根据2006年开始实施的国务院《艾滋病防治条例》，其中规定：“国家实行艾滋病自愿咨询和自愿检测制度。”那么，河南省教育厅的相关规定是否与国家政策相悖呢？对此，相关工作人员表示：因为当时这个文件是卫生厅牵头，教育厅配合发的。艾滋病防控的任务，主要是省卫生厅和艾防办他们在做。我们教育系统的主要工作是配合做好健康教育。教育部门主要是在健康教育的过程当中把艾滋病的防治知识纳入我们的知识传播体系。

关于如何保护艾滋病病毒感染者，尤其是刚入大学校门的年轻人，如何保障他们的隐私，让他们在此后的读书、就业等不受歧视呢？河南省卫生厅艾防办工作人员表示，信息是保密的。
工作人员：隐私这个国家法律规定的很详细，发现阳性了以后，会有专业的技术人员告知他，再做进一步的检测。这个所有的感染者个人隐私只是掌握在跟这个工作相关的人手中，其他的人是不知道的，不会被侵犯。而且这个信息是保密的，只有特定人才知道，包括他无关的亲属都不会知道。
对此，中国疾病预防控制中心性病艾滋病预防控制中心主任吴尊友认为：这个举措和国家政策并不违背。艾滋病检测是全球防止艾滋病的一种策略，在不少国家的医疗服务中会作为常规检测。吴尊友强调，这项措施一定要注意保护艾滋病感染者的隐私，另外，校方绝对不能对感染者作出开除和退学的处理。
吴尊友：第一是隐私的保护，因为如果隐私保护不好，就会对感染者造成很大的伤害。第二发现感染者要如何处理，不能作为开除和退学的条件。因为在《条例》当中也规定了保护这些人的这些上学、就业等基本的权利。
