吉林一家家禽养殖企业自称因为“H7N9禽流感”这个叫法在2013年亏损了近1600万元，近日，这家企业的董事长把国家卫生计生委告上了法庭，他要求卫计委按照相关国际组织的建议，用“H7N9”、“H7N9病毒”等名称代替“H7N9禽流感”。那么，H7N9究竟和禽流感有没有关系？“H7N9禽流感”的叫法又有什么依据？
对于吉林省德惠市程鹏家禽有限公司董事长程恩宝，这几年不好过。他熬过了“抗生素鸡”、“速生鸡”风波，本以为苦日子到头，最终，在去年3月31号我国报告出现人感染H7N9病毒疫情后，他的企业还是倒下了。
程恩宝：我2012年进的11万套种鸡，11月21号进的，11万套我是投了1100万。养到刚要见蛋也要出鸡苗了，这边报道禽流感，社会上是养鸡的不敢养鸡，吃鸡肉的不敢吃鸡肉，我们前两年的数据是将近3块钱一只的鸡苗，等到禽流感一报，整个2013年的鸡苗平均下来还不到6毛钱一只。11万套只鸡我损失了1600多万。养得越多，亏得越多。
程恩宝将此归咎于国家卫计委对病毒的称谓：H7N9禽流感。他说，世界卫生组织、世界动物卫生组织、联合国粮农组织等国际相关组织已会商建议使用“H7N9”、“H7N9病毒”等名称。卫计委没有法律依据加上了“禽”字，用“H7N9禽流感”对外公布，与国际组织的通用行为不符。
程恩宝：别人命名都可以，怎么说都可以。卫计委这个称谓是不负责任的，而且没有确切的消息是禽传人，我认为对我们是不公平的，直接等于一刀把我们扎死一样。
在程恩宝刚刚向北京市一中院递交的诉状上，他提出两条主要的诉讼请求：
程恩宝：“人感染H7N9禽流感”的称谓错误，予以撤销；“人感染H7N9禽流感”的称谓重新做出具体行政行为。
记者：具体来说怎么执行？
程恩宝：卫计委可以叫“人感染H7N9流感”或“人感染H7N9病毒”，这都可以的事儿。
今年初，有来自中国畜牧协会家禽分会的消息称，有1009家家禽企业签约情况说明函并向国家卫计委递交，要求相关部门给“禽流感”改名称。这份说明函中也透露2013年禽类养殖行业经济损失超过1000多亿元，仅2013年上半年养殖业厂户直接经济损失就超过600亿元，而今年1月损失已经接近200亿元，不少企业面临停产倒闭。
据国家卫计委通报的今年2月全国法定传染病疫情概况，人感染H7N9禽流感病例2月共发病99例，死亡41例。综合卫计委1月疫情通报，2014年1至2月全国人感染H7N9禽流感病例共226例，死亡72例。在卫计委的公开文字资料中，“H7N9”的确与“禽流感”三字完全同步出现。这一病毒与禽类的关系是否已经明确呢？
来自今年2月卫计委新闻发布会的消息称，专家研判认为，目前人感染H7N9禽流感疫情的特点未发生明显变化，病例仍以散发为主，监测未发现病毒发生有公共卫生的变异、病毒的传播途径仍然是由禽到人。这个说法，程恩宝直呼其“不负责任”。
程恩宝：如果真是禽发病了，我们都不会告卫计委的。H7N9在家禽场没有检测出来，如果有，我们心甘情愿。我获得的信息是，其中人的H7N9和鸡的H7N9有两个基因片段不同，我现在也反过来问，为什么到菜市场就有H7N9病毒？为什么我们养鸡的不得，到菜市场就得？
