　　餐饮单位私卖潲水油最高罚1万

　　广州地沟油监管办法昨起征求意见

　　备受关注的地沟油监管办法——《广州市餐饮垃圾和废弃食用油脂管理办法(征求意见稿)》(简称《办法》)，昨起在广州市法制办官网征求意见。《办法》规定，餐饮单位不得将餐饮垃圾和废弃食用油脂交给无资质的单位和个人收运处置，否则最高可罚1万元。

　　收运处置一条龙?民企也可参与

　　据了解，广州现有各类餐饮店、集体食堂近5万家，每天产生餐饮垃圾约1500—1800吨(其中废弃食用油脂约75—150吨)，但餐饮垃圾总处理能力不足5吨/日。大部分被俗称“潲水佬”收购和处置，用于饲养家禽家畜，更有甚者直接提炼地沟油当做食用油脂售卖，以致地沟油流入食品领域。

　　对此，《办法》将餐饮垃圾和废弃食用油脂按“收运、处置主体一体化”原则纳入垃圾分类体系。《办法》规定，收运处置单位应当在划定的服务区域范围内对餐饮垃圾和废弃食用油脂实行统一收运，集中定点处置，即收运、处置主体一体化。

　　市法制办相关负责人表示，将通过招投标等公平竞争方式确定收运处置单位，并与其签订特许经营协议，民企等社会力量也可参与。

　　机关单位食堂私卖潲水油要问责

　　《办法》要求，餐饮垃圾和废弃食用油脂产生单位应与收运处置单位签订收运处置合同，合同中应当明确收运时间、频率、数量和处置场所等内容。合同应报所在区城管部门备案，在向同级环保部门办理排污申报登记时，应当提供备案回执证明。

　　同时，要求餐饮行业组织将餐饮垃圾和废弃食用油脂的处理工作纳入餐饮单位等级评定和诚信管理范围，督促餐饮服务单位做好餐饮垃圾和废弃食用油脂的减量和规范排放、无害化处置等工作。

　　《办法》表示，禁止任何单位和个人将餐饮垃圾和废弃食用油脂交未取得服务许可的单位和个人收运、处置，违反规定，对单位处以2000元以上1万元以下罚款，个人处以1000元以下罚款。禁止将餐饮垃圾和废弃食用油脂直接排入公共水域、公共厕所、排水管道或者以其他方式随意倾倒、抛洒、堆放餐饮垃圾和废弃食用油脂，否则责令立即清除污染，对单位最高处以5万元罚款，对个人最高处以1000元罚款。禁止将餐饮垃圾和废弃食用油脂混入其他类别生活垃圾存放、收运、处置，否则单位最高罚2万元，个人最高罚1000元。

　　《办法》还表示，行政机关、事业单位内部食堂、餐厅违反本办法的，除依照本办法进行处罚外，对其主要领导和直接责任人员，依法追究行政责任。

　　回收废油脂?或有政府补贴

　　《办法》规定：餐饮垃圾的收运和处置费用由市、区财政予以补贴。餐饮垃圾排放处置纳入生活垃圾收费体系。

　　广州市法制办相关负责人称，将来对餐饮垃圾和废弃食用油脂将实行差别化的排放处置费和补贴政策。目前的考虑方向是：向产生单位收集废弃食用油脂时，不仅不收废弃食用油脂产生单位的排放处置费，反而考虑对排放单位给予一定的收购补贴。

　　而对餐饮垃圾，该负责人称，目前广州的餐饮垃圾处理仍执行生活垃圾标准收费，将考虑“在餐饮垃圾规范收运处置前提下，对现有的生活垃圾收费标准和方式进行必要的修订和调整”。据悉，目前广州的餐饮垃圾处理费只相当于20元/吨，而国内已经实施餐饮垃圾收运处置费城市中，其收运处置费用一般在100-200元/吨左右。
