　　事发的平度市凤台街道杜家疃村农田，也就是被征的土地，村民们却在此搭起帐篷，轮流守夜，只为土地不被拿走。这块土地究竟会用来做什么呢？

　　早在2006年7月，一份《征收土地预公告》中显示，根据土地利用年度计划和土地利用总体规划，平度市人民政府拟征收香店办事处杜家疃村农用地125055平方米等四块地，土地征收后拟作为工业和教育用地。

　　当年12月31日，山东省人民政府批复了香店街道办事处等农用地转为建设用地。上述农用地转用后同意征收，用于该市城市建设。

　　然而，就在今年3月初，有开发商在耕地里圈地建办公室，一些村民认为地可能被卖了，于是在农田里支帐篷值守土地。记者调查了解到，这块地于2013年10月被青岛成元天业房地产开发有限公司竞得。

　　土地“先转后征”

　　平度火灾一个无法回避的事实是，村民们守的地，是地方政府合规征得，还是部分村民无理取闹、死守不放？

　　我国相关法律法规规定，在征地依法报批前，要将拟征地的用途、位置、补偿标准、安置途径告知被征地农民。征地补偿不落实的，不得强行使用被征土地。

　　平度市有关部门介绍，按照规定，政府征收土地程序合法。记者辗转得到的相关文件显示，2006年，平度市人民政府就要求土地征收后村委要做好村民工作，将对上述土地进行勘测定界，进行现场调查。

　　未曾想，征地矛盾从此开始出现。一些百姓不愿失地，在政府部门组织土地征收过程中，一直“不配合”。2007年开始，凤台街道和村委会数次去清点地块，一些农户不到场。按法律要求在村委会张贴的《征收土地预公告》、《征收土地公告》和《征收土地补偿公告》，一些村民也反映没有看到。

　　杜家疃村有197户646口人。涉事土地面积约134.37亩，其中100亩左右是村民口粮田。直到2013年1月，历经磕绊，杜家疃获批征收土地的清点工作才算“完成”。

　　一份填表日期为2013年1月28日的杜家疃村《附着物调查登记表》显示，村民李荣茂的三块用于种植枣树的林业用地中，他按手印并写上“不同意卖地”。

　　记者向平度市凤台街道和杜家疃村相关负责人询问，土地征收有没有履行发通知、公告，他们表示公告过，但无法提供相关证明，而部分村民则坚称对自己的承包地被征收“不知情”。

　　补偿谁说了算？

　　平度市有关方面表示，当地财政2013年4月8日拨付了杜家疃村青苗和地上附属物补偿费340.6274万元，每亩标准2.5万元。5月16日，又拨付土地安置补偿费604.665万元，并按规定，预备将其中80%即483.7万元分配给村民。

　　截至3月23日，有42户村民领取，剩余27户以补偿标准过低为由，尚未支取。用于支付土地延包(1999年)以来新增无地人口139人的口粮补助，标准也是人均6800元(共17年)，共计90多万元。其中112人已经签字支取，还有27人也以补偿过低为由尚未支取。

　　一个已经领取部分补偿款的村民告诉记者：“尽管自己没有同意卖地，但还是签字领取了部分补偿，因为我担心，如果不领，我可能就会一无所有。”(新华社)
