“普通消费者维权积极性不高。”于素娟称,消费者对《消费者权益保护法》和《食品安全法》了解不够多,很多时候不懂得通过法律手段维护自己的合法权益。此外,普通消费者由于在消费时缺乏法律意识,往往取证意识不足,导致在消费者维权诉讼中举证困难。

对于职业打假人能否是《消费者权益保护法》中的消费者,法官称,这在理论界是存在争议的,只要购买商品,不是为了再出手从事交易活动的认为是生活消费,不能从数量和次数来判断是否是生活消费,“职业打假是主观上的判断,除非购买人自认,在实践审判中很难认定是否是职业打假人或知假买假,因此在司法实践中职业打假人被认为是一般消费者”。

法官提示消费者,应妥善保管购买凭证,消费者维权案件中消费者的举证责任主要是与经营者之间存在买卖合同关系。消费者在购物时,经营者通常向其出具购物小票、销售凭证或者发票,消费者持有上述购物凭证即可初步证明其与经营者之间存在买卖合同关系。
