“相对而言，前些年谈论较多的59岁现象，近来回落明显。值得警惕的一个现象是，年轻干部贪腐正在迅猛增长，去年我们查办35岁以下年轻干部达291人，同比上升167%……”面对台下近千名在杭省属单位副厅以上领导干部，省检察院检察长陈云龙娓娓道来。
昨天下午，首场领导干部预防职务犯罪宣讲会在杭州举行，由此拉开全省“百场领导干部预防职务犯罪宣讲”活动的序幕。

5年来38名厅级干部落马
2009年至2013年立案侦查贪污贿赂、渎职侵权等职务犯罪案件6681件8311人，其中县处级以上干部769人，厅级干部38人，涉案金额高达62.5亿元。平均下来，每年我省要查处1700人左右。
从查处情况分析主要有以下特点：犯罪的罪名比较集中，受贿罪、行贿罪和滥用职权罪等三个罪名要占七成；犯罪的年龄主要集中在36到50岁之间；犯罪的领域、环节主要集中在工程建设、商业贿赂、涉农等权力、利益集中的领域；犯罪的手法日趋隐蔽。
陈云龙表示，当前还出现了年轻干部贪腐案件迅速增长等新情况，2013年检察机关查办35岁以下年轻干部达291人，同比上升167%。36-50岁占到总数的62.6%。相对而言，前些年谈论较多的59岁现象，近来回落明显，去年56-60岁之间只有64人，占比仅为4.8%。
“如何预防年轻干部职务犯罪是目前面临的新课题。”陈云龙说，35岁以下年轻干部多为高学历、高智商人群，他们普遍思维活跃，敢想敢干，是机关企事业单位的业务骨干，有些已经成为中层干部乃至单位领导。但他们工作时间不长，一些人法律意识淡薄，同时又笃信所谓的“潜规则”，胆子大，对外界的诱惑抵御力差，职务犯罪风险较高。
过半厅级干部受贿案涉及低价购房或高价售房
总结近年来检察机关办案情况，陈云龙说，一些领导干部对职务犯罪认识不够、存在偏差，某种程度上也导致了职务犯罪的发生。他在宣讲中对比较常见的几大认识误区进行了澄清：如将低价购房、高价售房误以为是商业折扣；如将高投资收益、高利放贷误以为是投资手段；如将节假日的礼金礼卡误以为是人情往来；如认为只要在收受财物后退还或上交就不算受贿；如将集体腐败误以为是行业“潜规则”，等等。
实践中，房地产商、开发商会根据市场行情、客户性质的不同采取各种折扣方式，这种折扣也会因为对象权力的大小、关系的亲疏而有所差别。因此，不少干部认为打折是属于正常的市场交易，不属于受贿。这类认识误区在被查处的厅级干部职务犯罪案件中比较突出，省检察院曾做了一个初略估计，一半以上的厅级干部受贿案件都涉及到了低价购房或高价售房。
2007年最高人民法院、最高人民检察院曾下发了《关于办理受贿刑事案件适用法律若干问题的意见》(简称两高意见)对此进行了明确，以明显低于市场价格购买、以明显高于市场价格出手房屋、汽车等物品的，都应当以受贿论处。
勿将集体腐败当作行业“潜规则”
近年来，“潜规则”在一些单位、部门大行其道，出现了上行下效的“从众式”腐败现象，也称集体腐败，简单地说，就是一把手或者主要负责人自身不正，带动着整个单位乃至整个系统的风气不正。
如2011年检察机关在全省运管系统查办窝串案，围绕审批流程，形成了道路运输管理系统的“潜规则”，他们把运输企业逢年过节的“孝敬礼卡”当成正常灰色收入，并主观地认为，这是“潜规则”，见者有份，法不责众。
再比如，2012年在某地港航系统查办窝串案，该地港航系统也有一套“潜规则”，港航执法人员与社会人员(黄牛)合作，向船户收取保护费。黄牛定期向港航系统的一线执法人员行贿，就好像发工资福利一样，其胆大妄为令人瞠目结舌。
陈云龙表示，把集体腐败误认为行业“潜规则”是非常错误的，检察机关将重点打击各种腐败“潜规则”，为党委政府公信力建设保驾护航。
