律师：该行为涉嫌侵权
对此，北京盈科律师事务所高级合伙人王贝贝律师表示，商家这一行为已涉嫌侵权。“因为冬奥会开幕式中五环变四环的乌龙事件，并非主办方有意设计，而是一起事故；但将奥运五环做成雪绒花的形状却是主办方设计的，即使作品没有完整的展现，也不影响主办方对‘奥运四环’所享有的著作权，将冬奥会主办方拥有著作权的‘雪绒花奥运五环设计’印在衣服上的行为并未得到主办方的授权，因此属于侵权行为。”
