“最牛违建”仍在清运垃圾
昨天下午，记者来到人济山庄东侧，观察4号楼顶的“最牛违建”。此前的葡萄架、假山、植被如今都不见了踪影。这些建筑被拆除后的垃圾，凌乱地堆放在楼顶。
再从西面看去，阳光房外覆盖的假山皮也已被剥去，露出了内部整块的玻璃。生长在假山皮缝隙中、并向下蔓延到楼体上的爬山虎，也不见了踪影。
违建主体结构拆除后，工人一直在清理楼顶的建筑垃圾，包括假山皮、绿植、铁丝、塑钢框架等。记者注意到，与一个月前相比，楼顶的“垃圾山”矮了一些。环绕楼顶的绿色防护网和建在楼下的防护通道也已被拆除。
地下三层的车库一角，垃圾站内堆着搬下来的建筑垃圾。据保洁人员称，张必清家拆违的工人，每晚10时后使用货梯搬运建筑垃圾至此，再用卡车拉走处理。
记者看到，一个月前垃圾从地面一直堆到天花板，以大块的假山皮为主。如今假山皮被清走后，垃圾站内腾出了不少空间，剩下的是植被、废家具等杂物。
拆违负责人此前接受采访时表示，冬天楼顶上气温低、风力大，工人为防止高空坠物等威胁居民人身安全，不敢使用大型切割设备，只能手动清运垃圾渣土，垃圾清运工作预计将持续一段时间。
今天上午，城管部门表示，已要求业主在自行拆除清理完成后及时汇报。届时城管将协同相关部门按照楼房的原始图纸进行验收，只有验收合格，整个拆除工作才能算真正结束。城管部门也会督促业主尽快清理。
周烈：北京应立法管理违建
“我在自己家可以眺望到人济山庄。一开始还以为是楼顶美化，后来电视上曝光了，才知道是违建。”人大代表、北京市第二外国语学院校长周烈说，他家住北外附近，距离人济山庄小区不远。
回忆起人济山庄的拆除过程，周烈颇有感触，“那是个很大的建筑，远看就像一座山。在拆除过程中，工程确实特别大。”目前，北京地区已经拆除了几个典型、知名的违章建筑，这一行动还应持续下去。
周烈表示，现在很多违建在向社区化发展，比如现在很多一楼的商品房都附赠花园，但是一些房主就会将花园“改建”成房屋，这些都是违建的新趋势。同时，目前违建大行其道，很大的原因是违建的违法成本太低。
周烈向记者举了个例子：一些使用彩钢板搭建的违建，搭建只需1到2天，成本也只要千元左右。这种房子一般能圈盖5到10平方米面积。现在这样面积的在四环内值多少钱？而城管对于违建的管理大多是拆除，并不处罚。
对于违建主人来说，无非是城管走了之后再盖，多花几千元换来的却是百余倍的利益。这种低成本的违法，自然让违建屡禁不止，“对于违建者的惩戒，已超过了城管的管理范畴，应该由法律来规定。”
卫爱民：违法者要承担违法成本
人大代表、北京当代律师事务所律师卫爱民表示，对于违建，北京目前没有专门的地方条款来管理，这就导致了违法的成本很低。北京对此还是应该专门立法。
“北京每年拆违量非常大，都花的是纳税人的钱。而在违建拆除中，最核心的问题，就是违法者要承担违法成本，不能让纳税人来买单。”他说。
卫爱民建议，违法建筑的建设者要区分不同的情况，要给予不同的处罚。但是，无论如何还是让违建的建筑者担负起法律责任。
杨立新：违建拆除应公示限期
市人大代表、北京市东城区东花市街道东花市南里社区居委会书记、主任杨立新表示，北京市去年在大力进行拆除违法建筑的工作，而“最牛违建”的曝光让所有人都感到错愕。
针对违建在被发现至今5个多月后，拆除仍未完成一事，杨立新说：“我觉得像这种对社会大众造成恶劣影响的违建，必须予以严厉处罚、强制拆除，同时必须明确规定拆除的时间段，向大众明示。”如果不进行强制拆除，对社会造成的影响太坏，长此以往，这必将会给这个城市的管理带来更大的隐患。

委员提案楼顶拆违要建长效机制
农工党北京市委员会，在这次政协会议上提交了针对“违建”的提案，建议城管部门应制定拆除楼顶违章建筑的长效机制。
楼顶违建对于建筑结构以及极端天气下周边道路的安全构成极大的危害。
农工党市委建议，首先，城管部门必须坚持定期对楼顶违建进行巡查。发现的必须严格记录并向业主发出自行拆除通知书。
此外，在采访中有居民向记者反映，物业公司在违建开始兴建时并没有起到积极的作用，放任其搬运建筑材料，才最终形成这样的规模。
因此，建议还指出，如果城管部门因为人力有限不能及时全面普查，可以委托小区内的居委会、业委会、物业管理公司代为调查和发出通知。采取鼓励措施，调动居委会、业委会、物业公司的积极性非常重要。
最后，对于居民投诉和反映的楼顶违建问题要积极调查予以反馈，并严格处理。让居民看到投诉的效果，可以促使居民积极投诉和反映违建情况。
