控烟条例
控烟条例有望明年出台
日前，中共中央办公厅、国务院办公厅印发了《关于领导干部带头在公共场所禁烟有关事项的通知》，自上而下的禁烟备受关注。
今年北京市两会期间，所有会场都禁止吸烟，走廊内也放置禁烟标识，禁烟行动全面升级。
市人大常委会主任杜德印昨天在报告中指出，作为市人大今年的立法工作重点，将制定控烟条例。
市人大法制委员会副主任委员、市人大常委会法制办主任李小娟透露，控烟条例提请市人大常委会审议的时间可能在今年下半年。考虑到涉及重大公众利益，控烟条例很有可能还需提交明年年初的市人代会审议，表决通过后出台。这意味着，如果顺利，控烟条例有望在明年通过并出台。
李小娟介绍，目前已对控烟条例进行了立项论证，在立法思路上，提出了明确各类主体的权利、义务，采取社会监督、共同治理的方式加强执法，控烟范围与国际接轨等意见、建议，常委会主任会议确定立法思路时，采纳了部分建议。
吸烟罚款上限提高19倍
2011年，市人大常委会将制定控烟条例列为立法预调研项目，并成立了项目领导机构和以应松年教授为首的立法专家组。
经过近一年的调研，专家组提出了《北京市控制吸烟条例（专家建议稿）》，并于2012年3月至4月公开征求意见，参与的网民中九成赞同进一步扩大控烟范围。
根据当时专家组提出的建议稿，控烟条例将大幅提高对违法吸烟的处罚力度，相比现行条例处罚10元的规定，建议稿的最高罚款是现行标准的20倍。提出“公民在禁烟场所吸烟且不听劝阻的，由市和区县爱卫会或相关管理部门责令立即改正，并处以50元以上200元以下罚款”。
走廊卫生间也不能吸烟
李小娟介绍，经过研究，未来的条例有望扩大现行的控烟范围。其中提出“有顶儿”的室内公共场所全面禁烟，涉及室内公共场所、室内工作场所、公共交通工具等。
实际上，此前很多公共场所已经提出了禁烟的要求。但在封闭的建筑内总会辟出一些“例外”的吸烟区。比如走廊、楼梯间、卫生间，或者干脆设置专门的吸烟室，供吸烟使用。
有关专家表示，这种做法实际上等于“自欺欺人”。控烟条例的出台将意味着电梯、走廊、地下通道、楼梯间、卫生间等区域都将禁烟。同时，学校、医院、体育场等公共场所的禁烟范围或将扩至室外区域。
住房保障条例
将调研“共有产权”住房
根据立法安排，今年，市人大常委会还将对基本住房保障条例进行立项论证。所谓立项论证就是具体研究并解决这个法写一些什么内容，按照什么思路立法。
今年的政府工作报告中提出，在建设保障房中引入了“共有产权”的概念。李小娟介绍，在对基本住房保障条例的立项论证过程中，就会涉及“共有产权”的问题。李小娟说，现在房子动辄几万元一平米的价格，其实不是建房子贵而是地价高。如果考虑到人们有居住的权利而不是土地的出让使用权，地钱实际上政府给提供，对基本住房的保障责任，可能就形成一种共有产权。李小娟说，立法部门已经注意到外省市提出了“共有产权”的概念，有些地方已经开始实行这一制度，北京也有可能按照这个想法来做。
此外，李小娟表示，房屋出租条例也正在进入立项论证，在所有北京市制定的相关政策里，虽然有特大城市调控人口规模的任务在，但是在具体的政策制定过程中，会考虑到常住人口的合法权益保障。
多名代表建议为房立法
在本次人代会的第10号议案中，李国等21名人大代表联名提出“完善本市基本住房保障制度”。
议案中指出，住房保障工作的开展，采取了自上而下，以每年完成一定数量保障房建设任务为重点的推进方式，尚未形成基本住房保障的制度性安排，群众缺乏对基本住房的制度预期。
代表们认为，北京当前的住房保障主要存在五个方面的问题：基本住房保障制度尚不够健全，住房保障政策体系缺乏系统性和稳定性；保障房种类多，政策边界不够清晰；产权式保障房有可能成为投资获利手段；保障房供应量仍显不足，申请人轮候周期过长；保障房的分配和运行管理机制还不健全。
议案中提出，应加快制定《北京市基本住房保障条例》，将住房保障工作纳入法制化轨道运行，结合本市实际情况，针对突出问题，加快地方人大立法的进程。通过立法，构建住房保障制度框架、政府责任约束机制、准入退出等运行机制、社会参与监督机制、法律责任追究机制，为住房保障工作提供法规支撑。
第62号议案中，代表们也提出相似的问题和建议。
专家建议稿获得“认可”
据了解，2013年北京两会时，《北京市基本住房保障条例》就已完成立法预案研究报告和专家建议稿。市人大常委会在充分调研、座谈及开展基本住房保障法规预案研究工作的基础上，于2011年正式通过并启动《北京市基本住房保障条例》法规预案研究。
经过一年多的调研，市人大常委会委托北京市房地产法学会起草了《〈北京市基本住房保障条例〉（专家建议稿）草案》。
去年7月上旬，市住建委副主任程建华、市住建委委员邹劲松专题听取了市住保办关于《条例》立项论证情况的汇报。邹劲松对《条例》的立项论证报告提出了修改建议，要求从北京市现行住房保障制度出发，梳理出实践中的难题，深层次地论述立法必要性。他强调：要通过立法将北京市住建委在住房保障工作中开创性的做法以及好的经验固化下来，在法规中明确基本住房保障范围、保障方式、保障标准、建设、分配、审核及后期管理等方面内容；并要求下一步广泛调研听取意见，加快推进《条例》立项论证工作。
昨天，北京市房地产法学会秘书长高喜善向京华时报记者表示，相关方面对该学会起草的建议稿“比较认可”，建议稿中包括基本住房保障的内涵、基本原则等，包括规划和计划、资金和房源筹集管理、开发建设与运营管理、价格确定、申请和准入、监督管理等涵盖住房保障的各个方面，共50多条。

精神卫生条例将做立法后评估
据杜德印介绍，今年市人大常委会拟继续审议动物防疫条例、人口与计划生育条例修正案；制定控制吸烟条例、城市轨道交通安全条例、建设工程质量管理条例、水土保持条例；修订老年人权益保障条例。
立项论证方面，将对制定实施工会法办法、房屋出租管理条例、基本住房保障条例、气象灾害防御条例，修订养犬管理规定、旅游管理条例、公园条例进行立项论证。
今年，市人大常委会还将对精神卫生条例进行立法后评估。
5个专项报告将交常委会审议
今年人大常委会拟安排听取和审议“一府两院”5个专项工作报告。包括听取和审议市政府关于行政执法工作情况的报告；听取和审议文化创新发展专项资金使用情况报告，并对文化创新发展专项资金使用情况开展专题询问；听取和审议北京市国际友好交流城市工作情况的报告；听取和审议市高级人民法院关于完善审判权运行机制、市人民检察院关于完善检察权运行机制情况的报告。
