武威市凉州区公安局行政处罚决定书显示，凉州区公安局刑警队1月7日下午以涉嫌嫖娼拘留张永生，并处以行政拘留5天的治安处罚。后凉州区公安局拘留通知书和逮捕通知书又显示，张永生因涉嫌敲诈勒索刑事拘留，后于1月25日被批准逮捕。张永生被抓的原因究竟是哪一个，引发质疑。
2月6日，甘肃省检察院官方微博发布对“张永生涉嫌敲诈勒索案”核查情况的通报，称凉州区公安局民警在对张永生涉嫌嫖娼留置盘问过程中，发现张永生系1月4日武威市公安局批转的举报信中的被举报人，遂就举报信反映的敲诈勒索问题同步进行盘问。
1月8日，凉州区公安局以涉嫌敲诈勒索罪对张永生立案侦查，并于1月18日提请批准逮捕。1月25日，凉州区检察院决定对张永生批准逮捕。
关于张永生涉嫌嫖娼问题。经核查证实，1月7日16时许，张永生独自进入西津洗浴广场，在307包房内接受了异性李某某提供的服务。核查工作组认为，凉州区公安局以张永生有嫖娼违法行为进行行政处罚，事实不清，证据不足。已建议甘肃省公安厅调查处理。

敲诈勒索5000元如何认定?
据甘肃省检察院通报，经核查证实，2009年3月以来，张永生利用其《兰州晨报》记者身份，以报道负面新闻对多个单位和个人进行要挟，其中敲诈勒索人民币5000元的犯罪事实清楚，证据充分，张永生供认不讳，并有证人证言及同步录音录像资料相互印证。
根据目前查证的事实，省检察院核查工作组认为，张永生虽然涉嫌敲诈勒索犯罪，但鉴于涉案金额不大、本人认罪悔罪态度较好，已建议公安机关变更强制措施，对张永生取保候审。
但也有媒体张永生6年涉嫌敲诈勒索数额仅为5000元提出疑问。
检察长回应
路志强说，张永生目前共有核查到4起涉嫌敲诈勒索事实，这4起都有人证、物证及其本人供述，事实清楚，证据确凿。张永生涉嫌敲诈勒索4起事实不只是针对政府，所认定的共计5000元的涉案款也全是现金。
路志强说，这4起涉嫌敲诈勒索的事实时间跨度从2009年到案发的2016年1月7日。这些事实有群众举报，也有他自己交代的，其中涉嫌的案情不止这4起。检察机关觉得这4起证据确凿可以公布，其它尚需进一步查证的，没有对外公布。目前对张永生案仍在进一步调查中。
路志强说，对于张永生7年涉嫌强诈勒索5000元是不是少了的问题，社会应该有个正确认识，“现在都要依法办事，根据最高法和最高检关于敲诈勒索的有关法律依据，敲诈2000元到5000元就属于数额较大。利用或冒充国家工作人员、军人、新闻工作人员(身份)的，数额减半。因此，(涉嫌敲诈勒索)1000元就够立案标准。”

张永生是否受到疲劳审讯?
此外有媒体报道称，张永生在被抓前曾向同时称自己因报道当地负面新闻受到威胁，还发生过被要求调走等情况。且在关押期间曾被疲劳提审。
检察长回应
路志强说，张永生案当地仍在继续侦查，检察机关也督促武威凉州公安分局抓紧办理。对于有关媒体报道张永生被疲劳审讯的问题，路志强说，张永生本人没有反应，他们也没有接到这方面的反映。
“一定要相信我们检察机关的结论，是比较客观的。我们核查时从省院和兰州市检抽了35名检察官，不允许武威任何人员和调查组接触，并让人大代表参与。我们就是要对事实负责”，路志强说。
