  北京市《房屋登记工作规范》修订稿公开征求意见

  修订稿与此前规定相比,增加新建商品房初始登记后的备案要求,今后购房人可单方办理房产证。对于新建商品房,按此前规定,应当由开发企业先办理初始登记,再为购房人办理转移登记。


  北京市住建委相关负责人表示,由于购房人较多,开发企业均是分批申请办理;又由于办理登记需买卖双方共同申请,在开发企业不配合的情况下,购房人无法单独申请办理自己的产权证。


  为了方便购房人及时办理产权登记,修订稿规定,房地产开发企业完成房屋初始登记后,应当在房屋登记部门办理房屋转移登记备案手续,将企业应当提交的身份证明、委托书等申请材料事先一次性提交登记部门,购房人届时只需持本人身份证件、买卖合同等相关材料即可随时自行办理产权证,但房屋地址、面积和价款有变化的,还应当提交与开发企业签订的补充协议。


  该负责人表示,这一要求不仅方便购房人根据自己的时间安排随时办理产权登记,也减轻了开发企业多次协助购房人办理转移登记的负担;同时缩减了申请材料的复印数量,又给登记档案减了负。


  赠与合同公证不需要再办理


  据了解,赠与合同必须公证的规定开始于1991年,当时规定房产继承和赠与都必须先办理公证,再办理房产登记。


  北京市住建委相关负责人表示,鉴于办理公证时需根据房产价值支付一定比例的公证费,近年来有律师和群众对这一规定提出了质疑,认为该文件没有上位法依据,不应执行,“我们考虑,房屋赠与属于赠与方和受赠方共同申请办理的事项,在双方提交赠与合同且双方本人到场的情况下,登记部门已经有能力审查赠与行为的真实性,因此无需要求办理公证。”


  不过,该负责人强调,如果赠与方不能到场,委托他人办理的,则委托书必须公证,以保证委托行为的真实性,避免假冒产权人将房屋赠与他人;如果受赠方不能到场,因受赠属获益行为,则其委托书无需公证。


  赠与的无须公证,继承是否仍然需要公证呢?


  对此,该负责人表示,对于房屋继承的仍维持现行规定,先办理继承公证,再办理房屋登记。一是避免纠纷和诉讼;二是住建部行业标准《房地产登记技术规程》也要求房屋继承应先公证,因此,修订稿保留了原规定。


  房改房补证件无须单位证明


  修订稿取消了房改房遗失补证需售房单位出证明的规定。原登记规范规定,产权证书遗失的,产权人登报声明作废后可申请补发,但房改房产权证遗失的,需原售房单位出具已领证的说明后才能补发。


  相关负责人表示,这一规定的背景是,由于房改房产权证都是由单位代为办理,一些单位在售房时与职工有特殊约定,为防止职工擅自将房屋上市交易,职工的产权证往往由单位统一保管,以此约束职工。


  北京市2003年12月1日起施行的《北京市城市房地产转让管理办法》第十六条明确规定“已购公有住房转让时,可以不征得原售房单位同意”。


  相关负责人解释说,根据《物权法》规定,房屋登记簿才是物权归属和依据,房产证和登记簿记载不一致的,原则上以登记簿为准。


  因此,原来的规定一是没有法律依据;二是遗失补证并非房屋上市交易,不会发生新的登记行为;三是原来的房改售房单位经过多年变化,有的重组、改制,有的已经不存在甚至已破产,如果再找原单位开证明,确实非常困难,也没有必要,所以修订稿取消了这一规定。


  集体土地房屋登记须贴公告


  修订稿中规定,集体土地范围内房屋初始登记以及申请补发房屋权属证书、登记证明的,房屋登记部门应在房屋所在地农村集体经济组织或村民委员会办公场所或房屋所在地张贴公告,同时,还应在市住建委网站发布公告。


  农村集体经济组织申请房屋所有权初始登记的,还要求提交经村委会确认的村民会议同意或由村民会议授权、经村民代表会议同意其登记的证明;或者乡镇农民集体经济组织同意的证明;没有组建乡镇农民集体经济组织的,由乡镇政府出具同意的证明。


  此外,修订稿规定,申请村民住房所有权转移登记的,还应提交房屋所在地农村集体经济组织(村委会)出具的申请人为本农村集体经济组织成员证明。也就是说,如果不是本村人,没法在本村买宅基地。具有城镇户口的,更不可能到农村买宅基地。


  北京市住建委相关负责人表示,在符合规划和用途管制的前提下,允许农村集体经营性建设用地出让、租赁、入股,实行与国有土地同等入市、同权同价,加快建立农村集体经营性建设用地产权流转和增值收益分配制度。


  设审核委员会解决疑难事项


  修订稿中要求,进一步加强登记队伍建设,提高工作质量和效率。


  首先,增加建立房屋登记审核委员会要求,房屋登记审核委员会应由3人及以上单数组成,其中登记官不应少于总人数的1/2。相关负责人表示,登记工作中经常会遇到一些疑难问题,为有效解决这些问题,提高登记质量,避免行政风险,修订稿规定,市住建委和各区县登记部门应设立房屋登记审核委员会,负责会审房屋登记重大疑难事项。


  修订稿还对登记人员从业条件提出了要求。其中规定,房屋登记人员应当具备与其岗位相适应的专业知识,取得市住房城乡建设委颁发的岗位资格证书。其中,在审核、登簿、质量检查等重要岗位工作的人员,还应当取得住建部颁发的房屋登记官资格证书。同时规定登记部门应当加强登记人员培训考核及日常管理。


  此外,修订稿还进一步规范了登记业务办理标准,统一全市登记用章、各类文书和表单内容及填写要求。

  相关负责人解释称,对房改房、保障性住房、中央国家机关办公用房、军队房产等房屋的登记和管理,国家和北京市还有一些特别规定,鉴于涉及到的部门和政策都比较多,修订稿不再一一列举,凡上述房屋的登记管理,按修订稿和相关规定执行。
