一个人的“假政府”
一起简单的养猪场土地纠纷，最后竟引发一件令人啼笑皆非的荒唐事。其反映出的基层维权困境，令人深思

只要到过河南省邓州市蒋庄村的人，就会打消对这里竟然会出现一个“山寨人民政府”的疑惑。尽管这个假政府是由一个仅小学毕业的农村家庭主妇成立的。
它不只像模像样地生存了一年多时间，还对外发布红头文件，并且公开面向社会招聘公务员。
“海新是我们的领头人。”5月初的一个中午，大雨如注，蒋庄村七八个妇女围坐在一起，还有些无法接受张海新已被刑拘这件事。后者即假邓州市人民政府的发起人。
这里距离邓州市20公里，全村几千人口，多半外出打工，承担绝大部分村中劳动的，都是留守妇女，伺养牲畜、照顾老小、种地……她们多没上过几年学，最远也只去过邓州市，遇事没什么主意，许多道理心里明白，但要说出来，只会翻来覆去重复同样的话。
能言善辩的张海新很难不脱颖而出。
5年前，因为一起微小的土地维权事件，张海新一步步成为蒋庄村的维权领袖，因此，当她拿着一个金灿灿的公章通知大家“这是上面给我们的”，村民们对她“集体拥护”，并把她看成“大英雄”。
谁也没想到，张海新最终会因涉嫌伪造国家机关公文罪被拘捕。
从“张拍子”到“维权代表”
矮矮的，胖胖的，黑黑的，“一看就是农民”。村民们只能大致描述出46岁的张海新的样子。但他们对她说话的样子印象深刻：大嗓门、洪亮、令人振奋，夹杂着些脏字儿，相当“泼辣”“不好惹”。
和村里大多数妇女一样，张海新的丈夫多年前就外出打工了，在深圳卖海鲜，一年回来两次。她带着三个儿女在家种地、养鸡。不过地不好种，鸡也没养活，张海新后来便在村路边开饭馆，卖些胡辣汤、烩面、窝子面等当地小吃。
村里人都说她做饭好吃，人也热情。她常把自家果树结的果子分给邻居吃，还喜欢聊天，常常因为聊天忘了回家做饭。村里人因此都叫她“张拍子”——当地话，“拍话”即聊天的意思。更多村民喜欢张海新，是觉得她“敢顶撞权贵”“敢反抗”。
当时，乡里村里干部常到张海新的饭馆吃饭，不付钱常“打白条”，几年下来欠了五六千块钱的饭钱。张海新去讨债，讨不来，又去村里告状，时任村支书吴振德回复：她有仨孩子，没交超生罚款，欠的饭钱就算抵消计生罚款。
自此，张海新和村委会结下梁子，村里修路路过她家门口，她拦着工人不许动工，要求“先还饭钱再修路”。村民们也不觉得“张拍子”的个人行为阻碍了村子的发展，反而认为这是“有勇气有正气”。
直到2007年，张海新的二女儿吴甜去邓州市区上学，张海新关了饭馆，搬家到了邓州市里陪女儿，才算告一段落。
再和蒋庄村扯上关系，已是三年后。2009年4月，村里原来养猪用的8亩土地，被五组一吴姓村民拿来建房子。关于这块地的归属，三方一直争执不下，六组认为一直是本组的集体土地，只是借给村里养猪；村委则声称在这块地一直是村集体土地，现在给五组村民吴家建房；吴家则声明是村委欠债用这块地抵债。
吴家挖地基开工那天，两组人各执一辞互骂，一边是吴家请的建筑工人，一边是清一色的“娘子军”。
娘子军自知真打起来不是对手，“得找个人带咱们告状去”。这个带头告状的人选很快锁定在张海新身上，大家觉得她年轻、有文化、敢反抗，还住在城里面。
张海新果然点头同意。告状第一天，张海新找来两辆卡车，载上几十名村妇，声势浩荡地去了乡政府。对方回复，“给解决，回去等吧”。
但解决没有等到。村民们再去告状，就被拒之门外了。最初张罗告状的人渐渐泄了气，张海新却没放弃：“去邓州！去南阳，郑州！不行就去北京！”
“漂亮极了，像是毛主席像章”
18岁的吴甜觉得，自从母亲“被拉上这条船”，家里就全变了。
初到邓州时，张海新带着三个孩子住在邓州市政府旁边一条胡同里，屋子虽然简陋，但还算整齐。张海新在胡同口支摊卖水果，生意还不赖。
就在张海新准备再开个干果铺子时，村里人来求助了，刚刚做好干果铺招牌，从没挂起来过，就被搁在了墙边。
自那以后，张海新就“变了一个人”：不再收拾屋子，不做家务，甚至连最拿手的饭菜都做得没了味。这间原本还算整洁的小屋，如今四处狼藉，隐隐散发着臭味。
张海新似乎找到了某种使命感。她成了蒋庄村的大家长，不仅是养猪场的土地纠纷，村民们找她的任何事，她都有求必应。在外打工的村民被拖欠工资，她帮忙写材料；村里的孩子上学请她收留看管，她也一口答应，这间简陋的小屋里，最多一次挤了8个人——对维权事业的关心最终战胜了对儿女的关心。本来是为了让吴甜在城里上学才举家搬到市区，如今，为了照顾8岁的弟弟，吴甜不得不辍学了。
有几次，张海新跟女儿抱怨，帮忙写过材料或者照顾孩子的村民，竟然在街上碰到她也不打招呼。“太没人情味了，以后不帮了。”张海新生气地说。可是，话说过了，气也就消了。
张海新买来《公共基础知识》，从头学习“如何上访”。从2009年4月到2012年10月，3年里，张海新带着蒋庄村六组的村民反反复复去南阳、郑州甚至北京上访，不只如此，差旅、食宿，全都是张海新负担，村民们渐渐退出后，上访就成了张海新一个人的事。张海新用光了丈夫打工的钱，还欠了十几万元的饥荒(欠债)。
吴甜说不清楚，这究竟是热心，还是逞强。但张海新的鞠躬尽瘁，换来了村民们的无限信任。“她特别无私，不可能骗我们。她是我们村的英雄！”村妇们说。
三年多上访维权，张海新每周至少有3天在外奔波，余下的日子就窝在家里看书、写材料。但养猪场的事情始终毫无进展。
张海新也并非毫无成果。那8亩地始终没有开工建房，村民们将此看作张海新的功劳。张海新也叮嘱村民，“不要跟他们硬碰硬，如果他们开工，立即告诉我，我去告状！”此外，原村支书吴振德曾被“查账”、被“给予党内警告处分”，村民们认为也是张海新维权的胜利。
但在吴甜看来，张海新投入如此多的时间、精力和金钱，换来这种分庭抗礼的局面，实在算不得成功。在女儿的眼里，母亲的维权事业实在看不到尽头。
直到有一天，张海新带回来一个“章子”。
2012年10月，张海新从北京回来，兴奋地拿出一个章对儿女炫耀。“上面给了公章！”张海新笑得合不拢嘴，“这是上面对我的信任！”
谁也没有追问“上面”具体是指哪里。他们对张海新拿回来那个金色的公章充满敬畏——水杯口大小，金灿灿的，“漂亮极了，像是毛主席像章”。
没人注意到，章上面刻的内容有些令人费解：中华人民共和国蒋集体经济组织。村民们只顾着高兴：“有了个这个章，我们就能合法地使用土地了。”1
“我都不知道那些人为什么相信她”
张海新的代理律师高承才告诉《中国新闻周刊》，张海新自述：在北京维权时，被国土资源部的工作人员告知，如想拿到土地确权，需当地村、乡、县的各级政府盖章审批。张海新说，政府盖章审批拿不到，但组里人都推选她做村组长。不知是应付还是调侃，对方说：既然推选你做组长了，你怎么不刻个章？
张海新听后，认为自己当村组长就此得到了“领导”认可，出了国土资源部信访办的大门，就在北京监察部门口的地摊上刻了个章。她丝毫没觉得任何不妥，这个刻章的也是在北京部委门口呢。
刻章人疏漏了一个“庄”字，这个章于是变成了不伦不类的“中华人民共和国蒋集体经济组织”。但这丝毫没影响它的功效。
张海新带着这个金色大章回到蒋庄村，告诉当年委托她帮忙维权的乡亲们：要按这个章所赋予的权力，成立由五人组成的集体经济组织委员会，之后“递上去给组织审批”，以后村里土地的事儿，就由这五个人一起商量解决。
村民们兴奋极了：“咱的地能回来了。”
五个委员很快被七八个经常聚在一起维权的农妇选出来了：张海新本人，识字又能说的刘金兰，一个高中文凭的年轻村民，德高望重的老组长，以及张海新的大儿子吴洋——因为在张海新身边，能帮上很多忙，比如“用电脑打字的时候，能给些指导”。吴洋这样对《中国新闻周刊》解释村民们选他的原因。
为了“方便工作”，张海新又照着政府各机构的设置，去刻了各级机关的红色公章，包括一枚邓州市人民政府印。
蒋庄村六组200多个村民，都认可张海新组建的这个新的委员会。除了老支书吴振德。
可他不承认也没办法。不用交接，新的委员会很快就开始了工作。第一项工作，就是由五名委员集体商议后，给占领养猪场土地建房的五组村民吴家庆家传达了“停建通知”。
《责令停止违法行为通知书》由张海新拟写：××户属非法占用集体的耕地无证建筑，你户的行为违反了《农村土地承包法》的相关规定。根据《中华人民共和国土地管理法》的相关规定，现责令你户立即停止上述违法行为，听候处理。
通知书下附：邓州市人民政府印、文渠乡人民政府印、邓州市人民检察院、张海新印以及刻有五人名字的集体印章。
“停建通知”很快又发给了其他有违章建筑的村民。有人收到通知后，拎着水果去张海新家解释：不盖房娶不了新媳妇啊。张海新温柔又坚决：娶媳妇也不能建违章建筑。再等等，我给大家办合法的建筑证。水果拿回去！
村里人开始按照张海新的指示，挨家挨户上交家庭信息，填写《邓州市村镇规划区居民建房申请表》，申请“办证盖房子”。
张海新购置了办公桌、办公椅、传真机，本来就不大的家里，挤得满满当当。为了保留证据，她还专门买了台数码相机，专拍看到的违章建筑。各种书籍迅速摆满了家里的各个角落：《户口、人口与计划生育》《一本书读懂土地法》《最新土地法律政策》，甚至还有《领导不可不读的精彩演讲》……
就在邓州市政府一墙之隔的小胡同里，张海新一个人的“政府”似乎正越来越完善，而张海新本人，也越来越像“公仆”。
每天早上7点送小儿子上学后，张海新便一直整理材料、看书，或是去政府部门上访，直到晚饭后才稍微靠在床上眯一会儿，半夜十二点再起来继续“工作”。她因此得了颈椎病，需要吃药，还常找中医按摩。
一次，张海新在推拿时听按摩师闲聊，说某个村民家有冤案，她一下子来了精神：“谁家？告诉我。我帮忙解决。”
陪在一旁的吴甜连气带拦，“你可别再揽事儿了。”吴甜觉得，张海新一天从早忙到晚，最后也没办成什么事儿，但是就是有人不断来找她。“我都不知道那些人为什么相信她。”
“为什么不信”
“张海新有章能办事”。
她在附近维权圈子里出了名。还被添油加醋了诸多杜撰成分：张海新打赢过官司；张海新以前是教师，现在是中央派下来的领导。
无从得知张海新本人是否对这些传闻辟过谣。总之，她成了名人。人们也愿意相信她。
38岁的小学毕业生王良双就是追随者之一。他是高集乡李岗村村民，在土地纠纷维权过程中成了村维权代表，偶然听说“邓州县城有个人能办事”，四处打听，找到了张海新。
另一个是汲滩镇廖寨村村民马香兰。廖寨村村民描述的马香兰瘦瘦高高，看起来弱不禁风，但为人处事和张海新有些类似，“刚正”“敢反抗”。
2012年2月，廖寨村启动镇中村改造的“廖寨明盛社区”项目，许多农户房子被强拆，甚至有人在讨要说法无果后，喝农药自杀。村民们自发维权，推选了“敢举着药瓶子跟开发商对抗”的马香兰为代表。
村民最初在当地反复告状，毫无进展。突然有一天，马香兰领来了张海新，说她“在上面有人”，之后便组织起8个村民代表，去北京告状。
廖春洲也是廖寨村维权代表。他记得第一次见张海新2013年初，张海新穿了一件黑呢子大衣，“一看就是农民，完全不像领导”。廖春洲自我安慰，“也许高级干部都朴素”。
但张海新一说话，廖春洲的顾虑全打消了，“柔和，就是领导语气”。张海新只简单说了一句，“既然到了北京，咱就要把赔偿拿到手。”廖春洲觉得如沐春风。
廖春洲忍不住问：“你们大领导不都有贴身保镖什么的吗？”
张海新笑而不语，旁边有人抢话说：“秘密的，这都是上面不愿意公开的关系，就像是电视里演的中情局！”
廖春洲追问：“那你的领导是谁啊？”张海新简短地回答：“领导？我就是啊！”
那次北京上访并不顺利。眼看就要过年了，村民耗不下去了，无功而返。
可又过了几个月，马香兰带话回廖寨村，张海新要给大家办《农村土地承包经营权证书》，“有了这个证，咱们的房子就合法了，开发商的赔偿就要按照法律程序走，不然的话，他们想给多少就给多少，不会跟我们谈判的。”
村民们似懂非懂，不知该不该办。但他们最终被打动了：“就收5块钱工本费，证办下来才收！”
“为什么不信！”廖寨村村民至今仍觉得马香兰和张海新不会骗人，“他们站在老百姓这一头，不收钱就给老百姓办事，他们也没骗我们什么啊！”
在为维权奔走多年的农民眼里，许多事情都是“张海新是上面派来的人”的佐证：张海新输入自己的身份证号码，可以进入中纪委的内部举报邮箱；每次张海新帮忙递交举报材料，检察院都客气地接收；当然，还有那个“金灿灿”的大印章。
很快，廖寨村和李岗村如法炮制，在当地“选举”出五个人的“集体经济组织”。张海新任命马香兰为汲滩镇“负责人”，王良双为高集乡“负责人”，她本人则为邓州市兼任文渠乡“负责人”。所有这些集体经济组织的唯一工作，就是帮助各村进行土地维权。
因为给廖寨村改造项目的开发商下达“停建通知”，马香兰被开发商举报。警察带走马香兰三天后，张海新和王良双正在家里商量如何营救马香兰，警察就冲了进来。被带走的，还有整屋子的材料，“整整装满了两个面包车的后备箱。”吴甜说。
三个村“负责人”各自领导的维权进程因此停滞了。房子被扒，土地上盖上新房，村民们只敢偷偷在一旁观望。不过，导致这起荒唐事的养猪场土地，倒是一直未再开工建设。
听说张海新被抓捕，村民们坚持认为：海新是帮共产党维权啊，根本不是和政府作对，只要把情况跟“上面”汇报清楚，很快就会被放出来。
但是，怎么让“上面”知道这些情况呢？
“去北京！”64岁的刘金兰说。商量解救张海新的人中，她最有主见，文化水平最高——小学毕业。“只有‘上面’的人能解决。”她坚持。
“上面”究竟是哪里？众说纷纭：中纪委、邓小平、胡锦涛、国土部、检察院、法院、联合国……
这个提议最终却没有获得拥护，因为在座的人“不认识路”，“七八十岁了”，“有冠心病”，“谁都没有个手机”……大家开始念叨“海新在就好了”“海新一定很快就能出来”。
晌午到了，人群便在大雨中散了。
