市河湖管理处主任获死缓
身为北京市城市河湖管理处主任，李柱却以批准承包工程为由，索要现金、车、房子等。
被纪委调查后，李柱将房子过户给出资人，自己则继续住在里边直到被抓。
记者今日获悉，一中院一审以犯受贿罪和贪污罪，判处李柱死刑缓期二年执行，没收个人全部财产。其被认定受贿金额为1100余万元，贪污4800余万元。
《法制晚报》是最早报道这起北京水务系统窝案的，自2011年7月27日，首篇曝光报道《永定河引水渠闸口被指建会所》中，当事单位给出的"职工食堂"的说法便引发质疑。本报连续对永定河引水渠海淀双槐树闸口违法建设进行了报道后，引起社会广泛关注。之后，市河湖管理处负责人被抓。
可以说本报系列报道的刊发，揭开了这起本市水务系统内发生的最大一起职务犯罪窝案。
指控11年贪污受贿6413万
现年59岁的李柱是北京市人，曾先后担任市清河整治工程建设管理处主任、市东水西调管理处主任。被抓前，他则是北京市城市河湖管理处主任。
检方指控，李柱从2000年至2011年，共受贿10笔，金额共计1113万元。11年间，李柱先后向10家企业，索要现金、房子、购物卡及宝马车等，平均每年受贿100余万元。
李柱被控的第二项罪名是贪污罪。在1989年至2011年间，他采取签订虚假工程协议等手段，通过北京市水利建筑工程处第五施工队和北京都恩工程有限责任公司、北京市宏达工程公司的账户，骗取公款共计5300余万元。
受贿·房被纪检部门调查把别墅过户给出资人
据检方指控，2000年至2008年间，李柱利用担任北京市清河整治工程建设管理处(下称清河管理处)主任、北京市东水西调管理处(下称东水西调管理处)主任的职务便利，为北京绿视点园林景观工程有限公司(下称绿视点公司)顺利获得河道整治、南水北调市内配套拆迁与恢复等工程提供帮助，先后两次向该公司法定代表人刘某索要昌平区北七家镇的蓬莱苑别墅一套，购房款及税费共计199万余元，装修费40余万元。
据李柱供述，2000年，他是通过朋友介绍认识了刘某。买房的手续是他和刘某一起去办的，房产登记在了其妻名下。
2007年5月，水务局纪检调查李柱的房产情况。后李柱将蓬莱苑别墅过户给刘某，但刘某并未支付房款，李柱也并没有搬离，一直住到2011年被抓。
刘某证言显示，2001年，其与几个人成立了绿视点公司。2000年他因分包工程认识了李柱，当时李柱任清河管理处处长。据刘某称，李柱在任期间，绿视点公司通过李柱承接的工程总金额有4000余万元。
受贿·车
要了宝马不敢开又让人买路虎
李柱不仅要房，还要车。
李柱称，其帮彭某协调接洽过北京翔鲲水务建设有限公司等几家水务系统公司的工程。2000年，李柱提出要买车，彭某花78万元给他买了一辆宝马5系。但由于该车太显眼，明显与其收入不匹配，加上车子又是套牌，总有罚单，其很少开这辆宝马。2007年，水务局纪检曾查过其是否开宝马车的事，其就不再开宝马了。为了方便，李柱又让绿视点公司的刘某买了一辆路虎。
检方指控，李柱曾向绿视点公司和北京都恩工程有限责任公司索要过两辆车，金额共计131万元。
刘某证言显示，2008年10月，做完南水北调配套工程后，李柱提出想要一辆黑色路虎神行者，刘某和公司另一股东商量后决定给李柱买，总费用花了53万元。当时李柱怕出事，把车登记在了刘某名下。
受贿·钱
借儿子留学等直接捞现金
除了要车、要房，儿子出国留学当然也成了李柱捞钱的机会。
检方指控，2006年至2007年间，时任东水西调管理处主任的李柱，为京水公司承揽林萃路及北苑路北延跨清河桥项目的审批提供帮助，4次向该公司项目部经理张某(另案处理)索要200万元人民币、10万澳元(折合人民币600390元)。
李柱称，2000年，其在清河管理处时认识了张某。2007年年初，张来其办公室聊天，问其用不用帮忙换美元，因儿子要去澳大利亚留学，李柱便问能不能换澳元。
2月初，张某拿来一个装有5万澳元的信封到李柱办公室，李柱收下了。
2月底，另外5万澳元换好了，张某还另外准备了80万元现金，但这80万元李柱没收。2007年上半年，张又来到办公室，说公司要建两座桥，问其需要多少费用，李柱反问："你说呢？"张说每座桥给其100万元，李柱同意了，让张回去准备材料。后张某公司和京水公司签订施工管理协议。7月和12月，张在单位分两次给了李柱200万元。
张某的证言显示，李柱曾多次暗示他两座桥的利润不低，并向其要200万元。当时由于材料、工人已经进场，拖延开工会产生大量费用，于是他才答应了李柱的要求。
另据检方指控，2009年至2011年间，李柱利用担任河湖管理处主任的职务便利，为北京网信通信息技术有限责任公司(下称网信通公司)获得中国联通北京市分公司等单位通信基站设施建设业务提供便利，多次收受该公司总经理王某、副总经理孙某(均另案处理)给予的60万元人民币及价值30万元的购物卡和消费卡。
审理受审辩称都是行贿人主动给钱
检方指控，2001年至2011年间，李柱为北京文雪苑园林绿化有限公司(下称文雪苑公司)承揽多项河道保洁、绿化维护等工程提供帮助，先后两次向该公司负责人袁某(另案处理)索要100万元。
袁某称，2000年之前，其施工队曾为李柱的工程干活儿，由于质量比较好，逐渐获得了李柱的信任。
2009年4月和2011年6月，李柱称他需要用钱，袁某用公司的劳务费和利润凑钱，分两次在其家门口交给李柱。袁某说，李柱要钱，他不敢不给，否则以后就拿不到活儿了，而且李柱还有一些工程款没结，所以其要跟李柱搞好关系。
法庭上，李柱对指控有异议。他称对其向刘某和彭某索要的路虎牌、宝马牌轿车，系其向二人借用的车辆；对于指控其索贿200万元，李柱称是其帮助他人的借款。
另外，李柱称没有收受李某给的100万元现金，曾有侦查人员对其进行诱供，并称自己不存在索贿情节，都是行贿人主动给的。
对于指控其犯贪污罪，李柱辩解称，水务局领导同意其使用第五施工队承包工程搞创收；其自行出资为工程先期垫资，工程完工后，其有权支配工程款。
判决
受贿贪污两罪并罚获死缓
法院经审理，将李柱的受贿和贪污金额进行了重新认定，认定其受贿1100余万元，贪污4800余万元。据悉，李柱被抓时，侦查人员从其家中扣押 现金442万元人民币、美元38920元、欧元26149元、澳元36800元、加元10元、不丹币21元以及金银条、金银币等物品。
一中院审理后认为，李柱身为国家工作人员，利用职务上的便利，以签订虚假工程合同等方式侵吞、骗取公款，其行为已构成贪污罪；身为国家工作人员，其索取他人财物，或非法收受他人财物，为他人谋取利益的行为亦构成受贿罪。
检察院指控其向惠新吉索要200万元的证据不足，法院不予认定。
李柱的部分受贿罪行为具有索贿情节，依法予以从重处罚。
鉴于李柱在双规期间主动交代了司法机关尚未掌握的部分受贿事实，可认定为自首，且案发后部分赃款、赃物以及用赃款购买的房产、物品已追缴在案，依法可对其予以从轻处罚。
据此，法院最终以犯贪污罪，判处李柱死刑，缓刑二年执行，剥夺政治权利终身，并处没收个人全部财产；犯受贿罪，判处其无期徒刑，剥夺政治权利终身，并处没收个人全部财产，决定执行死刑，缓期二年执行，剥夺政治权利终身，并处没收个人全部财产。
第1次曝光
2011年7月27日，本报对永定河引水渠双槐树闸口兴建违法建设，出租办私人会所的情况进行了报道。许多读者打电话或在网上留言，对河湖管理处有关人员称闸口建筑是“职工内部食堂”的说法提出质疑。
第2次曝光
2011年8月15日，本报以《是私人会所不是河湖职工食堂》为题，对该事件进行了追踪报道。北京市规划委员会组成联合执法队，经过调查认定闸口一带违法建设达3000平方米，并对违法建设进行了查处。
在调查过程中，河湖管理处出示了两份文件，而经查证，这两份文件有伪造的嫌疑。
第3次曝光
2011年9月2日，本报刊发《河湖管理处涉嫌伪造市规委文件》一文。
文章中，市规委工作人员告诉记者，这两份文件涉嫌伪造，已向上级领导和有关部门报告，警方已经介入调查。
第4次报道
与第3次报道时隔3个月后，被曝光的闸口违建虽仍在施工，但由于北京市河湖管理处涉嫌伪造国家机关文件，市规委于是向公安机关报案，河湖管理处负责人被抓。事件又一次有了新进展。
最终
本报的系列报道揭开了本市水务系统内最大一起职务犯罪。据本报2013年10月25日的报道，该窝案至少已有7起案件落判。
