新华网兰州4月29日电(记者王博)甘肃省酒泉市原政协主席杨林利用主管城市建设的职务便利及职务影响力，为他人承揽工程、调动升迁提供便利，收受现金、汽车、房产等财物折合人民币1300余万元，被检方以涉嫌受贿罪提起公诉。兰州市中级人民法院29日公开开庭审理了此案。
兰州市人民检察院指控，1997年至2013年间，被告人杨林利用担任嘉峪关市政府副市长、酒泉市委副书记、酒泉市政协主席，主管城市建设的职务便利及职务影响力，先后为33人在承揽工程、竞拍土地、工作调动、职务晋升等方面谋利，非法收受941万余元人民币、13000美元、2000欧元、酒泉市鑫源小额贷款公司经营性投资300万元、兰州市雁滩地区住房一套、沃尔沃C60越野车一辆、人民币10万元的中国人寿保险公司保险一份、金条两根、金吊坠一个、手机一部、手表两块、以明显低于市场价格15.95万元购买房产一套。收受现金财物折合人民币1358万余元。
被告人杨林此前任酒泉市政协主席、党组书记。2013年9月6日因涉嫌受贿罪经甘肃省人民检察院决定由甘肃省公安厅执行逮捕。其将收受的财物据为己有后，主要用于投资、购买房产铺面等，部分藏匿于武威家中，案发后被依法扣押。
检方认为，被告人杨林身为国家工作人员，在担任嘉峪关市政府副市长、酒泉市委副书记、酒泉市政协主席期间，利用职务便利，为他人谋取利益，非法收受贿赂，情节严重，数额特别巨大，构成受贿罪。
控辩双方对事实没有异议，只对个别款项的性质有争议，焦点主要在于被告人杨林是否收受于某300万元“经营性投资”、购买马某别墅优惠的15万余元是否是受贿、收受潘某的手表、金吊坠和住院期间收取的慰问金是人情往来还是受贿等定罪问题、杨林是否有自首情节及悔罪表现、收受吕某的3万元是否属于受贿款等等。
审判长宣布本案将择期宣判。
