  业主起诉鄞州区政府


  昨天下午两点半,宁波市中级人民法院一号审判庭座无虚席,数百名业主前来旁听。


  邱隘镇政府在没有羊毛衫市场拆迁许可证的情况下实施强拆,在申请要求鄞州区政府对此行政行为作出复议遭拒绝后,又起诉法院要求政府作出行政复议,但先后又被鄞州区人民法院、宁波市中级人民法院以理由不足不予支持为由驳回。


  2013年8月,浙江省高院对邱隘羊毛衫市场违法拆迁行政诉讼作出判决,撤销了鄞州区政府和宁波市中院不予受理的裁决,并“责令鄞州区政府在法律规定期限内重新作出复议决定”。


  本报对此案进行报道后,2013年10月,鄞州区政府对此案召开了行政复议听证会,并于同年10月28日作出行政复议决定:“确认被申请人宁波市鄞州区邱隘镇人民政府于2012年9月12日拆除邱隘羊毛衫市场房屋的具体行政行为违法。”但对业主要求房屋恢复原状或赔偿损失的请求不予支持。


  被告坚持房子收购不予赔偿


  昨天业主起诉了鄞州区政府,也将涉及此案的邱隘镇政府、东部新城开发建设指挥部列为第三人。


  被告方鄞州区政府认为,邱隘羊毛衫市场地块目前已经隶属于东部新城范围,规划为建设重点项目“明湖”,属于公共用地,因此市场房屋已经不能恢复原状,对于违法拆迁事实造成损失的赔偿责任,则也不支持。


  被告委托代理人在庭上表示,就因为当初业主与政府已经签订了拆迁补偿协议。代理人说,虽然拆迁没有合法许可,“但是事实上,房子已经是政府进行了收购。”因此政府有权进行拆迁,很多业主已经拿到了钱,他们认为并未对业主的利益造成损害,因此不予赔偿。


  第三人东部新城建设指挥部表示,当时的补偿款是由他们支出的。对于同样房屋补偿金额相差很大的问题,被告代理人表示房屋价格是经过评估的。


  原告律师称违法必须赔偿


  对于被告的说法,原告业主方代理律师表示,事实上直到现在市场房屋的产权登记还是业主的,但房子却被强拆了。鄞州区政府也已经承认拆迁是违法行为,因此承担赔偿责任是肯定的、必须的。


  记者从起诉书中看到,这次原告将赔偿的数额也进行了计算,除去已经拿到的补偿款,16名原告业主总赔偿数额达到了六七千万元。其中少的数百万元,多的则达1000多万元。据介绍,这个赔偿数额是原告根据现在的邱隘镇政府拆迁补偿标准进行计算的。


  昨天下午庭审进行了两个多小时后,法官表示将择日作出判决。
