2009年，工业园区在湘东区下埠镇大陂村开展征地拆迁，根据安排，村主任王某南及其他村干部协助进行丈量土地、签订协议等工作。王某南对副村主任施某昌表示，要虚报一块山岭，“弄点钱花花”，施某昌当即同意。二人商议，由王某南负责疏通关系，联系其他人完成虚报土地套取补偿款，施某昌负责丈量土地。
王某南找到村支书李某春、镇长助理雍某、园区负责征地登记的张某国，他们串通好后，利用征地丈量、签订协议过程中无监管的漏洞，竟将原本8.896亩的征地面积虚报为103.896亩。
与王某南等人相比，下埠镇杞木村原副村主任王某云、杞木村龙湾小组长李某芳与陶瓷工业园干部胡某的做法更为简单。2010年，他们虚构征用李某芳土地62亩的协议，并将协议与其他征地协议一起送往工业园按正常征地程序办理手续。此后，胡某和王某云又以不同人的名义签订虚假征地协议5份，套取补偿款10余万元。
萍乡市人民检察院反贪局副局长唐震说，因为部分农村财务管理制度混乱，收支管理不严格，且农村干部变动频繁，谁当干部谁管钱，无账目的交接和财务公开，导致在土地征用补偿款的申报、领取环节的窝串案频发。
一人贪腐多人效仿，抱团联手作案
记者调查发现，由于征地补偿工作程序比较复杂，涉及补偿物的种类、性质各有不同，需要各环节相互配合，而这之间又缺少必要的监督。因此，园区、镇、村干部形成利益共同体，采取联手作案、集体合谋的方式，利用各自分管具体工作的职务之便，相互勾结侵吞国家征地补偿款。
“法不责众”的想法往往会导致“一人提议，多人附和；一人贪腐，多人效仿”，贪腐窝案串案频发。在王某南一案中，便是村支书、村主任、副村主任、镇长助理、园区工作人员等联手作案。
办案人员发现，在土地、房屋拆迁补偿环节，若有一个村子多报、虚报面积，其他村便可能效仿，并且这种行为会逐渐向周边相邻乡村蔓延，形成特定地域大面积的侵吞补偿款现象。
“部分干部法律意识淡薄，贪财心切，其作案手段简单直接，犯罪中智力因素参与较少，有的甚至是集体研究，明目张胆地从事犯罪活动。”萍乡市人民检察院检察官熊亮表示，在农村土地征用拆迁过程中，犯罪手段主要表现为在申报环节采用虚报面积、虚列名单非法骗取和侵吞补偿款。此类案件作案时间跨度大，少则一两年，多则五六年，且重复作案、多次作案。
据办案人员介绍，自2006年以来，在陶瓷工业园区的征地拆迁过程中，连续发生多起虚报征地，套取国家征地补偿款腐败案件，9名相关干部被查处。
“发生在农村的腐败案件说明，国家对基层权力的监管还存在漏洞，致使征地程序不公开、农村村务不透明。”江西社会学学会会长王明美认为。
村干部权力过分集中，拆迁单位与土地主管部门缺乏互动
“农村土地征用中的职务犯罪危害大，有的甚至引发群众集体上访，严重影响社会稳定和经济发展。”熊亮介绍，由征地矛盾引发的群体性上访事件已经成为一种突出的社会现象，反映村干部贪污腐败的举报信件也大多集中在征地补偿环节。
权力过分集中，存在监管盲区，是基层干部敢于贪腐的首要原因。王明美认为，在基层农村，办事权力集中在村党支部书记和村委会主任等个别人或少数人手中，有的村干部甚至集党支部、村委会、村企业大权于一身，这使他们作案时如鱼得水、有恃无恐。一些知情群众慑于这些人的权势，敢怒不敢言，害怕招来报复；同时，来自上级部门的监督无力，纵向监督软弱。
在征地拆迁系列腐败案中，拆迁单位与土地主管部门缺乏互动，对上报的土地信息没有认真核实，甚至没有相关复核程序，而是直接将上报补偿金予以发放，导致村干部和相关人员勾结贪污有机可乘。
办案人员介绍，由于上述特点，目前在退耕还林、移民安置、农田水利、电网及饮水改造、村庄整治、扶贫开发等工作中，均存在不同程度的村官职务犯罪现象。
唐震认为，应健全农村土地征用拆迁环节资金监管体系和土地征用制度，制定农村征地补偿工作管理办法，明确征地管理和监督的责任主体、监督措施、责任追究等，为农村征地补偿工作提供制度保障；还应围绕土地开发领域、涉农领域等民生领域，建立健全职务犯罪风险预警机制，有效发挥查办案件的惩戒治本功能。
