　　此前当北京市工商局刚刚叫停餐饮行业中这6条“霸王条款”时，本报便对全市的数十家高档餐饮企业进行了探访，发现其中有三分之二的餐厅仍在按“条款”行事。但当时还并未到工商部门给出的1个月的整改时限。

　　此次，赶在春节长假期间，本报记者再次对这些高档餐厅进行探访与回访，发现“霸王条款”问题仍存在。

　　条款仍然有 自带酒水还要钱

　　正值过年期间，又到了饭店生意的火爆时期，无论是家里面的团圆饭还是朋友间的感情饭，图省事儿大家都直接在外面“下馆子”。昨天是大年初二，傍晚5时许，记者在中关村的东来顺和港丽餐厅内探访发现，两处餐厅的大堂内早已坐满了食客，甚至还有人在外等位。

　　一个是老字号名店，一个是中高端的连锁港式茶餐厅，但在探访中记者发现，这两家餐厅均“禁止自带酒水”，这类似的“霸王条款”还并未“清剿”干净。

　　东来顺中关村海图店的一名服务员告诉记者，来用餐是不能自带酒水的，随后记者指出工商部门对此已有相关规定，可以自带，对方便表示“明面上就这规定，您要是偷着带来了我们也没办法。”

　　而在与其相距不远的港丽餐厅中，还没进门就可以看到其门玻璃上印有的一系列“规矩”，其中便包括“严禁食用外带食品及饮料”。服务员告诉记者，如果自带酒水就要收取开瓶费，每瓶50元。

　　晋阳饭庄银谷店，要想在这儿订包间，人均消费必须在100元以上，对于酒水，工作人员表示“过节这两天可以适当带点儿”，当记者问是否还会收开瓶费时，对方工作人员不耐烦地回复称：“让您带这不就不收了吗。”

　　在位于和平门的老字号全聚德烤鸭店，虽然酒水可以自带，但也是有规矩的，“白酒红酒只能带一种”。除此以外，如果提前预订单间，便全是配餐，最低是360元一位，还要外加15%的服务费。大厅可以自己点菜，但服务费也是照收10%。

　　而在簋街内的花家怡园倒是既没有最低消费也不限制自带酒水，只有一样，包间服务费10%，“每个包间配一个服务员，这样人力成本高啊。”该店的工作人员向记者解释道。

　　食客吐槽

　　吃饭还得来 遇“霸王条款”没辙

　　对于餐厅的这些“霸王条款”，虽然招人讨厌但不少消费者为了减少麻烦都会选择“服从”。市民刘女士告诉记者，若是有餐厅强烈要求不可自带，他们也没辙，“那怎么办啊，饭还得吃啊，来都来了。”

　　可是明明知道一般饭店中的酒水都比外面贵，所以若是出去吃饭的时候要喝酒，那就一定会自带。“饮料倒是无所谓，贵几块钱的事儿，但是酒不一样啊，有些饭店里面的比外面卖的贵好几倍呢。”刘女士称有一次自带酒水去饭店吃饭，被店内的服务员看到后称，自带了酒水就不能享受8折优惠。

　　市民王小姐说自己平时不喝酒，和朋友出去一般也不怎么点酒，但是如果有需求那就在店里直接要，不会自带，因为会觉得“有点儿没面子”。
