我的问题是，该《规定》与2012年减刑、假释的司法解释是一个什么样的关系？

2012年，最高人民法院在1997年《最高人民法院关于减刑、假释案件具体应用法律若干问题的规定》的基础上进行修改，重新公布。也就是2012年减刑、假释司法解释。这个司法解释主要是关于实体性内容的解释。所以我们把它称为“实体性司法解释”。这次我们发布的《规定》叫做《最高人民法院关于减刑、假释案件审理程序的规定》，是专门规定减刑、假释案件如何立案、如何公示、如何开庭以及如何书面审理、如何送达等具体程序性的规定，所以也被称为“程序性司法解释”。但是大家可能发现，前面我们称之为“实体性司法解释”其实也是有一些程序性规定的，因为在那个时候，减刑、假释案件的审理程序还没有完全总结出来，只是做了部分规定。这次程序性的司法解释是对减刑、假释案件审理做了一个系统性的比较全面的规定。它也标志着我国审理减刑、假释案件由过去的那种执行机关报请、法院审批行政化的审批模式正式变成了按照案件特点进行审理的一种审判程序，这个司法解释出台以后，必将和前面讲的实体性司法解释一样，分别从实体上和程序上共同保障减刑、假释案件办理的公正、合法。谢谢。

这次新的司法解释与3月14号最高法院召开的贯彻落实中央政法委指导意见视频会议上提出的“五个一律”的工作要求有什么关系？谢谢。
3月14号最高人民法院召开了贯彻、落实中央政法委关于减刑、假释、暂予监外执行的指导意见的全国视频会，同时在视频会议上，最高人民法院提出了“五个一律”的工作要求。“五个一律”的工作要求就是把办理减刑、假释案件程序中关键的几个节点提炼出来，提出刚性的要求。这些节点是下级法院在审理减刑、假释案件中总结经验找到的几个关键环节，也是我们针对实践中出现的问题进行分析，采取的有针对性的措施。抓住了这五个关键的节点，就要强调从严掌握，要体现出严抓、严管、严控、严防的要求。因为对于程序性的规定，必须认真严格执行，如果认识上产生懈怠就会带来执行中的松懈，使执行中放宽把握。有时候恰恰是因为在执行中的变通和放松，使得有违法犯罪企图的人有机可乘，因此就必须提出更高的要求，所以我们提出在这五个关键环节中要一律从严把握。“五个一律”和我们今天公布的司法解释，它的主要内容都是关于程序上的要求，“五个一律”的内容也体现在这个司法解释当中，可以说两者的目标都是一致的，都是为了确保减刑、假释的公开公正，最终也是确保减刑、假释案件的质量。谢谢。

想请问现在出了“五个一律”的工作要求，又出了新的司法解释，下一步最高法院在具体工作中如何保障这些新的规定能够得到落实，有什么更严厉的举措？还有，如果您有特别值得推荐的案例，有没有比较典型的，给我们推荐一下。
下一步最高人民法院将采取以下这些措施保证“五个一律”和有关措施的执行。第一，要进一步完善相关制度。比如根据中政委的意见中关于对部分职务犯罪罪犯减刑、假释、暂予监外执行实行备案审查的要求，我们下一步要下发《关于对职务犯罪罪犯实行备案审查的通知》，就备案审查的具体程序要求予以明确。同时我们考虑到新出台的司法解释以及“五个一律”均主要为程序性的规定，对于实体方面下一步还要根据审判实践的经验和提出的问题，对2012年公布的《最高人民法院关于办理减刑、假释案件具体应用法律若干问题的规定》，也就是刚才说的实体性的司法解释再进行必要的修改。
第二，要建立常态化的监督检查制度。我们要以三类案件为重点，最高人民法院每年要组织全国性或者区域性的检查，今年下半年将正式启动，重点检查职务犯罪罪犯减刑、假释、暂予监外执行的比例是否明显高于其他罪犯的相应比例，各高级人民法院也将根据本辖区的情况建立相应的监督检查机制，并且报最高人民法院备案。在监督检查中发现问题的要坚决予以纠正，发现法院工作人员在办理这类案件中有违纪违法行为，甚至构成犯罪的，一律移送纪检监察部门或检察机关从严追究责任，追究责任的情况还要向上一级法院报告，涉及其他机关工作人员违纪违法的也要及时移送有管辖权的有关部门处理。
第三，加强与相关部门的协调配合。我们要更加主动地接受检察机关的监督，积极协助刑罚执行机关修改罪犯的计分考核制度。
第四，建立全国性的公示公开网络平台。最高法院已经着手在人民法院网上建设减刑、假释、暂予监外执行案件的信息平台，这个平台建好以后可以实现全国的减刑、假释、暂予监外执行案件的信息联网，在这个平台上不仅可以进行立案公示、开庭公告、裁判文书公开，而且可以了解减刑、假释、暂予监外执行的工作动态，查询相关法律法规和司法解释。
第五，我们要加强队伍建设，完善机构设置，充实人员力量。新出台的司法解释、“五个一律”的工作要求以及中政委的意见，都对办理减刑、假释案件提出了更高、更严的要求，减刑、假释的工作任务将更加繁重，压力会进一步增大，为了做好这项工作，我们必须使广大从事刑事审判监督工作的法官坚定理想信念，用社会主义法制理念武装头脑，依法办案、廉洁自律，不断提高法律理论水平和办案能力。与此同时，为了改变目前“案多人少”矛盾尤为突出的现状，人民法院将按照中政委关于“审判机关应当建立专门的审理减刑、假释、暂予监外执行案件的审判庭”的要求，及时完善相关机构设置，充实配备符合工作要求的高素质人员力量，以确保减刑、假释、暂予监外执行工作顺利开展，努力实现“让人民群众在每一个司法案件中都感受到公平、正义”的目标。
第二个问题，你说的案例，可能过去媒体上已经报道过，比如说在广东省高级人民法院、广州市中级人民法院、新疆乌鲁木齐市中级人民法院、河南省高级人民法院、河北省的衡水市中级人民法院，这些法院都开展了对报请减刑、假释案件的公示，特别是广东省高级人民法院是在互联网上进行公示的，在今年3月广东高院网上公示的一批案件引起了媒体的关注，其中有一个拟减刑罪犯是原广东省统战部的副部长，他的情况公示以后，在社会上引起了关注，审理案件时法院严格把关，最后将这个案件退回了报请机关，没有做出减刑的裁定。

我有两个问题，第一个问题，关于减、假、保案件，我想问一下今后人民法院是否更多地开庭审理。第二个问题，尤其是针对官员腐败案件，举个例子，他如果被判处了无期徒刑的话，现在有了这样一份新的规定以后，假如他再申请减、假、保之类这一系列的情况，在审查和执行的过程中跟以往相比会有哪些不同的地方呢？
第一个问题是关于更多地开庭审理的问题。根据司法解释的规定，刚才新闻发言人也介绍了，对于开庭案件的范围有了进一步的规定，应该讲开庭审理案件的范围更广了。在具体的开庭审理当中，减刑、假释案件和一般刑事案件不一样，我们这次就针对减刑、假释案件的特点设计了更适合减刑、假释案件的审理程序，重点审查、核实罪犯的悔改表现，增加了检察院工作人员和执行机关工作人员对罪犯实际表现的审查。过去由于减刑、假释案件比较多，在开庭场所的选择上，很多法院选择在监狱开庭，就造成一般的公众想去旁听有所不便，这次我们在司法解释以及“五个一律”的要求中，强调要更加主动的公开。所以在“五个一律”里有一条是主动邀请人大代表、政协委员及其他方面的代表来旁听。主动邀请实际上是要体现主动的接受监督，增强庭审公开的效果，以公开促公正。另外，针对减刑、假释案件开庭的特点，很多地方还推行了视频开庭，通过这种方式来解决罪犯押送不便以及监狱和法院距离太远带来的审理不便等问题。河北省衡水市中级人民法院在工作中就使用了高清摄像设备，组成了一个便携式的巡回数字法庭，效果还是很好的，这样也可以使我们邀请的代表不必长途奔波，在法院就可以看到对罪犯的审理情况。这些措施的执行，都会促使更多的减刑、假释案件得到开庭审理。
第二个问题，对官员的减刑、假释等会有什么不同。这要从实体和程序两方面来说。
从实体上来讲，根据中政委意见的要求，对于职务犯罪罪犯的减刑、假释采取了更严格的标准。这里我要先解释一个问题，法律和司法解释关于减刑起始时间、间隔时间以及罪犯实际服刑时间的规定，都是按照最低要求来表述的，比如说“服刑三年以后方可减刑”，是说罪犯至少要服刑到这个年限才可以减刑，但在实践中我们发现有的地方把这个问题理解成到了这个期限就必须减刑，这个理解是不对的。关于职务犯罪罪犯的减刑问题，在2012年减刑、假释司法解释的基础上，中政委的意见提出了更进一步的要求。比如说对职务犯罪罪犯如果判处的是无期徒刑，他必须服刑三年以上方可减为二十年以上二十二年以下的有期徒刑，注意这里讲的是“方可减刑”，不是说他到了三年就一定减刑。减为有期徒刑以后，一次减刑不超过一年有期徒刑，两次减刑之间应该间隔两年以上，这是实体上有了进一步的要求。
除此之外，新司法解释和中政委的意见都对职务犯罪罪犯的减刑、假释条件做了进一步的严格限制，比如说有重大立功表现的认定，其中有一条是“有发明创造或者重大技术革新的”，要认定为重大立功表现，这个发明创造或者重大技术革新必须是罪犯在服刑期间独立完成，并经国家主管部门确定的发明专利，而且不包括实用新型专利和外观设计专利。如果按照法律规定“对国家和社会有其它重大贡献”认定为重大立功表现的，这个重大贡献必须是罪犯在服刑期间独立完成并经国家主管部门确认的劳动成果。
此外，我们在对职务犯罪罪犯减刑、假释的实体把握方面还要注意，对于服刑期间利用个人影响力和社会关系等不正当手段企图获得减刑、假释机会的，不认定该罪犯有悔改表现，也就是说在考核时这不是加分的因素，是必须减分的因素。
在程序规定方面，就如刚才新闻发言人所介绍的，这次我们对于减刑、假释程序，在五个节点上都要从严控制，特别是前面四个节点，强调对于减刑、假释要一律公示，对于“三类罪犯”(包括职务犯罪罪犯)的减刑、假释案件要开庭审理，对于职务犯罪罪犯的开庭审理要主动邀请人大代表、政协委员等有关方面来出席旁听，减刑、假释裁定做出之后要公示。以前的公示一般是在服刑场所进行，这次我们设计的公示有一个很大的变化，就是公示走出了高墙之外，向社会公示。最高法院减刑、假释、暂予监外执行信息平台搭建以后就要上网公示。社会公示对于严格规范职务犯罪罪犯的减刑、假释是能够产生很大的监督作用的。关于这个问题我就回答这么多，谢谢。
