私彩赌博违法犯罪案件为何屡禁不绝？《法制日报》记者就打击“六合彩”、“3D”等私彩赌博违法犯罪情况，采访了辽宁省公安厅治安总队政委孟冰。
孟冰告诉记者，此类犯罪久打不绝有四大原因：暴利诱惑欺诈诱导、操作简便手法隐蔽、参赌人员涉及面广、法律法规震慑偏弱。
私彩赌博向城镇蔓延
孟冰向记者介绍，“六合彩”、“3D”私彩赌博是由香港“六合彩”、国家福利彩票“3D”玩法衍生而来，是个人非法操控以这两种开奖方式为依托演化成的赌博方式，具有很强的诱惑性、欺骗性和隐蔽性，且传播速度快，渗透力强。
近年来，此类私彩赌博在辽宁省城镇、农村呈蔓延态势，受害人员众多，在辽宁少数几个地区仍未能彻底根除。
“‘六合彩’、‘3D’私彩赌博害人害己，但屡打不尽。”孟冰说。
从2013年5月开始，辽宁警方在全省范围内组织开展了严厉打击“六合彩”、“3D”等私彩赌博违法犯罪专项行动，对“六合彩”、“3D”私彩赌博实施围剿打击。
在辽宁警方侦办的抚顺县海浪乡“六合彩”赌博案中，海浪村的一户人家，父母、兄弟、姐妹、妯娌共同经营“六合彩”，各自发展下线，全村参与赌博的近百人，有的村民因欠赌债长年不敢回家，妻离子散；有的靠政府救济，无法正常生活。
编中奖消息刺激彩民
孟冰告诉记者，私彩赌博如此吸引人，一个主要原因就是暴利诱惑，欺诈诱导。
庄家通过以所谓玩法“灵活、高赔率、高奖金、易中奖”来刺激群众一夜暴富的心理，具有极强诱惑性。有些人因致富无门，生活看不到“奔头”，因此陷入“六合彩”泥潭不能自拔。
在破获的私彩赌博案件中，返奖比例多为80%以上，表面上中奖率远远高于国家发行的正规彩票，然而，一旦彩民中大奖，庄家就会逃得无影无踪，彩民的利益根本得不到保障。庄家为了诱使更多群众购买私彩，往往编造某地某人中了几万元、几十万元乃至上百万元的消息，这些消息犹如“强心剂”般促使彩民更疯狂地进行私彩赌博。
“为吸引更多人参与私彩赌博，庄家故意编造出各种各样的‘玄机图’、‘彩诗’等供人们竞猜。”孟冰说，有的庄家甚至暗中指使人装疯卖傻或蓄意让一些精神病患者透露“中奖特码”，放风说“痴仙”提供给自己的“特码”中了大奖等，使不少人落入圈套。
另外，私彩赌博操作简便、手法隐蔽，不法分子通过电话、网络、传真报号，参赌者无需掌握任何技巧，往往不需要现金即可购买，第二天有专门人员负责收钱兑奖，投注的金额多则成千上万元，少则数元，可以用电话随时随地联系参赌。
孟冰表示，私彩赌博参赌人员涉及面广，已经由农村向城市蔓延，参赌人员包括农民、城市职工、商人、学生，甚至还有基层党员干部等。庄家通过“中线”发展“下线”小庄家，形成“金字塔”式类似传销的较为严密结构，而且涉案金额越来越大。
2013年11月28日，沈阳警方获取一条线索，称一个特大赌博犯罪团伙在该市利用互联网进行“六合彩”进行赌博，参加人员众多，涉赌金额巨大。该市警方根据线索一举摧毁了以刘某、钟某等人为首的“六合彩”赌博团伙，先后抓获涉案团伙成员70余人，涉案金额达两亿余元。
孟冰表示，私彩赌博犯罪操作方便、区域跨度大、涉案金额大、犯罪收益高，而相关法律法规滞后，震慑偏弱；执法部门对私彩与赌博行为难以界定，对经营私彩的处罚缺乏准确的法律依据，此类犯罪的高收益及其产生的社会危害性与量刑偏轻形成强烈的反差，使刑罚功能对此类犯罪难以起到有效的震慑作用，致使很多不法分子铤而走险，屡教不改。
□说“法” 治理私彩赌博需多部门联动
赌博不仅仅是治安问题，也是社会问题，它不仅毒害社会风气，还危及家庭稳定。赌博债务纠纷极易导致家庭破裂，甚至引发恶性犯罪，严重危害社会治安稳定，因此，各地都在加大综合治理力度，构筑全民参与的禁赌格局。
打击私彩赌博活动单靠公安一家力量是薄弱的，要充分调动社会各界力量，营造浓厚的禁赌工作氛围。在工作中，要充分发挥党、政、工、青、妇等组织和团体的作用，各类媒体也要对禁赌工作情况及时宣传报道，让禁赌拒赌观念深入人心，使群众自觉远离赌博。目前，辽宁省已将治理“六合彩”、“3D”私彩等赌博活动纳入到建设社会主义新农村、构建和谐社会的考核内容中。在各级综治委领导下，组成禁赌工作领导小组，以纪委、宣传部、法制办、公安、检察院、法院、民政、体育、工商、银监、通信等职能部门为成员单位，统一部署，形成联动工作格局。韩宇

经查，王建晖与海南省海口市的吴清雄是经营私彩的合伙人。吴清雄在海口市雇佣邓正考等人非法销售“七星彩”黑彩，获利后吴清雄和王建晖按比例分成。同年7月27日，警方在南岗区宣化街王建晖的“七星彩”私彩工作站，将正在收账的王建晖抓获。同时，警方在海口市将吴清雄抓获。两名主要犯罪嫌疑人到案后，供认了其他赌博“下线”人员的行踪。8月1日，警方在海口市龙华区将邓正考抓获。据王建晖、吴清雄供认，2006年，王建晖在海口市结识了吴清雄，二人商定，王建晖在哈尔滨市当庄家，吴清雄负责在海口市联系经营“七星私彩”下线，赚取10%的赌资提成。
2010年3月，二人正式开始经营“七星彩”。吴清雄联系了邓正考等5名多年在海口市贩卖“七星彩”的私彩站业主，从他们手中收购彩票，按销售金额8%的利润返现金，吴清雄自己留2%作为合作条件。从2010年3月至9月，赌资流水金额约800万元，王建晖非法获利199余万元，吴清雄非法获利15万元，邓正考非法获利3万元。
