《法制晚报》记者了解到，李学林被抓后，他的父亲辞去了当了18年的村干部，平时门都不愿出。老人称，儿媳曾给儿子写信，称要么自己死，要么离婚。
牵入命案 河南唐河农民 被举报杀人
2007年3月10日晚上，两个蒙面入室抢劫犯在湖北省原襄樊市襄阳郊区一户农家作案时被事主当场制服。
两人一个叫李小冬，时年34岁；一个叫王小华，时年29岁。他俩都是河南省南阳市唐河县桐寨铺镇大李营村人。
王小华交代，从2002年到被抓时的5年间，他和李小冬在河南、湖北两地入室抢劫57起，杀人2起(其中一名死者名叫李建东)，还实施过一起绑架。王小华称，杀人案是李小冬要求自己“配合”的。
李小冬则交代，其中一起杀人案发生在河南省唐河县，自己系受雇犯罪，雇主是同村的李学林。
李学林1972年生人，住河南省南阳市唐河县桐寨铺镇大李营村，小学毕业后一直在家务农，开过养殖场，李建东曾在养殖场打工。
2007年4月25日，李学林被湖北襄阳警方刑事拘留。
口供不断反复 称遭刑讯逼供
李小冬被抓后一直供述，是李学林要求他“做掉”李建东的。“我当时说自己一个人干不了，李学林说你找谁帮忙我不管，也不用跟我说。于是我找到王小华、李大林。”
被抓后，李学林最初称自己没有雇李小冬杀人。但从被拘留的第13天即2007年5月10日开始，李学林承认雇凶杀人。
但李学林认罪后，同年7月16日，襄阳警方却对李学林变更了强制措施，将其移交河南省唐河县警方，由唐河警方对李学林进行监视居住，半年后改为取保候审。
回到唐河老家，李学林变了，不承认自己雇凶杀人。唐河县警方的讯问笔录显示，当时民警问李学林是否有违法行为时，李答没有，称在襄阳自己是挨了打才不得不承认的。
被取保候审一年后，2009年1月18日，襄阳警方再次将李学林从家里带走，一走至今5年。
知情人透露称，襄阳警方再次抓走李学林，是因为被害人李建民的家人一直在上访，“他们太闹了，一直要求处罚李学林”。
卷宗显示，其间李学林一共接受过9次讯问，其中2次承认雇凶杀人，7次不承认，并称有罪供述是被打得受不了才那么说的。
法院审理 一审被判死缓 文书公章边上写“冤”
此后，襄阳市检察院对该案提起公诉。
检方指控，2003年初，李学林怀疑其妻与李建东有两性关系，以6000元酬金请李小冬杀掉李建东。同年3月24日晚，李小冬纠集王小华、李大林，将李建东骗出后用木棍将其打死，后将尸体丢进一机井内。事后，李学林给付了李小冬酬金。
2009年8月19日上午，此案在襄阳中级法院开庭。其间，李小冬翻供了。
当时的庭审笔录显示，公诉人讯问李小冬，此前他作出的李学林雇凶杀人的供述是否属实，李小冬称不属实，李学林没有雇他杀人。李学林也称自己没有雇凶，更没给过钱，有罪供述是遭到刑讯逼供做出的。
2009年9月15日，襄阳中院对此案作出宣判。法院一审以故意杀人罪、抢劫罪、强奸罪、绑架罪判处李小冬和王小华死刑，以故意杀人罪、抢劫罪判处李大林有期徒刑11年，以故意杀人罪判处李学林死缓。同时法院判决4人应共同赔偿死者李建东家属23415元。
拿到判决书后，李学林大声喊冤，并在判决书的最后一页法院公章旁写上了这样的字迹：“我要上诉，告状，求真理……一直告到我死为止，冤枉、冤枉、天大的冤枉！!!!”
峰回路转 举报者承认诬陷 家属拿到“悔过书”
宣判后，李学林上诉。二审在湖北省高级法院开庭。
法庭上，就李学林是否雇凶杀人一节，无论公诉人和法官如何提问，李小冬始终拒绝回答。而李学林仍坚称自己遭诬陷。
2010年7月7日，湖北省高院终审维持原判。二审宣判后不久，李学林的二审辩护人、湖北相宜律师事务所的律师倪移生给李学林父亲李建斌送来一封署名为李小冬的信(见右上图)。信的开头这样写道：
学林：
我对不起你，对不起你全家。当我看到你现在的样子，说实话，我心里很内疚，也很后悔……我真的没想到会给你判这么重，说心里话，要是知道是这样，我绝对不会这样做。我本想着把你拉出来，让公安治治你就行。
学林啊，我这辈子欠你的，下辈子再还吧……你把这封信收好，如果年前或年后我要是走了，这封信也许能救你……我如果春节前后不死，明年我保证能让你回家。你要好好保重，对不起了。
承认因分赃不均遭威胁 起意杀人
信中，李小冬道出杀死李建东的原因。
李小冬称，因为儿子超生，被村里罚了款，他恨上了村计生干部李连才，曾在一天晚上用土枪对准李连才家的窗户开了一枪。“我离开李连才家刚走两步，李建东蹿了出来。他正在李连才家偷东西，但什么都没偷到。我的一举一动都让他看到了。”
李小冬称，从此以后两人经常一起偷东西，但变卖赃物后钱经常被李建东独占，而且还经常借钱不还。“有几次我找他要钱，他还说我别把他逼急了，逼急了他不让我好过。”李小冬认为李建东经常用当初的事情威胁自己，是个“定时炸弹”。
按照信中的说法，2003年春节前，李建东向李小冬要500元过年，李小冬不愿给，又遭威胁。李小冬只好开着拖拉机卖了10袋小麦，把卖小麦的500元钱中的300元给了李建东，说剩下200元要自己全家过年用。但李建东不肯罢休，称自己春节后要去外地打工，要求李小冬春节后给他准备200元路费。
“我恨他，恨得很。他说过了年要走，我怎么也不能让他走，这才设计了杀死李建东的全部计划。”李小冬在信中写道。
再现波折 二审开庭时悔过书未做新证据提交
李学林的申诉律师、北京永泽律师事务所律师王永杰讲述了信的由来。
王永杰前往襄阳监狱会见李学林时，李学林说，开庭前，他和李小冬等4人都被羁押在襄阳看守所。一审开庭后，李学林到看守所里的理发室去理发，当时李小冬也在，趁人不注意，李小冬将一个烟盒扔在地上，示意李学林捡，李学林捡起来揣进了兜里。
回到监室后，李学林发现烟盒里有一封信，写在普通信纸上，一共4页，末尾没有写时间。李学林看后意识到信的重要性，在二审开庭前的一次律师会见时，他把信交给律师倪移生。
但在二审开庭时，律师没有把它当做新证据提交给法庭。“我问过倪律师，他没有说明理由。”王永杰说。
举报者被枪决 悔过书法院没认可
2010年10月15日，李学林的父亲将信和申诉书一起交给湖北省高院，要求改判李学林无罪。
申诉书交上去了，但迟迟不见结果，李学林在焦虑中度过了2011年春节。春节后不久，李学林听同监室的人说，李小冬被枪毙了。
半年后，李学林拿到了湖北省高院的驳回申诉通知书，法院对信的内容未予采信。
在这份编号为[2011]鄂刑申字第22号的驳回申述通知书中，法院陈述的理由有几点：
从李学林的杀人动机上看，法院查明，李小冬明确供述李学林是因为怀疑其妻子与李建东有不正当男女关系，所以雇请李小冬杀人，李学林的妻子曾称李学林质问过此事，李学林本人也在侦查阶段有两次有罪供述，因此三方证据可以相互印证。
在侦查阶段，李小冬曾供述称，“我开始没有说，后来看到我命保不住了，我想对死者有个交代，就把杀人的事交代了。刑警问我杀人动机时，我实在没有杀李建东的动机，就只有把李学林雇我的事据实交代。”
法院认为，李小冬的供述，有同案犯李大林的供述印证。而李学林虽称遭到刑讯逼供，但无证据证明。
法院还强调：一审之后，李小冬还给被害人李建东的家人写过信，但内容与给李学林的那封信完全相反，信里明确写明是李学林雇请其杀害李建东的。
法院认为，李小冬已被执行死刑，无法核实李小冬写两封内容迥异的信的动机是什么。
同时，李学林称信是在一审庭审之后、二审开庭之前拿到的，为何如此重要的信李学林不在二审开庭时提交？李学林称是因为“害怕”，而李父说是二审后律师才交给他，父子说法明显不一致，与常理不符。
“我们申诉时还没有开始对李小冬进行死刑复核，等人已经被枪毙了，又说我们提交的材料死无对证。”李学林的父亲哭着对《法制晚报》记者说。
家属情况 与案件被害人是亲戚 已不走动
提起儿子，66岁的李云斌哭了。李云斌在村里当过18年村支书、村长，还担任过县人大代表。
儿子被抓后，要面子的李云斌辞职，连门都不愿意出。李云斌常怀疑，李小冬给儿子“栽赃”，是因为自己当村干部得罪了人。
李云斌始终不相信儿子犯罪。他回忆儿子第一次走出看守所的情景：“才被关了三个多月，就已经骨瘦如柴了。见到我他哭了，说自己没有雇凶杀人，然后我俩抱头痛哭。”
他也还记得儿子第二次被抓走时的情景：“警察说带儿子走，去问些情况。李学林非常坦然，笑着说爸别担心，我没事。可这一走就是5年。”
李云斌说，他与李建东的父亲是亲叔伯，在一起养羊，关系很好，现在根本不走动了。
李学林妻子 被指曾提出离婚
李学林有2个儿子，大儿子今年22岁，小儿子今年11岁。“孩子在村里抬不起头。”李云斌说。
他说，大孙子初中没毕业就不愿意上学了，他托人让他在附近的高速路当保安，可他干了不到一个月就回家说不干了，因为“老有人说小话儿，吃饭都抬不起头”。
李云斌说，他已到结婚年龄，但亲戚朋友给他介绍了好多姑娘，都没成，人家一听说他父亲在监狱里，就不愿意交往了。说着说着，李云斌哭了。
李学林的儿子埋怨父亲，李学林媳妇也要求离婚。她曾写信给李学林，说要么自己死，要么离婚。
“学林给我写信说，孩子已经没有父亲了，不能再让他们没有母亲，要我一定要留住他媳妇。”
“我66岁，老伴65岁，老伴身体不好，曾经得过羊角风，靠吃药维持。儿子被抓后，她精神受了很大的打击，本来好几年没犯病了，结果又开始经常犯。”
说着，李云斌拿出一张全家福给记者看，上面是他们老两口和媳妇及2个孙子的照片，唯独缺了李学林。
但如今的家里，只剩下了老两口。李学林的媳妇带着两个儿子，离开老家去浙江打工了。
最新进展 已委托律师 进行新一轮申诉
郑毅(化名)是一名驻所检察官。他告诉《法制晚报》记者，李学林入狱后多次申诉，一直说自己是被冤枉的。
“我和同事们查阅案卷、找当事人谈话，一番调查后，我个人认为李学林是冤枉的。”郑毅说。
他分析说，一审、二审法院均称参与杀人的李小冬、王小华和李大林的口供都曾说过李学林是雇主，但仔细看3人的口供，互相矛盾，并不能证明李学林是雇主。另外，在李学林“给钱”的时间上，众人说法不一。
目前，李学林已经委托律师王永杰进行新一轮申诉。王永杰告诉《法制晚报》记者，“已经找到新的证据，但现在需要保密。”
