地产小广告纠缠不休
2013年上半年，经权威统计，北京地铁公司共在车厢内清理出无法统计数量的小广告646公斤。去年11月，本报也曾报道过地铁车厢内存在大量发放小广告的不文明行为。昨日下午，记者再次来到10号线地铁站采访，从角门东站上车后，记者发现车厢扶手上，仍插着一张张售卖房地产的小广告。
有的乘客为扶扶手，看都不看直接将小广告抽出扔到地上；有些坐着的乘客会翻看两眼，但到站后，便将小广告留在座位上或直接扔在地上。就算乘客不扔，有时列车一动，插在扶手上的小广告也会落到地上，很快便是满地狼藉。
记者发现，虽然小广告出现的频率减少了些，但售卖房产的小广告仍存在。
“可能都忙着过年去了。”昨天下午，在地铁宋家庄站，一保洁人员也表示，到年底，广告的数量渐少，但车厢内仍有不少楼盘的小广告，多的时候一节车厢一天还是能清理出上百张的。
两三年时间
发放方式变“侵略”
经常乘坐地铁出行的高女士告诉记者，2010年她还在上学，常坐13号线，当时发小广告的人还是将小广告递到乘客手里，有人接才发。但现在小广告已经是以侵略的方式进入地铁了，强行放在座位上或扶手上，让你躲都躲不开。

事实上，小广告的地盘远不止地下，地面上各种租房广告以及各种办卡业务的广告霸占了各个街道的墙面、电线杆等。
从宋家庄地铁口A口出来，就能看到一根直径约一米的圆柱体广告箱上被贴满了各种小广告，柱体从上到下已经被裹得严严实实，多是租房广告。
街道的环卫工人表示，街道曾定期用强力水枪进行清洁，频繁时每周都要来，但仍除不净。

刘颖：建信用平台对被查人员“限制”租房等
市人大代表、首都经贸大学财政税务学院副教授刘颖建议，出台针对治理非法张贴小广告的法规依据，从源头上根治此类城市“顽疾”。
刘颖表示，当前，非法张贴小广告和黑车、摩的等违法运营已成为严重影响本市形象的城市“顽疾”。
目前，城管执法部门虽仍在开展对非法小广告上的电话号码取证上报工作，但自2012年1月1日《行政强制法》出台后，执法部门已无法对已取证上报的电话号码实施停机。在查处麻将牌九、包小姐等涉黄、赌、毒、诈骗的违法小广告时，缺乏必要的技侦手段，无法对相对人的违法行为进行有效取证，这些都有碍根治。
对此刘颖建议，在针对非法小广告涉及的电话号码停机工作方面出台相关法律法规或工作措施。由市级部门统一牵头，对涉嫌组织散发黄、赌、毒等内容的小广告的个人或单位全程跟踪，从源头治理。
同时，建立全市人口信用平台，对于破坏城市环境或接受处罚的相对人采取信用评分方式，对其就业、租房等产生影响，以遏制其违法行为。
卫爱民：治小广告该立重法严格执行
“为什么人家用小广告就能营业，我们就不能用他们发布的消息来找到他们？他有电话我们屏蔽掉电话不就行了？”人大代表、北京当代律师事务所律师卫爱民说，治理小广告只要追究广告发布者的责任，谁发布谁担责就可以了。
卫爱民建议，北京市政府对于全局性的、久治不愈的问题，应利用整体资源优势，由市政府来牵头治理。现在，北京虽然有多部门的联动机制，但是作用没有发挥起来，还存在执法不到位的问题。
“对久治不愈的城市病，北京不仅要立法、还要立重法，且执法一定要严格。”卫爱民指出，一出现奶粉荒，香港就立法、量刑，并严格执行。北京也应针对小广告这种久治不愈的城市病立法，虽然不见得要追究发布者的刑责，但经济责任和行政责任都可追究。
刘俊彩：重罚加设专贴处双管齐下
北京市人大代表刘俊彩表示，清理城市牛皮癣的现状就是清洗的人力赶不上贴小广告的人力，贴小广告的人没地方去贴，就会产生乱贴乱扔现象，这种情况就需要一个疏导的路径，也就是开辟出一个专门的地方允许他们贴，做到“疏”。
此外，市政市容委要加大宣传力度，让发小广告的人认识到其行为违法，并让雇主们认识可能带来的相应后果，这就需要“堵”，也就是说治理小广告可以像解决醉驾一样，发现之后直接入刑，纳入到法律体系内。疏堵结合，能很大程度上起到治理的作用。

方炎委员认为，治理小广告取证成本太高，不应让运营商承担。有关部门应该先准备一笔钱，如果“误杀”，机主可以带着身份证号码“报案”，城管、公安确认被冒用以后，立刻立案，马上退钱、恢复运营，甚至给予赔偿。
几个委员争先恐后发言，险些“吵成”一团。此时唐晓青委员掏出手机，“能不能用技术手段，既能不停机，又能让小广告发不成？”唐委员想到是不是可以像手机软件拦截垃圾短信一样拦截小广告。
还有些委员认为，治理小广告不能只靠堵，还必须“疏”。政府应选取一些正规的社区服务商和居民建立“联系”，让居民可以享受正规服务。让小广告失去市场。

希望手机、座机全实名全国可追责
据执法人员介绍，北京的小广告主要有三种，一是办假证的，因公安部门的介入及打击力度强，这部分小广告已很少见；另一种是租房、售房小广告，这部分占总数的70%至80%；另外就是超市、发廊开业等小广告，这部分较少。
据介绍，北京规定，对房地产小广告的查处，涉及房地产公司涉嫌组织散发的，可予以最高10万元的处罚。
为规避处罚，房地产公司便改变策略，将散发、张贴委托给第三方公司，第三方公司再临时招人，散发者为规避查处，则选择身上不带钱、不带身份证等方式“上岗”。
“所以只是理论上可以处罚，实际操作很难。”一名执法人员表示，城管部门曾对小广告上的号码进行停机处理，具体说就是从张贴的小广告上留下的电话联系后，确定为实施小广告者后，城管部门将电话报经上级主管部门批准后交予电信部门，由电信部门予以停机处理，但因《行政强制法》出台，此办法也被暂停使用。
“当时效果很明显。”执法人员表示，希望有关方面应该实施手机(包括座机)实名制，让执法部门可以在全国范围内追责，将电话停机，并建立黑名单，从根上杜绝小广告。
