控烟条例或明年上半年出台

“北京市无烟机关建设经验交流会”上午举行，市爱卫会办公室主任刘泽军介绍说，本市已经全面启动无烟机关、无烟单位建设。去年，市控烟协会等5家单位联合开展的北京市无烟机关单位创建活动中，采用统一的标准和记分方法对168家机关单位进行了测评，有80%机关单位基本达到“无烟机关单位”标准，近一半的机关单位制定了奖惩制度。
刘泽军透露，本市新控烟法规已于昨日提交市政府法制办，如果进展顺利，有望于明年上半年出台实施。据介绍，新控烟法规将在进一步扩大禁烟范围、加大宣传教育和监督管理力度、提高控烟工作成效、加大处罚力度等方面作出明确的规定，是一部禁烟范围更全面、处罚力度更严厉的地方法规。
市人大常委会法制办主任李小娟曾表示，控烟条例或提出“带顶儿”的室内公共场所全部禁烟。这意味着，包括电梯、走廊、地下通道、楼梯间、咖啡馆等公共区域，可能都要面临禁烟。同时，学校、医院、体育场等场所的禁烟范围可能扩至室外区域。
2011年，市人大常委会对控烟进行立法调研，并公开征求意见，网民中有九成赞同进一步扩大控烟范围。当时的征求意见稿规定，将大幅提高对违法吸烟的处罚力度，相比现行条例处罚10元的规定，建议稿的最高罚款是现行标准的20倍，并提出了“公民禁烟场所吸烟且不听劝阻的，处以50元以上200元以下罚款”。
