北京百度网讯科技有限公司(以下简称百度网讯公司)诉北京奇虎科技有限公司(以下简称“奇虎公司”)、周鸿祎侵犯名誉权一案，经北京市海淀法院依法审理后，于2013年12月19日作出(2013)海民初字第14071号判决，认定周鸿祎和奇虎公司构成对百度公司名誉权的侵犯，应当停止侵权并赔礼道歉、赔偿损失。该民事判决现已发生法律效力。
因两被告拒不履行向百度公司公开赔礼道歉、消除影响的义务，为示惩戒，本院公布本判决的主要内容如下：
本院认为：在奇虎公司发布的微博中，2012年10月11日下午13时54分发布的含有内容“声明：百度抹黑360安全浏览器遏制360搜索，必是徒劳无益”等内容的微博发言及配图，该微博发言内容含主张百度抹黑奇虎公司相关产品360安全浏览器及评论百度依靠垄断谋取暴利等不当内容。2012年10月13日17时10分发布内容含有“建议那个声称没有为此收百度黑钱的方博士读一读安徒生童话《皇帝的新装》。”内容含有主张案外人收取百度黑钱等不当内容。2012年10月12日下午15时19分发布的内容含有“将打击搜索引擎假医药的基金臆想成收买，方舟子到底是打假，还是假打？”的微博发言，该发言同时引用公司负责人之一谭晓生在其新浪微博360谭晓生V对百度的相关不当评论“方舟子是一杆付费枪，幕后操纵者就是百度”。
在周鸿祎发布的微博中，2012年10月11日下午15时5分发布的包含“后面肯定还有一系列抹黑360安全浏览器的组合拳，目的都是趁立足未稳要灭了360搜索。一个牛奶里掺三聚氰胺的搜索公司有钱有势力，在幕后制造舆论造谣360，真正秉承其创始人神龟一样的风格”的微博发言，该微博发言同时引用奇虎公司于当日下午13时54分发布的微博“声明：百度抹黑360安全浏览器遏制360搜索，必是徒劳无益”，发言内容含有“抹黑”、“造谣”、“神龟一样的风格”等不当言论。2012年10月13日晚21时48分发布的含有“关键是方肘子从来没用过360浏览器就拿着百度提供的抹黑谣言开始狂喷”的微博发言，内容含有“拿着百度提供的抹黑谣言”不当言论。
上述微博发言内容语言明显带有针对“百度”的贬义陈述或评论，并已对外传播，其中部分微博发言主文不含有“百度”字样，但微博发言同时引用他人对百度的不当评论，内容情节相似，使得阅读微博的第三方依据正常理性思维可知悉微博发言与百度的关联，致使百度网讯公司遭受贬损性评论。身份上，周鸿祎为奇虎公司的关联公司负责人，业务利益存在密切关联；时间上双方发表微博的时间间隔较短；内容上双方微博发言内容相似，周鸿祎在发表微博时亦引用奇虎公司相关微博发言，故奇虎公司与周鸿祎的相关微博发言构成对百度网讯公司名誉权的共同侵犯，奇虎公司与周鸿祎理应删除侵权微博发言，并向百度网讯公司赔礼道歉、赔偿损失。
综上，本院判决周鸿祎、奇虎公司停止侵权，删除侵权微博发言；周鸿祎、奇虎公司在其新浪微博首页显著位置发表向百度网讯公司的道歉信，连续公开赔礼道歉10天、消除影响；周鸿祎、奇虎公司连带赔偿百度公司经济损失共计五万元。
