耒阳警方和同行民警数次提醒抓错人均未引起重视
11月24日，湖南耒阳西站派出所将“刘丽”抓获并电话通知了案件主办人张军治。
“耒阳警方在电话中告知张军治犯罪嫌疑人一直声称自己没去过青海，可能抓错人了。”检方称，张军治并没有及时将这一情况告知所领导，只是以刘丽被抓获为由，与另外2名民警赶到湖南执行押解任务。
据介绍，耒阳看守所管教人员在接交手续期间，反复询问张军治当初抓捕的疑犯是不是眼前这个人，甚至连同行的民警也向张军治提出了疑问，并建议张军治向上级领导汇报核实清楚。
“耒阳警方并未按规定让张军治在看守所提审刘丽，张军治也没有因此找看守所领导交涉，而是直接将人带走。”办案人称，如果当时发现抓错了，就该立刻放人。
在衡阳火车站，刘丽的丈夫谢齐富向张军治提出做指纹照片比对要求，但这些提醒和建议均没有引起张军治的重视。
“12月6日押解刘丽返程到西安后，张军治才向主管所长打电话告知有可能抓错人了。12月9日，才发现确实抓错人了。”办案人员称。
抵达湖南后先旅游后提人
根据检方调查，张军治一行3人于11月28号抵达湖南后，并未及时到耒阳提人，而是先去旅游。

据了解，“跨省抓错人”事件发生后，青海省检察院将其列为督办案件，西宁市检察院指定由湟源县检察院办理此案。
受理此案后，湟源县检察院即派人前往湖南浏阳、耒阳等地进行了大量而细致的调查取证工作，并走访了与此案有关的人员以及单位，最终认为张军治的行为涉嫌玩忽职守，遂于4月2日立案侦查。日前此案已侦查终结，并于5月13日依法向法院提起了公诉。
