　　广东省武江监狱正式发函

　　新快报讯 记者黄琼报道 近日，广东省武江监狱正式发函佛山市三水区公安机关，请求协助对张海执行收监。

　　据介绍，张海系健力宝原董事长，因犯职务侵占罪、挪用资金罪， 于2005年4月30日被逮捕，2008年9月12日经广东省高院二审判处有期徒刑10年。2008年11月后，张海在广东监狱服刑改造。2010年6月、12月，张海因检举揭发他犯余罪和发明“汽车前后双视镜”实用新型专利分获立功和重大立功奖励，并因此获取减刑4年1个月28天，于2011年1月26日刑满出狱。

　　经查，张海用来立功的破案线索信息是贿赂得来的。他委托律师代其贿赂佛山看守所有关工作人员，获得破案线索，进行检举揭发。而所谓国家专利，也是张海“冒名骗取”的。该专利是张海指使他原公司一名工程师设计，并通过专利代理公司运作申报的。

　　目前，监狱机关已经撤销了张海的立功和重大立功，韶关中院据此撤销了张海的两次减刑裁定。依据法律规定，张海仍有4年1个月28天余刑。

　　据悉，省纪委等有关部门去年已着手对张海违规减刑案件中监狱系统涉案人员进行查处。涉案人员有的已被判刑，有的还在侦办过程中。待案情查清后，构成犯罪的，将移送司法机关审理，依法追究刑事责任；违纪违规的，将严肃追究相关责任，给予党纪政纪处分。

　　张海案件的发生，教训深刻。监狱机关正在开展“以案治本”活动，进一步严格规范减刑、假释、保外就医工作，充分利用门户网站、狱内法庭等平台和载体，不断拓宽狱务公开的广度和深度，全面公开罪犯减刑、假释、保外就医案件办理情况，加强制度监督，打造“阳光狱务”，接受社会监督。
