广西一砂场因妨碍行洪遭强拆 县政府被判担责|房屋遭强拆_新闻资讯

  中新网钦州5月9日电(陈燕 赵子钦) 广西钦州一砂场抽砂设施因妨碍行洪被当地县政府强拆,该砂场经过三次维权终有所获。钦州市中级法院9日披露,该院近日作出判决,确认双方均违法,判令涉事县政府赔偿砂场七成损失。


  法院审理查明,2008年11月5日,钦州某县水利局向上述砂场作出河道采砂许可,有效期至2009年底。砂场自筹资金购置了抽砂机、配电盘、变压器、抽沙木排、构建砂台等设施,采砂出售。在行政许可有效期内,该县防汛抗旱指挥部认为砂场的抽砂设施妨碍行洪责令拆除。


  2009年11月6日,砂场为了能继续采砂,遂向水利局申请延续一年采砂期限但被拒。砂场随后向当地政府提出行政复议,2010年2月,该县政府行政复议决定责令水利局重新作出具体行政行为。水利局根据采砂场河段的实际情况及专家技术人员鉴定的意见,决定不准予砂场延期申请。


  砂场不服,曾两次向法院提出行政诉讼,均维持水利局不准予延续采砂许可的决定。


  2010年3月,砂场采砂许可有效期满后,没有取得延续采砂许可仍继续采砂。该县政府即组织水利局、国土局等部门联合执法,拆除和清理该砂场采砂设施。由于没有及时对拆除的全部采砂设施进行清点、登记,并妥善处理,致砂场许多采砂设备无法确认下落,造成经济损失。


  据悉,采砂设施被被告拆除后,砂场不间断地向上级人民政府及有关部门反映投诉。2011年1月11日,广西自治区法制办要求涉事县与砂场协商解决,但该县并未遵照执行。2013年,砂场向该县政府书面提出赔偿申请,但遭回绝。


  砂场诉称,砂场取得河道采砂许可后投入100多万元购置采砂设备,其中大部份资金向银行借贷。被告县政府动用公安、水利、国土资源等组成执法队伍,拆除和烧毁砂场所有设施,造成砂场巨大经济损失。请求法院确认被告县政府具体行政行为违法,判令赔偿直接和间接经济损失。


  被告县政府辩称,组织联合执法的具体行政行为执法主体、执法程序合法,无任何过错,不损害砂场的合法权益,砂场的违法事实清楚。同时,砂场的行政赔偿申请已过诉讼时效,请求法院驳回其诉讼请求。


  法院审理该案后认为,被告县政府具体行政行为不仅违法,而且造成原告采砂设备灭失,过错的责任较大,砂场损失与政府行为间有直接因果关系,政府应承担必要、合理的赔偿责任。


  今年4月底,法院作出判决,判令被告县政府赔偿砂场直接经济损失33.76万元,原告自行承担直接经济损失14.46万元。(完)
