包头市第六医院又名包头市精神卫生中心，是内蒙古地区规模较大的市级精神病专科医院，也是包头市唯一一家具有法医精神病鉴定资格的专业鉴定机构，承担着包头及周边盟市精神病鉴定工作。被告人陈富仁、党仁、张灵娥、宋培义、李丽琴、张珍、王晶分别为包头市第六医院原临床一、二、三、四科主任、心理科主任、医务科主任、主治医师，其中党仁与李丽琴为夫妻。
法院审理查明，被告人党仁、王晶、李丽琴、陈富仁、张灵娥、宋培义身为包头市第六医院的医务人员，在诊疗活动中，利用开处方的职务便利，收受医药代表王勇等多人的药品回扣，分别为71万余元、43万余元、33万余元、25万余元、17万余元、8万余元，其行为构成非国家工作人员受贿罪。
与此同时，被告人党仁、陈富仁、李丽琴、宋培义、张珍等5人身为该院司法鉴定所鉴定人员，在精神病司法鉴定过程中收受被鉴定人家属的好处费，为被鉴定人谋取利益，帮助被鉴定人免除或减轻刑事处罚，法院共认定此类受贿案件共5起，其行为构成受贿罪。
记者从包头市东河区人民法院获悉，精神病司法鉴定过程中收取好处费成为该院医生敛财的重要手段。2011年冬季，鄂尔多斯市中级人民法院委托包头市第六医院司法鉴定所对王首达有无刑事责任能力进行法医精神病司法鉴定。被鉴定人王首达亲属找到被告人宋培义、党仁等鉴定人，要求对王首达给与关照。之后包头市第六医院司法鉴定所出具了被鉴定人王首达为限定刑事责任能力的鉴定结论。鄂尔多斯市中级人民法院依据该鉴定结论对王首达从轻处罚。之后，党仁、张珍、宋培义、陈富仁、李丽琴等收受被鉴定人亲属所送感谢费每人5000元。
2012年7月，包头市东河区公安分局委托包头市第六医院司法鉴定所对犯罪嫌疑人刘智亚有无刑事责任能力进行法医精神病司法鉴定。在鉴定过程中，被鉴定人家属通过被告人李丽琴的亲戚王锡利找到被告人李丽琴、党仁，提出在鉴定过程中给予关照、帮助，期间收受王锡利送来的人民币共计13000元。之后刘智亚被鉴定为无刑事责任能力人，包头市公安局东河区分局依据此结论对刘智亚涉嫌放火罪一案作出撤案的决定。
法院依据上述事实，分别判处被告人党仁有期徒刑7年6个月；李丽琴有期徒刑6年6个月；陈富仁有期徒刑5年8个月；宋培义有期徒刑3年6个月；王晶有期徒刑6年6个月；张灵娥有期徒刑5年；张珍有期徒刑1年6个月，缓刑2年。
此外，江苏省恩华药业有限责任公司包头地区销售代表王勇，在包头市第六医院推销药品期间，为提高药品销量，以相应的回扣标准并按推销药品处方量的多少给开具处方的医生药品回扣共24万多元。被告人王勇犯对非国家工作人员行贿罪，判处有期徒刑3年，缓刑4年，并处罚金1万元。
一审判决后，被告人党仁、李丽琴、陈富仁、宋培义、王晶、张灵娥提出上诉，包头市中级人民法院已受理。(完)
