检察官说法
据承办检察官介绍，信息网络传播权是著作权中专用权中的一种，根据《信息网络传播权保护条例》的规定，信息网络传播权是指以有线或者无线的方式向公众提供作品，使公众可以在其个人选定的时间、地点获得作品的权利。
2011年最高人民法院、最高人民检察院出台的《办理侵犯知识产权刑事案件的指导意见》中明确了通过信息网络传播他人作品的行为属于刑法意义上的发行行为。
通过建立“盗版”视频网站，以营利为目的，未经著作权人许可，播放他人享有信息网络传播权作品的行为属于侵犯著作权人著作权的行为，故达到刑事案件的追诉标准就应依法追究刑事责任。
