举报半年之后平调邻县
在大荔县履新还不满1个月，任教训为儿子安排工资关系“吃空饷”事件，经过渭南市委的通报，被舆论聚焦。
中国青年报记者经检索发现，至少从2007年起，任教训就开始担任渭南市富平县城乡建设局局长，并于2009年下半年升副县长。这一任职持续到2013年下半年。
“吃空饷”事件，正发生在任教训担任富平县副县长期间。一则发表于2013年6月的举报网帖称，任教训有二子，大儿子出生于1990年，虽未大学毕业，其工资关系被安排至富平县齐村镇已有两年。
记者注意到，网帖部分内容与渭南市委如今的通报结果一致。举报帖发布半年后，2013年12月18日，任教训被大荔县人大常委会任命为副县长。
不到一个月，渭南市委公布了对任教训的处理结果。任此次调离富平县是否与其遭举报有关，记者未得到证实。
平调之后的任教训，负责大荔县城建、卫生、食品药品监督管理、人防等方面工作。但富平县、大荔县人民政府官网均未公布任教训的任职经历。
在北京大学政府管理学院教授李成言看来，任教训给上学的儿子安排工资关系属于典型的“吃空饷”，即某些人不在政府机关或事业单位工作，却照样在该单位领取工资。
中央机构编制委员会办公室2005年9月印发的《中央编办关于对“吃空饷”问题开展督促检查的通知》，将“吃空饷”现象分为五种：在编不在岗的；已经调离，但不办理核减编制等有关手续的；虚报人员编制，骗取财政拨款的；已经死亡未核销编制的；其他形式“吃空饷”的。
事实上，“吃空饷”的现象屡见不鲜。
据媒体报道，2005年，四川省南充市清理出2323名“吃空饷”者；2006年，甘肃省发现“吃空饷”者908人；2007年，山东省共清理出涉及违规人数11858人；2013年，河北省11个试点县清理出各类“吃空饷”人员1336人，涉及资金1065万元。
这些事件的处理结果，大多是党内处分、上缴工资、责任人免职等。
2012年春，山西省至少处理了两起“吃空饷”事件。2012年1月，原山西省静乐县县委书记杨存虎因安排其女“吃空饷”连续5年累计10余万元，被给予党内严重警告处分，并被免职。
一个月后，该省长子县原教育局局长李福刚同样因安排其子“吃空饷”，被免去教育局局长、党组书记职务，其子被清除出教师队伍，所领工资全额退回。
相较同类案件，任教训的处分明显轻了很多。
专家认为“吃空饷”就是贪污
事件调查结果公布之后，多家媒体质疑处分过轻。有网站戏称：“任教训就给这么点教训？”
广东邦仁律师事务所律师吴浚年则在微博上评论称：“副县长为国家工作人员，为上学儿子造工资单领钱属于骗取公共财物，其利用职务上的便利实施骗取公共财物的行为已经构成贪污罪。”
《中华人民共和国刑法》第382条规定：国家工作人员利用职务上的便利，侵吞、窃取、骗取或者以其他手段非法占有公共财物的，是贪污罪。
中国政法大学刑事司法学院教授洪道德认为，“吃空饷”就是利用职权把国家财产据为己有，这符合贪污罪的构成要件，应移交司法机关。
洪道德说，事件未启动司法程序，主要是因为纪检部门对事件的性质判断不准确，“他们认为这只是违纪，没有违法，特别是没有犯罪。他们在性质上认识有错误。”
他说，刑法对贪污罪已有明确规定，但如何将法律运用到具体案件上，则需要办案人员处理。然而，一些纪检部门对法律不熟悉，对事件的定性不合法律的要求。
“‘吃空饷’就是贪污。应该撤职查办，开除党籍。”李成言也认为。
在李成言看来，问题也是出在纪检部门对事件的定性上。通常，纪检部门认为官员通过一个名单“吃空饷”，不是直接贪污，不构成犯罪。同时，“吃空饷”现象太多，纪检部门可能形成法不责众、从轻处理的思维。
“这是利用权力侵占公共财物，是违法行为。”李成言强调，“公务员必须服从法律的制裁。”
在多数“吃空饷”事件中，党内处理成了刑事问责的“挡箭牌”。
李成言发现，制造“吃空饷”事件的人常常会“先受到党内处分，过段时间又获得任命”，“如果不是党内处理成了挡箭牌，而是直接移送司法机关或是行政撤职，可能就不会出现这样的问题。”
南开大学法学院副教授闫尔保告诉记者，按照党内纪律，处分的裁量幅度是阶梯式的。他推测，渭南市纪检部门在作出党内警告的处分时，可能考虑了各种各样的因素，如本人认错态度、当事人在本地的社会关系等等。
“吃空饷”折射人事和财务的“糊涂账”
事实上，“吃空饷”的背后，往往是一笔人事和财务上的“糊涂账”。
闫尔保说，目前，一些行政机关、事业单位的人事管理制度不健全，人员编制不透明，财务制度不清晰，导致很多人对本单位具体情况不了解，难以起到监督作用。这是“吃空饷”屡屡发生的原因之一。
“单位到底进了什么人？有没有进这样一个人？应该尽量把这种情况通过一定程序和渠道向社会公开。”闫尔保认为，人事制度透明化很有必要。
在多位受访学者看来，清查“吃空饷”并不难，因为档案中都有相关记载，一查就能查出来。
“但是，我们很多官员都不作为，知道这个人有背景有来头，所以谁都不敢查。”李成言表示，纪检监察部门应该加大监督力度，尤其是针对人事主管部门，“纪检部门目前没有完全发挥独立力量”。
李成言认为，这种监督力度必须延伸到执法过程中，避免官官相护、执法乏力的局面。
作为法学学者，闫尔保坚持认为“吃空饷”现象应按照法律程序处理，因为其中涉及贪污受贿的行为，属于严重违法。
“从‘吃空饷’的结果来讲，还应对涉事责任人，比如整个流程中起到关键作用的人，采取严厉的惩戒性措施，而且这种惩戒措施应当向社会公布，接受社会监督。”他强调。
李成言希望，对于“吃空饷”问题，社会形成“知法者应当严惩”的共识，公务员无疑是知法者，不能突破党纪的底线，更不能突破法律的底线。
他表示，如果出现这样“吃空饷”处分过轻，必然造成违法成本过低，导致类似现象“一而再、再而三”出现，“处理轻，他可以铤而走险，‘牺牲我一个、富裕全家人’。如果处理得重一点，他就不敢了、不想了，也不愿意去腐败了。”
“如果处理偏轻，不足以达到惩戒的效果，也不足以防止今后出现类似情况。”闫尔保也说，在他看来，现在年轻人找工作不轻松，而官员利用手中资源安排子女进入行政事业单位，甚至不用去上班还能领工资，此举明显违反党纪国法。
记者注意到，从目前来看，任教训的仕途似乎未受明显影响。事件通报的当天，大荔县人民政府网站还发布了任教训调研指导大荔县住房和城乡建设工作的消息。3天后，任教训继续出席县重点工作进展情况汇报会。
