法制晚报讯 (记者 张雷) 利用科研项目资金发放的漏洞，原北京邮电大学软件学院执行院长宋茂强，伙同其妻借用亲戚、老乡身份证，以“校外劳务人员”的身份冒领68万元科研经费，为防审计出问题，还补签虚假的劳务合同。受审翻供，称领出68万元只是完成预算，用于系统维护、保养和团队建设等事项。
记者上午获悉，宋茂强因犯贪污罪，被法院一审判处有期徒刑10年6个月。
贪污
软件专家 获拨科研经费200万元
2010年7月15日，宋茂强任北京邮电大学软件学院执行院长。
根据宋茂强供述，2008年8月7日，工信部牵头启动“核高基”项目。“核高基”是“核心电子器件、高端通用芯片及基础软件产品”的简称，是2006年国务院发布的《国家中长期科学和技术发展规划纲要(2006-2020年)》中与载人航天、探月工程并列的16个重大科技专项之一。
“核高基”项目启动后，成立了专家组，宋茂强是15名软件专家之一，主要负责“面向新型网络应用模式的网络化操作系统”课题指南编写。
据他交代，2009年1月，北京邮电大学拿到了这个项目，作为牵头单位，2008年九十月份，该课题进行了申报，北京邮电大学软件学院教授袁玉宇任课题负责人，宋茂强负责下属的一个团队。
这个课题预算，财政部最终批了1.9亿余元，财政部要求北京邮电大学为课题设立银行特设账户，款项专用。
宋茂强团队的经费是200万元，其中设备费50万元，剩下的150万元全是劳务费。宋茂强承认，由于其团队没有具体任务，通过正常途径花不了这200万元。
借亲戚老乡身份证 冒领68万劳务费
课题经费到了2010年9月才到账。本来课题执行期是从2009年1月到2010年12月，当时只剩下4个月的时间，按照要求，经费应该在2010年12月之前执行完，后来课题延期了半年。
宋茂强称，袁玉宇把课题经费分给不同团队，在特设账户中设了几个子账户，袁玉宇将200万元分两次拨入了他负责的子账户中。
他说，如果课题到了执行期，财务就封账，经费就不能再用了。“50万元设备，是由学校进行政府采购的。而劳务费的发放，首先由其确定发放标准，然后安排工作人员把单子送到财务处，之后将钱打到指定账户，不需要袁玉宇和学校其他任何人签字。”
根据《民口科技重大专项资金管理办法》规定，劳务费只能发给在校学生和校外劳务人员。
他承认，劳务费一共支付给了7名校外人员，5人没在课题中从事过任何劳务，只是“以他们的名义把钱取了出来”。5个人的身份证，是宋茂强找自己的亲戚、老乡以及通过手下的讲师借来的。
宋茂强事后交代，将68万元冒领出来，最初是想完成预算，先把钱取出来再说。他感觉团队的老师很辛苦，想给老师们一些奖励。但钱到手后，产生了错误的想法。“我认为为项目做了一些工作，这些钱可以作为给自己的贴补。现在回想起来这些想法和做法是错误的。”
案发
审计发现问题 院长涉嫌贪污被逮捕
后来，国家审计署工业审计局对北京邮电大学参与的国家“核高基”重大科技专项课题的资金进行审计时发现了问题。审计署领导问宋茂强劳务费的发放情况，宋茂强如实进行了汇报。一周后，校领导要求其把钱退回账户，宋茂强把冒领的钱包括利息都还了。
2012年6月8日，教育部监察局将该线索移送至最高检察院反贪污贿赂总局，同年6月11日，线索交至北京市检察院第一分院反贪污贿赂局查办。
反贪侦查员要求宋茂强于2012年7月4日下午到指定地点接受调查。宋茂强不但爽约，还关了手机。
宋茂强表示，他经过一天考虑，次日下午主动与北京邮电大学联系，并于当天晚上在学校人员陪同下到达谈话地点。
因涉嫌犯贪污罪，宋茂强于2012年7月5日被羁押，同年7月20日被逮捕。
相关人员证实 劳务费发放没标准
案件侦查期间，北京邮电大学软件学院教授袁玉宇证实，北京邮电大学为课题开设了专门账户，财政拨款就打入这个账户，各个团队需要支出项目经费，不需要其审核签字，而是由各团队负责人签字，到学校财务处报销。袁玉宇称不知道宋茂强冒用他人身份领取劳务费的问题。
北京邮电大学科技处处长刘杰证实，项目预算2亿元，包括中央拨款、地方拨款和自筹资金三部分，其中中央财政拨款4800多万元。
劳务费的分配没有具体标准，就是按照预算来执行，由项目负责人掌握分配权。
2012年审计署审计发现问题后，其学校加强了对劳务费的使用管理规定，从制度上进行了修补，要求参加劳务的人员到科技处进行备案。
北京邮电大学校长助理兼财务处处长宿继军也证实，校外劳务人员劳务费的发放没有具体标准，具体由项目负责人决定。

法院审理认定，2010年9月至2011年6月间，宋茂强在担任北京邮电大学“面向新型网络应用模式的网络化操作系统”子课题的团队负责人期间，利用审批和分配科研资金的职务便利，伙同他人，以虚列劳务人员名单的方式，将国家科技重大专项中央财政资金人民币68万元(税后实际金额57万余元)据为己有。
法庭上，宋茂强对公诉机关的指控事实及罪名提出异议。宋茂强辩称，他自己没有非法占有的主观故意，冒领68万元是用于系统维护、保养和团队建设等事项，为项目维护经费，故其行为不构成贪污罪。
宋茂强还辩称，他被审计机关调查前，其妻将部分款项转存或用于购买理财产品，他并不知情。
法院认定构成贪污 因退赃对其轻判
对此，法院认为，除宋茂强的供述之外，虽无其他证据证明其直接授意妻子处分涉案款项，但劳务合同书、劳务费申请单、审计署工业审计局关于宋茂强有关存折取证过程的说明等均证明，其在套取劳务费的过程中，已明知该5人的劳务费脱离了公共特设账户。
涉案存折已处于其与妻子的实际控制之下，宋茂强亦供认存折由其妻负责保管。
因此，其妻的处分行为系贪污行为既遂状态下的赃款处分行为，不影响对宋茂强套取劳务费行为的定性。
而且，宋茂强在套取劳务费后补签劳务合同并伪造签名的行为，印证了其套取劳务费行为的非法性。
法院查明，从2010年9月资金到账至2012年1月11日涉案存折被审计人员查获，宋茂强既无系统维护、保养的经费分配方案和实施行为，也未将上述款项用于团队支出或激励机制，反而在虚报申领劳务费并实际控制后，由妻子取出存于个人账户，并部分用于购买理财产品。
同时，证人证言均证明宋茂强不仅未将款项在子课题团队内公示或用于科研奖励资金，反而在其行为被审计机关发觉后，采用单独约谈的方式向证人宣称该笔款项拟用于团队建设，具有干扰证人作证的心理态度。
法院认为，宋茂强身为国家工作人员，利用职务上的便利骗取钱财，其行为已构成贪污罪。
鉴于宋茂强在案发前退还了全部赃款，且系主动到案，法院对其依法从轻处罚，但结合其认罪态度，法院在量刑时酌予体现。
最终，法院一审以宋茂强犯贪污罪，判处其有期徒刑10年6个月。
