  自从商品房销售推行网签制度后,开发商一房多卖、虚假宣传等欺诈行为基本绝迹。然而,近日,在海南澄迈、三亚、海口等地却又出现“一房多卖”现象,有的房子被三卖四卖甚至五卖,开发商得手后纷纷跑路。


  开发商人间“消失”后,尚未交付的房子究竟归谁?层层监管之下,开发商为何能瞒天过海,一房多卖?有关部门又该如何预防“一房多卖”现象的发生?《法制日报》记者进行了调查走访

  开发商将已出售的房子抵押给别人,或者是抵押的房子再次出售给他人,最甚者出现了一房以抵押、出售等形式同时转手5次!这样令人不可思议的购房诈骗情况就真实地发生在我们身边。


  《法制日报》记者近日从海南省澄迈县公安局获悉,澄迈县公安局侦破一起涉及19个省市(包括台湾地区)和美国,涉案金额高达约3.4亿元的特大合同诈骗案件,涉案人员12人。同时,纪检监察机关根据该线索,已对涉此案的澄迈县委原副书记卢勇、县国土局原局长卢志刚、县住房保障与房产管理局原局长林中校等3名公职人员涉嫌利用职务之便谋取不当利益立案查处。


  买房装修后房主竟“另有其人”


  “花了一百多万元买的房子,刚刚装修好入住,却发现房主竟然不是自己!”提起这次购房经历,浙江籍刘先生便觉得痛心不已。


  2011年9月,刘先生经熟人介绍,花110万元在海南省澄迈县老城开发区阳光花苑小区买了一套100平方米的房子。2012年2月,退休后的刘先生来到海南,准备在新房中养老度假。


  “不曾想到,装修后的新房刚住上不久,就有人找上门来,说这套房子已经抵押给他了,让‘限期’退房。我当时就傻眼了,赶紧到澄迈县房管局去查备案登记,结果发现房子以买卖合同备案在某贷款公司名下了。”刘先生说。


  刘先生的房子被一房多卖的消息在小区中不胫而走,许多业主也纷纷到房管局查询。根据统计,约有百名以上的业主房子被开发商抵押,总房产价值上亿元。


  事发后,业主们赶紧向澄迈县公安局老城分局报案。老城分局立即依法受理立案,对开发商澄迈阳光投资有限公司进行取证调查。


  2013年7月,澄迈县警方又接到新疆某单位举报,海南博亚房地产开发有限公司涉嫌购房合同诈骗案件,而该案的主要涉案人员,同样是澄迈阳光投资有限公司负责人聂某某。于是,澄迈县纪委、公安局等多部门立即组成联合调查组,将这两起案件并案侦查。


  经查,该案涉及一房多卖的房产共计166套(栋),涉案金额约1.4亿元,受害人达104名,涉及19个省市(包括台湾地区)及美国;涉嫌合同诈骗新疆某单位2亿余元;除了利用阳光花苑小区项目用地使用权及地上在建建筑物用于抵押向某银行贷款1.1亿元,涉案公司还非法向外借高利借贷资金近6亿元,虽已还本息1.96亿元,但仍有近4亿元高利借贷本息未还。


  目前,澄迈县公安机关已冻结涉案公司及个人名下资金和资产,查扣涉案车辆数辆和游艇,查封涉案房产150套,追回涉案公司资金8000余万元,追缴部分赃款,两项合计追回资金超过1亿元。


  监管不严权责不明是重要原因


  《法制日报》记者了解到,2010年2月,聂某某在明知公司启动资金不足的情况下,指使皮某某、许某某等其他涉案人员,通过虚假注册资本方式,夸大履行合同能力,并大肆借贷;采用隐瞒手段,将阳光公司开发的阳光花苑小区商品房出售后再次以预售备案的方式抵押给借款人;或者是将已经以预售备案的方式抵押给借款人的房子,又再次出售给他人。最令人吃惊的是,有的房子以抵押、出售等形式转手5次。


  2012年7月,博亚公司在建设熙岸高尔夫公寓二期项目过程中,明知其未取得相关合法施工手续及已将部分项目用地抵押给其他单位的情况下,仍与新疆某单位及相关单位签订团购协议,收取预定金并挪作他用。


  为什么会发生这样的事情呢?记者在采访中了解到,2010年海南国际旅游岛上升为国家战略后,海南房地产业几度升温,使不少不法开发商看到该行业潜在的巨大经济利益,在强烈的趋利心理支配下,他们置法律不顾,铤而走险,以身试法。有的房地产开发商虚报注册资金大肆吹嘘其“实力”,致使购房者被其实力雄厚的假象欺骗;有的采取一房多卖、预售商品房不开据正规发票等手段,骗取购房者的钱财;还有的在无预算资金的情况下,仓促开发房地产项目,工程上马后,因资金严重不足或根本无开发资金而骑虎难下,欲罢不能,便采取一房多卖、一房多抵“空手道”的欺诈方式骗钱,从而陷入违法犯罪的深渊。


  “房地产职能部门监管混乱是‘一房多卖’、先抵押再出售或先售房后抵押等现象发生的重要原因。由于管理部门的职能、运作机制等方面的原因,房地产监管方面存在管理不严、权责不明的问题。”海南大学政治与公共管理学院教授章汝先称。


  章汝先表示,其一,资质认证不严。有些房地产开发商根本不具备开发房地产应具有的资质条件,却轻而易举地领取了资质证,公然运作大型房地产开发工程,可见管理部门在房地产开发行业的资质审查中,存在严重的渎职行为。其二,审批房地产业的预售许可证把关不严,已是一个不争的事实,在项目法定的配套费用未付或者还是“楼花”、“未封顶的在建楼”时,房管部门便发给开发商预售许可证,任其“挖地”叫卖,每售一套房也未按规定到房管部门审核备案。有的开发商对未取得预售许可证的商品房在市场上公开销售,房地产管理部门不督促办证。


  上述分析已被事实证明。1月12日,海南省纪委向媒体通报称,澄迈县委原副书记卢勇、县国土局原局长卢志刚、县住房保障与房产管理局原局长林中校等3名公职人员,利用职务上的便利,涉及此案为他人谋取利益,在工业项目用地、土地使用性质变更、房地产项目容积率调整、审批办理商品房预售许可证等事项过程中,多次收受他人贿赂。省纪委、监察厅决定给予3人开除党籍、行政开除处分,并将3人涉嫌犯罪问题移送司法机关依法处理。


  应推进构筑房地产反欺诈机制


  事实上,类似这样“一房二卖、一房多押”的房产纠纷案例,近年来在海南时有发生。尽管海南已有较为完备的商品房合同备案制度,但市场上在售商品房多为期房,从合同备案完毕到最终交房,一般需要1至2年时间。在当前楼市调控严厉背景下,开发商资金链普遍紧张,在生死存亡之际,一些人铤而走险进行“一房多卖”,以谋求更多资金发展。


  “加强房地产预售商品房的管理监督力度是根治‘一房多卖’的首要措施。”海南大学法学院教授童伟华称,房地产业急剧升温,发展迅速,相关部门加强有效监管显得尤为必要和迫切。政府管理部门要严格审查房地产企业的资质,确保该类企业完全具备房地产开发资质的实质要件;要加强对房屋销售的监督管理工作,切实履行监督管理职责,从源头上避免一房两证、一房两卖现象的发生。


  不仅如此,童伟华表示,房管部门应当严格审批房屋预售许可证和严格监督房屋预售、抵押登记,确认开发商完成国家预售规定的配套建设和交纳应缴的费用,并完成预售前的所有法定行为,达到“五证齐全”的前提下,方可指令预售许可,发给开发商预售许可证。在预售过程中,相关政府部门还得做好跟踪监督工作,严格审查每套房屋、每栋楼房的销售是否合乎相应法规的要求,从根本上堵住重复售房的漏洞。


  “房地产管理部门必须花大力气理顺各级职能,做到上下衔接,同级权责范围明确,避免多头管理、重复管理。要从方便群众、遏制欺诈的原则出发,建立快捷有效的房地产权证、查封抵押登记电脑查询系统,避免一房多卖、一房多抵的现象发生,构筑房地产反欺诈机制。”海南律师陈剑称。
