多地小产权房清理工作陷入困境|小产权房|房管|国土部_新闻资讯

  央广网北京1月27日消息(实习记者董凌鑫)据中国之声《央广新闻》报道,连日来,国土部多次强调小产权房的违法性质,并表示“将全面清理小产权房”。然而在“高压”政策下,小产权房在一些地方的销售却依然火热,地方政府的清理工作陷入困境。那么各方对小产权房的处理有什么争议?


  有专家认为,小产权房是城市房地产市场需求膨胀与我国土地制度滞后之间矛盾的产物,而农村土地制度的不完善则是造成小产权房产生的根本原因。从形成原因来看,要根治问题就要从供给端和需求端两方面去解决。随着十八届三中全会通过的《中共中央关于全面深化改革若干重大问题的决定》提出,要“建立城乡统一的建设用地市场”, 实现农村集体土地“同权同价”,土地供应就将从单一的政府征地逐步转变为包含农村集体土地流转的双轨制供应,这实际上是对城乡二元化土地制度的一种改革,也就是从供给端解决问题的一种方法。


  另外,此前习近平总书记在中央政治局的学习中提及对房地产调控重点将放在保障房的思路,构建以政府为主的基本住房保障,并重申3600万套保障房要全力完成。保障房体系的进一步完善,其实也是从需求端解决小产权房问题的一种方式。


  有专家提出,可以详细调研现有小产权房,在卫生环境和交通条件成熟而又不影响市政规划的地方,将空置小产权房改为养老院,其产权性质不变,由当地村镇来组建企业经营管理,条件合格者由政府核发牌照,有关部门严格监管。这样既可以解决部分新建的小产权房问题,又可以缓解老年人服务产业发展滞后的矛盾。


  这种说法其实是给地方政府提供了一种处理小产权房问题的思路。条件不错的小产权房是不是可以不用拆除,而是改建成为集体福利设施。不过这种方案实施起来也并不轻松。所以还有专家建议,接下来的工作重点在于土地确权上,这是土地流转的基础,一方面明晰产权可以最大程度保护农民利益,另一方面还将奠定农地流转和建立城乡统一的建设用地市场的基础。在农村集体土地流转方面,近年来安徽、成都、天津等地都已进行了积极试点。三中全会之后,土地流转上可能给地方更大的自主权。接下来就看各地当政府怎么因地制宜了。
