  乔宝仙在河北省涿州市经营着一家不锈钢加工厂。2007年,因土地升值,他被其公司的土地使用权转让方告上法庭,要求其返还的,却是另一块土地的使用权证。


  次年,经过3次审理,乔宝仙收到来自河北省保定市中级人民法院(以下简称“保定中院”)的民事调解书,调解书中要求乔宝仙将另一块土地的使用权证还给原告。因不认可其中内容,他没有签收。


  而到了2010年,该民事调解书却被涿州市人民法院(以下简称“涿州法院”)执行,且实际执行的内容与调解书内容颇有不符。


  如今,乔宝仙已向涿州法院提交《执行异议申请书》,至于结果,他还在等。


  地价上涨“惹的祸”


  事情还需追溯到1997年。那一年,乔宝仙43岁,生意做得红红火火。为扩大业务,他花了94万元,在涿州市区拿到两块面积均为9亩3分的土地。两块土地每块47万元,一“买”一“借”。


  “买”来的地位于涿州市东兴北街(以下称“A块地”),在交完47万元款项后,乔宝仙就拿到了该块地的土地使用权证。


  “借”来的地(以下称“B块地”)紧邻A块地,由涿州市清凉寺构件厂(以下简称“构件厂”)为乔宝仙出具了一张47万元的地款收据以及一张借条。构件厂承诺,若借款不能返还,则将土地使用权交给乔宝仙。但至今,乔宝仙既没有收回借款,也没有拿到地。


  记者拿到的资料显示,A块地事实也是从构件厂获得,构件厂为A块地同样给乔宝仙出具了一张47万元的收据,不过当乔宝仙拿到A块地的土地使用权证时,上面显示的使用权人为涿州市清凉寺建筑公司第六工程处(以下简称“第六工程处”)。


  一眨眼十年过去。2007年,构件厂厂长李福春找到乔宝仙,向他要钱。


  “他(李福春)当时跟我说,自己经济上比较困难,地现在涨价了,让我给他点儿钱。他要二三十万元。”乔宝仙对法治周末记者说:“我当时经济也紧张,正找他要那47万元借款呢。当时,我的母亲和妻子都得了脑血栓,需要钱看病、请保姆。”


  从1997年至今,作为北京“卫星城”的涿州市地价直线疯涨,从最初的一亩四万多元飙升至几百万元。


  乔宝仙拒绝了李福春的要求。后者将乔宝仙诉至涿州法院,要求其返还A块地的土地使用权证原件。


  “我咨询过涿州法院工作人员。法院的人说,因为A块地土地使用权证上显示的土地转让方为第六工程处,构件厂不具备起诉资格。除非构件厂能证明自己与第六工程处的关系。”乔宝仙对记者说。


  出于气愤,他对构件厂提出了反诉。


  法治周末记者试图联系李福春了解案件的相关情况,但截至发稿前,仍未联系上李福春本人。


  被“混淆”的两块地


  2007年9月20日,涿州法院作出一审判决,判决乔宝仙返还A块地土地使用权证给构件厂、构件厂给付乔宝仙借款47万元及利息。判决理由有两个:一是涉案土地在办理土地使用权证过程中,税费及罚款都由构件厂缴纳,法院据此认定,土地使用权归构件厂所有;二是乔宝仙反诉时提供了涉案土地相关收据和借条,法院对其诉求予以支持。


  乔宝仙不服返还土地证的判决,上诉至保定中院。2008年2月,保定中院作出民事裁定,对此案发回重审。5个月后,涿州法院再次作出判决,内容与上次基本相同。


  乔宝仙不服,再次上诉。当年9月24日,他等到了来自保定中院的民事调解书。调解书依然基本维持了涿州法院的判决。


  “我依然不认可调解书中要求返还土地使用权证的内容。我手里的这个证是第六工程处的证,没说是构件厂的证。而且这证也不是李福春为了借款而抵押的那块土地的。”乔宝仙认为,李福春要求返还的土地使用权证以及法院最终判决李福春归还自己的47万元借款,这二者所代表的是两块土地,“只是亩数一样”,法院混淆了两块地的情况。


  这是乔宝仙没有签收调解书的原因,也是他至今未将A块地土地使用权证交出去的理由。


  “当时没办抵押手续。”乔宝仙说。


  在乔宝仙的律师崔麒看来:“法院始终都没讲清楚,这两块地和两个47万元到底是怎么回事。”


  “后来李福春也没拿到B块地,就被重新收回做开发了,当然这块地也不可能给我,还把我的钱给坑了。”乔宝仙无奈地说。


  这场土地纠纷的另一个关键主体,是第六工程处。


  之前庭审中,构件厂曾陈述:“涉案土地使用权人第六工程处是虚构的,为了逃避土地的审批。但构件厂向公安机关提供了资料办理公章。”


  如前所述,法院经调查发现涉案土地在办理土地使用权证过程中,相关款项都由构件厂缴纳,并认定土地使用权归构件厂所有。


  但崔麒看来,这些证据不足以直接证实构件厂就是A块地的使用权人。


  “如果第六工程处是合法的涉案土地使用权人,那构件厂作为原告提起诉讼显然不适格。如果构件厂认为涉案土地使用权归其所有,应当向当地土地管理部门申请变更。”崔麒对记者说。


  调解书能否生效


  2010年,乔宝仙的母亲和妻子相继去世。悲痛之余,他依然为官司奔走。这份他并不认可的民事调解书,却在当年由涿州法院执行。


  乔宝仙说:“之前法院只是问我调解书收到没有,我答收到了。法院以此认为调解书生效并送达。”


  “实际上,是否签收才是调解书是否生效的关键。法院应当查阅卷宗,进行核实,而非单纯询问当事人。”崔麒律师说。


  2013年11月25日,法治周末记者分别赴保定中院和涿州法院,提出采访要求。


  在记者数次联系相关部门后,2014年1月7日,该案保定中院主办法官张峰先对此作出答复。他对记者说:“乔宝仙手里有调解书。既然有,就证明调解书已经生效了。”


  在由乔宝仙提供的调解笔录复印件上,记者看到有多处删改且字迹模糊。对此,张峰先法官解释道:“当时没有现在的打印设备,改动的部分都是手写,然后摁手印。调解书不是一次形成的,和调解协议的内容也完全一致。我认为没有问题。”


  调解笔录正文最后一句话为:“以上协议不违反法律规定,双方签字即生法律效力。”对此,乔宝仙表示:“当时签笔录时,并没有这行文字。”


  1月16日,涿州法院政治处主任陈雷对记者表示:“我们经过审查,送达已经生效,没有问题。”而对于记者提出“执行前审查调解书是否生效的具体依据”,涿州法院并未回答。


  “如果乔宝仙认为有不合法(之处),可以走申诉的途径。”主办法官张峰先说。


  从判决至今,乔宝仙及其律师已反复多次提及调解书有没有生效的问题,并数次请求相关法院予以重视,均未得到任何明确的答复。


  “我们还曾经尝试给保定中院某位院长写信,反映这是一起‘乌龙案件’,也跟保定中院的业务庭、立案庭、分管院长等多部门的数人反映,都石沉大海。”乔宝仙说。


  被质疑的执行


  乔宝仙对涿州法院的执行也提出了异议。


  2010年11月,涿州法院向涿州市国土资源管理局发出协助执行通知,要求注销A块地原土地使用权证,并重新办理。通知书记载的申请执行人为构件厂。


  一年后,涿州法院又向涿州市国土资源管理局发出协助执行通知,要求将涉案土地A块地的土地使用权变更到李福春个人名下。这次通知书记载的申请执行人为李福春。


  在乔宝仙和崔麒看来,若民事调解书生效,涿州法院执行的唯一合法依据,应当是民事调解书载明的:“乔宝仙自调解书生效后十日内,将双方借款抵押协议所涉及的证号为1995—030149号土地使用权证原件返还给涿州市清凉寺构件厂。”


  崔麒认为,涿州法院的实际执行内容,通过变更申请执行人、要求变更土地使用权人等方式,将本应返还证件的行为,执行成变更土地使用权的做法,使案外人李福春瞬间获利数千万元(基于当时涿州的地价)。


  “按照民事调解书的执行内容,只能是返还土地证原件,并没有赋予执行法院注销原件、重新办理土地使用权证的权力,更没有赋予执行法院通过故意模糊申请执行人名称、擅自变更土地使用权人、为李福春个人办理土地使用权证的权力。”崔麒分析称。


  2013年11月5日,乔宝仙向涿州法院提交《执行异议申请书》,请求法院依法撤销民事执行裁定书及相关协助执行通知书,并驳回被申请人、即涿州市清凉寺构件厂的执行申请。


  对此,涿州法院陈雷主任对记者表示:“乔宝仙对调解书的内容已经提出异议,涿州法院执行局要进行审查,走听证会的程序。目前只能回答到这个地步。”


  对于执行的具体依据,涿州法院方面亦无明确回答。


  乔宝仙和崔麒分别告诉记者,自己目前尚未接到任何关于听证会的消息。而构件厂早因连续两年没有年审而被吊销营业执照。这起因土地而起的纠纷,仍飘在空中。
