在行政问责方面，上海环保将会同纪检监察部门加大对违法企业的行政问责力度，对环境违法的国有企业，情节严重的，要追究企业负责人和相关人员的责任；对不办理相关手续，盲目引进环境污染严重企业的村镇，要追究相关负责人员的责任；对空气重污染应急预案执行不力的部门和单位，严格追究有关人员责任。同时，加强部门联惩联治，将环境违法行为与“企业信贷”、企业上市环保核查和企业评奖评优等政策措施相挂钩，对环境违法的企业，在企业商业贷款、企业上市、企业评奖评优中将受到严格限制，有些领域实行环保“一票否决”。
在刑事追责方面，目前，上海环保部门正会同公安、检察院、法院等司法机关，建立环境违法案件的行刑衔接机制，加大对环境违法行为的刑事打击力度，重点加大对六方面领域的刑事追究力度，即在饮用水水源保护区内排放、倾倒、处置有毒物质的；非法排放、倾倒、处置危险废物的；超标排放重金属或者持久性有机物的；私设暗管或者利用渗井、渗坑等方式排放、倾倒、处置有毒物质的；两年内受到环境行政处罚三次的；造成环境损害30万元以上的。
