　　中新网郴州5月9日电(胡志强 李忠卫 许志华) 9日，湖南省资兴市人民法院以徇私枉法罪，分别判处郴州市公安局禁毒支队原侦查员王斌、余菁有期徒刑10年、6年。

　　郴州市检察院反渎职侵权办案人员透露，该案侦查过程十分艰难，案发时间是2009年7月，由于时过境迁，很多证据湮灭，加之举报人不断上访并向媒体披露案件经过，案情和证据几乎没有秘密可言，同时王、余二人反侦查能力很强。

　　郴州市检察院侦查监督部门于同年8月3日及时对王斌作出了逮捕决定，余菁于8月30日向检察机关自首并由资兴市检察院予以取保候审。同年9月29日，郴州市、资兴市两级检察院反渎职侵权局侦查终结移送公诉部门审查起诉。

　　经检察机关公诉部门审查，王、余二人在办理曹某、邓某贩卖毒品案过程中徇私枉法，对明知有罪的人故意包庇使其不受追诉、故意使罪重的人受较轻的追诉，遂于2013年11月18日以徇私枉法罪向资兴市法院提起公诉。

　　2014年1月22日，该案在资兴市法院公开审理。庭审中，公诉人通过周密举证，并在发表公诉意见时释法说理，王、余二人当庭表示认罪。(完)
