　　利用职权制造不公平的村社干部们，在收受贿金时却十分讲究“公平”，人手一份。甚至是投反对票的社干部和没在现场的社干部，也会被分一份。靠这种“公平”形成利益共同体，“法不责众”的心态让他们感到安全。这种互相维护、企图密不透风的受贿方式被称为碉堡式受贿。(刘晓星)

　　本报讯 (记者刘晓星 通讯员马伟锋) 昨天上午，广州中院对白云区明星村党支部书记梁锡全等5人、东华村村委会主任周本财等23人涉嫌受贿的两宗案件进行了一审宣判。法院以非国家工作人员受贿罪，分别判处梁锡全、周本财有期徒刑八年及七年，其他26名村官也因构成非国家工作人员受贿罪，分别被判处三年至6个月不等有期徒刑并适用缓刑。在此之前，高增村村委会主任戴敏智已被一审判处有期徒刑九年。29名村干部被认定的受贿款项共计1200万元。

　　物流公司看上安置用地

　　2005年，广州市国土资源和房屋管理局将白云区人和镇以西、广花公路以南、方华路北侧窝西地段供白云区人和镇政府作复建安置用地，属国有建设工业用地。2010年10月，白云区人民政府确定，将其中70亩土地按统一规划、统一建设的原则，由白云机场第三跑道主体工程用地的人和镇东华村、汉塘村、明星村、高增村，按一定比例分配建筑面积或收益。

　　2012年初，广东申通公司董事长高汤根(另案处理)打算开发前述70亩土地，遂与四个村的负责人戴敏智、周本财、李瑞陶、梁锡全洽谈约定：涉案70亩地统一出租给广东申通公司，四人分别负责确保本村同意出租，在合同签订后，高汤根将另外付给其四人好处费各400万元。

　　贿金1200万签下租赁合同

　　在4人的“大力推动”下，高增村、东华村、汉塘村、明星村分别与广东申通公司签订了涉案土地的租赁合同。2012年11月7日、12月28日，高汤根按照约定，向4人分别支付了400万元“好处费”。梁锡全和周本财收款后，自己拿了大头，剩下的按不同比例分给了多名村官。戴敏智则独吞了400万元。

　　此前戴敏智在庭审中称，一开始李瑞陶与高汤根商定8元/月/平方米的租金，其他三个村并未参与议价。后来，李瑞陶与高汤根再次商议租金，将租金降为每月每平方米5元，但要给每个村400万元。高汤根通过李瑞陶将四个村的村主任聚集起来商量租地事宜，谈妥后，各自回村开“两委会”。这种“贿金人手一份数额一样”的“公平”所形成的碉堡式防护网，让涉案的村官们感到安全。

　　一名办案的检察官说：“对于什么行为是受贿，他们几乎没有概念，更不要说拒绝，更没有想过受贿会坐牢。”目前，汉塘村村干部李瑞陶尚未有消息，知情人士透露其已外逃。

　　村官成职务犯罪高发群体

　　据广州市检察院此前通报，农村基层组织工作人员成为涉农职务犯罪高发群体。2012年查办村支部书记、村委会主任以及经济合作社社长和村财务人员占查办总人数的48.4%。

　　这些村官掌握着农村集体组织的人、财、物，尤其是部分通过贿选上来的村官，手中的权力也变成其收回“投资”、捞取更大利益的重要工具。涉农贪污贿赂犯罪形式趋向复杂，由过去一人犯罪逐渐向多人的窝案、串案犯罪转变。涉农犯罪多与村干部权力过于集中、一把手说了算有关。在很多村无论是大事还是小事都是村长和书记说了算，村民会议的平台形同虚设，且村务公开、村账镇记、成立村民理财小组等制度，没有得到有效的执行，尤其是对征地补偿款重大款项的管理，款项的使用、分配没有得到跟踪监督、审计。
