今天上午，记者从市政府法制办获悉，禁令不走立法程序，因此将不会以法律法规的形式颁布。一旦出现重污染，本市有可能以政府相关部门颁布文件的形式来“预告”禁放。
春节如果遇到橙色及红色污染预警，本市将禁止燃放烟花爆竹。早在1993年，北京曾经以立法的形式实施禁放，即1992年10月12日北京市第十届人民代表大会常务委员会第六次会议通过的《北京市关于禁止燃放烟花爆竹的规定》。
1993年12月1日，禁放规定正式生效，直到13年后的2006年才废止。
如遇重污染天气，本市是否还会通过立法形式出台相关法律法规禁放？今天上午，记者通过市法制办了解到，今年本市的禁放工作不会通过立法来实现。
法制办的相关人员介绍，首先，一个立法程序从调研起草到出台实施，最少也要经过半年时间才能走完流程，目前距离春节只剩几天时间，从程序上讲不可能再有新的立法启动；其次，法制办目前也没有相关的立法工作安排。
从政府工作的程序上看，如果禁放令不是通过立法向市民颁布，那么则有可能通过相关政府部门发布“禁放”文件，向广大市民告知，让市民做好禁放准备。
此前媒体报道称，市环保局大气处相关负责人表示，春节前所做的污染预报将不仅仅考虑气象因素，还会考虑到烟花燃放可能产生的污染值，综合作出空气污染预报。
这也意味着，即便原本的空气质量达不到橙色或红色预警程度，但如果碰上燃放高峰，考虑到燃放可能会把空气污染值“抬高”成重污染或严重污染程度，本市也会发布重污染橙色或红色预警。
北京市公安局治安管理总队副总队长于连伟告诉记者，北京市将通过手机平台、媒体等提前向市民发布相关预警信息，对于坚持在重污染天气燃放烟花爆竹的市民，公安机关将以劝导为主，而对于不听劝导甚至殴打辱骂劝导人员者，将由公安机关依法处罚。

通知要求，春节期间，全市各级党政机关、事业单位和国有企业严禁用公款购买烟花爆竹或组织燃放，纪检监察部门要做好监督检查。
各区县、各部门、各单位要严格落实《北京市人民政府关于印发北京市空气重污染应急预案(试行)的通知》有关要求，做好春节期间应对空气重污染应急准备工作，强化应急预案职责的落实。在本市发布空气重污染橙色、红色预警时，严格执行禁止燃放烟花爆竹等规定。
通知还要求，春节期间，全市党员、干部要带头不放、少放烟花爆竹；市有关部门利用多种形式广泛宣传烟花爆竹燃放对空气造成的污染和对广大市民身体健康带来的危害，呼吁广大市民少放、不放烟花爆竹。
