引起重视。这说明文保单位的安保工作不到位，对园内所有文物的安全都造成了隐患。
