“表面上看，有的是企业行为，实际处处都有当地政府的影子。没有政府点头，这么大规模的违法占地怎么实施？”国家土地督察济南局副专员杜滇昆在26日的会上说。
不能“发文即执行、移交即完事”
对违法用地，基层干部也有话说。
“一些干部，特别是部分村支部书记、村委会主任，法律意识淡薄。”26日，一位不愿透露姓名的乡镇干部被记者问起怎么看待违法用地时说，“认为村里的地‘我说了算’,有的甚至在竞选时就夸下海口，拿卖地来增加集体收入。就别说个人拿好处了。”

为什么叫不停拆不掉？一位基层国土干部告诉记者，现在国土违法要强拆得移交法院，强制拆除只能由法院执行。而这位乡镇干部在任十几年，辖区内并未见到一起法院强拆的情况。“法院固然执行不力，但行政主管部门有督促之责，不能发文即执法、移交就完事。违建没拆除，土地没复耕，怎么能算执法到位了呢？”他说。
土地都没有，怎么能取得“部分合法手续”呢？他告诉记者，他见到的这些手续包括项目立项、工商注册、节能评估、环评等。“项目立项需要国土部门预审。问题是，国土部门在申请强制执行之前有个罚款，企业拿着罚款收据，认为款都罚了，还能不合法化吗？发改部门也可能这样理解。”
“要想堵住违法用地，一个是加强干部法制教育，更迫切的，是改变目前的执法体制，形成闭环。”他说。
企业怎么想？一位不愿透露姓名的企业主告诉记者，谁也不想看到自己投资好几百万的厂房被拆。但从项目核准、征地、公示、招拍挂到拿到土地证，顺利地话也需要一年时间。如果主管部门能适当提高审批效率，也会对减少违法起到积极作用。
