新京报讯?幼儿园小班21名儿童，在一年时间里均被幼儿园老师不同程度的殴打、恐吓。昨日，10多名被打孩子的家长拿着孩子的伤情诊断书，聚集在位于朝阳区清苑路的幼儿园讨要说法。朝阳区教委表示，将成立专门的调查组严查此事。朝阳区警方则将涉嫌打孩子的刘姓女老师带走调查。
同班多个孩童均称被打
“上周五晚上，我给孩子洗澡时发现，孩子膝盖和小腿淤青了三四处。”昨天下午，在朝阳区清苑路的这家幼儿园内，当事家长马先生说，他再三追问之下，在幼儿园小A2班的4岁儿子才吞吞吐吐地说，是学校的刘老师踢的。
“从去年10月份开始，孩子腿上每隔一段时间就会有淤青。”马先生告诉记者，据他的孩子称，基本每天都挨打挨踢，并且被打的不止一个孩子。
当天，经马先生提醒，在幼儿园小A2班上课的21名孩子家长，都发现自己家孩子在近一年的时间里，不同程度地遭到该幼儿园小A2班的班主任刘姓女老师的殴打，被打的部位包括头、背、膝盖和小腿，并且打完之后还威胁不让告诉家长。
8孩童鉴定软组织损伤
昨天上午8点，约20名家长来到幼儿园，就自己孩子被打一事讨要说法。经过交涉，园方同意家长查看小A2班在上周五的监控录像。
“不看监控还好，一看简直气疯了。”多位家长称，刘老师把21个孩子叫到厕所的监控摄像头死角里，后有孩子的哭声传出，然后在午饭时间还不让其中部分孩子吃饭。“还有3个孩子挨了踢，视频里不时传来孩子的尖叫声。”
记者随后也查看了相关监控视频，视频内容与家长描述吻合。
昨天下午，有8名被打孩子的家长带孩子到航空总医院进行了伤情诊断，诊断结果显示，这些4岁左右的孩子均有不同程度的双下肢淤青、疼痛的现象，时间从6个月到20天不等，经诊断属于多发软组织损伤。

两男孩试图逃离被追回
4月25日发生的一切，均被小A2班的监控摄像头拍摄下来。
监控显示，当天上午10点01分，小A2班班主任刘某，引导着21名孩子回到教室内，但并没有在教室里做过多停留，而是将孩子们赶进了卫生间的摄像头死角区域。
监控画面中，两名男孩试图逃离，刘某一脸愤怒地追赶出来，将两名男孩抓回了卫生间。
视频中不时传出孩子的尖叫声，以及刘某尖声的喊话：“你们喜欢这样是吧！你们喜欢这样是吧！”视频中孩子们断断续续的尖叫声一直持续到10点05分。
多名孩子事后称，当天他们在卫生间里遭到了刘某的打骂，被踢打的部位包括头部、小腿、背部。
在10点11分左右，孩子们陆续到了食堂内，两名孩子被刘某单独拉到一边不让吃饭，5分钟之后，在刘某的催促下，吃完饭的孩子被统一叫到教室的一边坐下。靠角落的一名男孩动作稍慢，刘某快步走过去，一脚踢在男孩的小腿上，并喊“有记性吗？”该男孩小声回答“有”之后，刘某就朝其他孩子走过去。
随后，又有两名动作稍慢的孩子遭到了刘某的脚踢，刘某同样大声问“有记性吗？”两名挨踢的孩子只能回答“有”。

当事老师看监控情绪失控
昨天上午，被打学生的家长曾找到刘某进行对质。
据幼儿园的记录显示，刘某今年27岁，毕业于唐山师范学院，2年前通过应聘来到该幼儿园。照片中，刘老师比较严肃，齐肩的短发烫得微卷，并染成了黄色。
“她一开始不承认，只是说自己只是轻微地推搡了一下孩子，但后来她自己看了监控录像，喊着说，‘不敢相信这些事是我干的’。”家长张先生说，在他们追问下，对方才承认的确打了孩子，并且最早是从去年4月份就开始对孩子多次打骂。
有幼儿园老师表示，刘某给她的印象一直是个认真负责的老师形象，“孩子发烧生病什么的，总是能第一时间发现。”

孩子半夜哭喊“别伤害我”
而多名家长反映，自己的孩子在近一年的时间里有着显著的变化，多名孩子变得胆小怕事，更严重的则对上学产生了恐惧。
家长王先生说，自己的女儿以前话特别多，嘴也甜，但近一年以来，性格变得谨小慎微，人也变得沉默起来。家长马先生的儿子则更加严重。“我们家孩子半夜哭醒了好多次，喊着说不要伤害他，我们大人看了心如刀绞。”
而家长李先生的儿子，则多次表示自己害怕上学，“他2岁半的时候可活泼了，自从读了幼儿园，我看他进教室门都畏畏缩缩的，见到谁都低着头。”
这些家长均希望，能有相关部门对他们的孩子进行心理干预。同时，希望能够取缔这所幼儿园，或者让他们的孩子去别的幼儿园上学，“我们要求幼儿园向我们家长道歉，向社会道歉，追究相应人员的法律责任，并赔偿损失。”

管理方将辞退老师和园长
昨天下午，朝阳区教委社会办学管理科及涉事幼儿园总园负责人与家长沟通。
“我们幼儿园是严禁老师体罚和变相体罚孩子的，但监控录像里这个老师的所作所为，甚至超出了体罚的程度，这是没有职业道德的行为，我们肯定会严肃处理。”幼儿园总园长史燕涛说，看了监控录像和听了家长反映之后，她作为管理者非常震惊。
“我们会彻底整顿这个幼儿园，并且这些孩子的所有学费全部退还，同时，当事老师和这所幼儿园的分园园长，我们也会将其辞退。”史燕涛说。
昨天晚上，朝阳区教委社会办学管理科的工作人员吴铁隶表示，他自己看完视频之后，心里也非常难过，“我在这个科室干了一年多，第一次听说这么恶劣的事情。”
吴铁隶称，按照家长们的诉求，第一，他接下来将向领导汇报，成立此事的专项调查小组，第二，对于打孩子的监控视频也一律公开，不遮不掩；第三，朝阳警方也已经介入，并将当事老师刘某带走调查，所以在接下来调查取证的阶段，教委也会协调配合。

老师体罚情节严重将追刑责
北京思科律师事务所高级律师王传巍表示，作为老师，依照《幼儿园管理条例》相关规定，严禁体罚和变相体罚幼儿。如有以上行为的，由教育行政部门对直接责任人员给予警告、罚款的行政处罚，或者由教育行政部门建议有关部门对责任人员给予行政处分。此外根据《未成年人保护法》，如果体罚行为情节严重，构成犯罪的(致人轻伤后果的)，由司法机关依法追究刑事责任。
“幼儿园也逃脱不了责任。”王传巍表示，依照《侵权责任法》，无民事行为能力人在幼儿园、学校或者其他教育机构学习、生活期间受到人身损害的，幼儿园应当承担责任。
