　　新华网长沙5月5日电 (记者史卫燕)近日，我国民间首个江豚保护机构“岳阳市江豚保护协会”的一名成员，因涉嫌敲诈勒索被警方拘留。

　　记者在调查中发现，目前一些民间公益组织人员组成复杂、管理漏洞百出、自我及行业监管不足等问题已十分严重，亟须重视并加以引导。

　　公益人士涉嫌敲诈渔民1万元

　　3月22日，民间公益组织“岳阳市江豚保护协会”成员李劲松因涉嫌敲诈勒索被岳阳县公安局拘留。而在此前，他以热爱江豚，甚至无偿使用自己的车辆用于保护工作，而被人点赞。

　　根据渔民何黄林的举报信，2013年9月，他在洞庭湖上电捕鱼时被岳阳市江豚保护协会的队员发现，在他的求情下，对方没有将其立即交给渔政等执法部门，而是告诉他上岸后再联系。第二天，协会成员李劲松要求其给1万元，并表示“以后不会为难你的，下次对你有好处”，遂成交。

　　李劲松也向记者坦承确实收了渔民的钱，但却是渔民“为感谢自己”自愿提供的经费，他将这些钱用于车辆修理和加油。他特别说明，车是自己的，但一直无偿用于江豚保护工作，用钱也是为了保障车辆的正常运转。

　　岳阳市畜牧水产局渔政站书记卢益卫表示，民间组织成员作为公民有监督的权利，但却无执法权，志愿者私自收受渔民的钱财，不仅在行政上“越权”，更有“敲诈勒索”触犯刑法的嫌疑。

　　根据《中华人民共和国渔业法》，渔业相关行政处罚，由县级以上人民政府渔业行政主管部门或者其所属的渔政监督管理机构决定。

　　人员混杂、行为失范、财务混乱的“江豚保护协会”

　　据岳阳市江豚保护协会负责人介绍，协会主要通过舆论宣传、巡湖守卫等多种方式保护江豚，同时也保护江豚赖以生存的洞庭湖生态体系。

　　相关渔政部门介绍，协会依靠取得的成绩在当地获得了一定认可。由于协会不少巡逻队员为当地渔民，非常熟悉洞庭湖非法捕鱼的情况，对执法部门的工作形成了有益补充。

　　但是，记者在调查中发现，这个协会内部管理存在诸多问题，隐藏极大风险：

　　第一，机构组成人员素质参差不齐，亟须培训规范。卢益卫表示，协会不少成员是没有接受过正规教育的渔民，也曾使用非法手段捕鱼。

　　第二，志愿者行为规范笼统，缺乏具体可操作性条文。协会成员李劲松的行为已涉嫌“敲诈勒索”，然而，在协会为记者提供的两份内部管理条文中，并未发现其对协会成员易犯的违法违规行为进行提示和约束。

　　第三，财务管理混乱且资料不全。记者在反复要求出示财务支出详单的情况下，协会出示了一份《协会负债投资情况》，其会长介绍此表即为支出表。

　　记者看到，协会的总负债合计170.06万元，其中用于宣传的费用即达142.22万余元，而用于直接保护江豚生活水域的巡湖费用仅24.3万元。更让人意外的是，负债投资已达170.06万，而协会自成立至今所得募款还不足100万。

　　民间公益机构如何健康发展？

　　事实上，问题不只存在单个组织内部，本从善意出发保护洞庭湖生态环境的公益组织之间也产生了矛盾。

　　2013年9月30日，江豚保护协会副会长何大明成立了名为“岳阳市洞庭湖水上废弃物清洁志愿服务队”的新组织，成为其负责人并继续担任江豚保护协会副会长职务，李劲松也在没有退出江豚协会的同时加入了该组织。

　　不少公益界人士表示，由于两支队伍都在洞庭湖从事环保工作，由此产生的竞争让关系恶化，“内讧”“构陷”等传闻不绝于耳。

　　根据岳阳市江豚保护协会今年3月8日发布的开除何大明会籍的决定可见，其“违法乱纪”行为有：多次擅自接受媒体记者采访，破坏协会和巡逻队员名誉，打着协会旗号为其个人募捐，对巡逻队员和渔民敲诈勒索等。

　　近年来，民间公益的崛起在为公益事业注入新鲜血液的同时，却并没有彻底改变部分公益机构不透明、不公开、不规范的印象。

　　中国社科院发布的2013年《法治蓝皮书》中《慈善法治现状与完善报告》调查结果显示，我国慈善机构对于财务信息公开的重视程度不够，抽查的15家慈善组织中只有5家公开了2012年审计报告，对于捐款总额只有两家给出了具体数字。

　　长沙市民政职业技术学院教授史铁尔表示，在民间公益机构迅猛发展的大背景下，我国亟须出台进一步的规范性法律条文。目前，我国法律法规对公益机构的规范刚性不足，缺乏对违反规定的有效惩戒措施。
