近期，连续几起公职人员伤人事件的善后处置引起了人们的关注。《法制晚报》记者整理了近年来10起公职人员违法事件，发现事件发生后，有8成左右当地政府或相关部门先行赔偿。
凭什么公职人员违法要政府买单？哪些情况下政府可以代赔，代赔数额如何确定？如何信息公开，如何追偿？一系列问题引起了广大网友的追问。
专家指出，“政府代赔”虽然客观效果并不坏，既安抚了受害者家属，也尽快平息事态以免产生更大的社会问题。但目前政府代赔机制存在很多问题，亟须尽快建立明确规则，在约束之下，屡见不鲜的“政府代赔”，才不至于成为乱花钱的代名词，受到纳税人的广泛质疑。
政府赔偿的两种说辞
在法晚记者盘点的10起公职人员伤人事件中，大多数是当地政府先进行了赔偿。
对于政府所给的赔偿款，一般当地政府有两种说法进行解释。一个是政府在其中有管理失职等责任，对受害者需要进行赔付；另一个是政府出面先行支付，事后再由犯罪嫌疑人偿还政府。
广西平南县发生醉酒警察枪杀孕妇后，当地政府先代赔73万元。贵港市副市长、平南县委书记黄星荣接受采访时称，考虑到诉讼时间较长，为了尽快让受害者得到补偿，计划由政府出面先行支付，事后再由犯罪嫌疑人偿还政府。
按照《中华人民共和国国家赔偿法》规定，国家机关及其工作人员因行使职权给公民、法人及其他组织的人身权或财产权造成损害，政府应依法给予赔偿。但是多起公职人员伤人事件中，对于伤人时是否属于执行公务均有很大争议。
中国社科院法学教授陈春龙接受《法制晚报》记者采访时说，地方政府代赔，是基于现实的考虑。诚如官方所解释的，考虑到诉讼时间较长，为了尽快让受害者得到补偿，计划由政府出面先行支付，事后再由犯罪嫌疑人偿还政府。
“如果按部就班走司法程序，赔偿问题肯定要延后，这对受害者家属与家庭来讲，无疑是‘雪上加霜’。”陈春龙说，但是，代赔不能“代责”、不能“减责”，这一点十分重要且关键。
赔偿数额
多为数十万元 均未对外作解释
各地政府对于赔偿数额是如何计算的？记者从整理的案例发现，无一政府在通报或者接受采访时做过相关解释。
在这些案例中，赔偿金额多为数十万，最多的是广西阳朔在押嫌犯身亡，当地政府机关赔偿90万元，最少的是青海湟中城管打人案，相关部门赔偿了20.9万元。
去年7月17日，临武瓜农与城管发生冲突不幸身亡的事件发生后，当地政府和受害人家属于7月19日迅速“达成协议”，给予在与城管冲突中不幸身亡的瓜农邓正加的家属死亡赔偿金、丧葬费、精神抚慰金等共计89.7万元。
根据《中华人民共和国国家赔偿法》第四章第三十四条第三款的规定：（公务人员职务行为）造成死亡的，应当支付死亡赔偿金、丧葬费，总额为国家上年度职工年平均工资的二十倍。对死者生前扶养的无劳动能力的人，还应当支付生活费。
当时就有媒体质疑赔给瓜农家属的89.7万是如何计算出来的呢？如果按照当年全国城镇非私营单位就业人员年平均工资46769元计算的话，死亡瓜农家属获赔的总额至少应为935380元。
无论适用的《中华人民共和国国家赔偿法》，还是《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》，临武县官方给出的89.7万元赔偿款，都找不到合法的理赔依据。
“正是因为法律对于补偿多少并无统一标准，具有很大的随意性。这就产生‘同案不同补’的现象，很容易造成新的不公平，影响政府的信誉。”国家行政学院教授杨小军在接受媒体采访时建议，应加快刑事被害人补偿国家立法，让政府远离“拿着纳税人的钱做好人”的质疑。
十起涉及赔偿的案件
广西警察枪杀孕妇
事件：2013年10月28日晚，平南县刑警胡平在该县大鹏镇一家米粉店内连开数枪，将怀胎5个月的老板娘吴英打死，将吴英的丈夫蔡世勇击伤。
赔偿：政府先期代赔73万元
湖北城管队长饮酒死亡
事件：2014年1月，罗田县政协委员肖飞进为庆贺自己生日，在县城大摆酒宴，胡吃海喝。其中参与的有副县级干部肖学明，河铺镇党委副书记、副镇长，县城管执法局中队长丰某等公职人员，结果丰某因饮酒过度身亡
赔偿：城管执法局与死者家属签订赔偿协议，共赔偿64.8万元
青海湟中城管打人案
事件：2013年9月起，湟中县多巴镇城管执法中队发现多巴镇新墩村李梅夫妇涉嫌违法搭建彩钢板房5间，10月9日对其中3间进行依法拆除，遭怀有身孕的李梅及其丈夫阻止。10月12日，多巴城管中队队员在一家水泥店执法的过程中，与替人看店的44岁妇女李发莲发生肢体冲突。
赔偿：相关部门支付受害者20.9万元
湖南临武瓜农死亡案
事件：2013年7月17日上午，湖南临武县城管局工作人员在执法过程中，与南强莲塘村瓜农邓正加发生争执，后邓正加死亡。
赔偿：给予瓜农邓正加的家属死亡赔偿金、丧葬费、精神抚慰金等共计89.7万元
河南洛宁局长撞人案
事件：2010年12月5日晚，河南省洛阳市洛宁县邮政局长谷青阳酒后驾车，在洛宁县涧口乡政府所在地以北新安虎线路段逆向行驶，撞死5名青少年。
赔偿：邮政系统先期垫付赔偿金115万元
云南官员洗脚致1死
事件：2012年5月13日下午，昆明市宜良县九乡乡政府人大主席、乡党委副书记等6人在一家饭店吃了晚饭后，驾驶两辆公车到县城一家洗脚城洗脚。谁知其中一辆车翻车，造成驾驶员死亡，3人受伤。
赔偿：当地政府赔偿了46万元
广西阳朔在押疑犯身亡
事件：广西阳朔县兴坪镇村民莫某此前因涉嫌盗窃被阳朔县公安局刑拘并逮捕，关押在阳朔县看守所内。2013年12月16 日，莫某突然被送往阳朔县人民医院抢救。次日晚，莫某因抢救无效死亡。
赔偿：公安机关协议赔偿90万元
青岛学生喝酒坠楼案
事件：2012年10月27日晚上，青岛求实职业技术学院学生刘晓傲连同另外5名同学被学校的6名老师叫出去吃饭，晚10点34分，晓傲在酒店四楼洗手间的窗口不幸坠楼当场身亡。
赔偿：青岛求实职业技术学院所在的城阳区流亭街道办事处先期垫付60万元赔偿金
☆湖北福田堵门事件
事件：2013年3月13日，湖北福田县公务员远赴深圳“逼”打工者返乡签拆迁协议未果，竟将对方的报刊亭门锁用胶水和化学制品堵死。
赔偿：福田警方通报称，湖北两名涉事干部已投案自首，向受害者道歉并赔偿了5000元损失，双方达成调解协议
四川一县人大官员殴打妇女
事件：2013年7月，四川省巴中市通江县人大常委会党组成员张智在上班时间公然在大街上殴打妇女。
赔偿：派出所组织双方当事人进行了调解，并就财物损失赔偿和医疗费用补偿达成协议注：☆为当事人自己赔偿的案件
政府追偿
公开信息中鲜有追偿成功案例
《国家赔偿法》规定，国家机关可以先行进行赔偿，然后再向犯罪嫌疑人实施追偿。而在法晚记者整理的10个案例中，并没有发现有政府追偿成功的通报或新闻报道。
虽然鲜有政府追偿成功的报道，但政府部门对公职人员提出起诉追偿的却不少。
1月26日，湖北罗田县城管干部饮酒死亡后，相关部门垫付了64.8万的赔偿金。城管执法局已委托律师向罗田县法院提起了诉讼，起诉当天出席生日宴和举办生日宴的人员以及送丰某回家的三方面人员共9人，要求他们偿还垫付的款项。
从目前的调查情况来看，追偿效果似乎并不好。
据国家财政部网站消息，该部对26个省(市、区)各级财政部门的调查显示，2002年至2004年，向责任人追偿赔偿费用合计约217万元，仅占财政核拨赔偿费用总额的3%，部分地区追偿赔偿费用数额为零。
调查显示，湖南省2002年至2004年核拨赔偿费用1109万元，追偿仅29万元，追偿率2.64％。黑龙江省发生61起国家赔偿案件中，只有1起得到追偿，核拨的447.9万元赔偿费中只追偿了9.4万元，占核拨赔偿费用总额的2.1％。北京市2002年至2004年发生国家赔偿费用660万元，追偿26.6万元，占核拨赔偿费用总额的4％。
专家观点
“政府代赔”亟须建立明确的规则
今天上午，北京大学社会发展研究所副教授王文章接受《法制晚报》记者采访时指出，目前国家赔偿花费的是公款，而公款源于民众所缴税费，这样，国家赔偿就变成了民众为责任人员的过错买单。政府代赔只是权宜之计，是善后处理的一个环节，与此同时，司法程序必须跟进，对犯罪嫌疑人的追偿工作绝不放松，避免滥用纳税人的钱。
“赔偿义务机关对其工作人员的‘追偿’往往没有动力，一个原因是先期赔付的钱来自财政，不是自己出的；另一个原因是过错方是‘自己人’，尤其机关里的人际关系，往往彼此间都是熟人，谁也不愿意得罪人，常常护短，使得真正的追偿制度没有贯彻实施。”王文章分析说。
王文章说，目前国家追偿有名无实，使得失职者和渎职者绝缘于经济责任。没有国家追偿为后盾的国家赔偿，实则是将官员的个人责任转化成了所有公民的责任，将官员的个人赔偿转化成了由所有的公民来为官员个人的错误买单。
王文章认为，赔偿款是否全部交给受害者家属，对嫌犯的追偿期限、追偿数额以及财政出现亏空如何弥补，如何进行更有效的追偿……这一系列细则都亟须进行明确规范，“让这笔钱花得明明白白，不要成为一笔糊涂账，则是法治社会的应有之义。 ”
