新京报快讯 （记者涂重航）今天上午，全国人大甘肃代表团举行全体会。会后，全国人大代表、甘肃省检察院检察长路志强接受新京报（微信公号ID：bjnews_xjb）专访，回应“武威警方1月7日抓获《兰州晨报》记者张永生”一事，详解检方调查组的调查经过和调查结论。
已核查到张永生涉嫌4起敲诈勒索
路志强说，武威警方控制记者张永生一事发生后，社会舆论广泛关切，为此从省检察院和兰州市检察院共抽调35名调查人员组成调查组，并邀请2名全国人大代表及律师身份的特约检察员和记者身份的人民监督员各1名参与，最终形成调查结论。
路志强说，张永生目前共有核查证实4起涉嫌敲诈勒索事实，这4起都有证人证言及同步录音录像相互印证，本人也供认不讳，事实清楚，证据确凿。张永生涉嫌敲诈勒索4起事实不只是针对政府部门，所认定的共计5000元的涉案款也全是现金。
路志强说，这4起涉嫌敲诈勒索的事实时间跨度从2009年到2015年。这些事实有群众举报，也有他自己交代的，其中涉嫌的案情不止这4起。检察机关觉得这4起证据确凿可以公布，其它尚需进一步查证的，没有对外公布。目前对张永生案仍在进一步调查中。
涉嫌嫖娼事实不清，张永生已领取国家赔偿1098元
路志强表示，张永生最开始以涉嫌嫖娼被抓，省检调查中也已对此作出结论：张永生涉嫌嫖娼事实不清。目前，公安机关已经对当事责任民警予以处理，其中对参与抓捕的民警停止执行职务。
有媒体称张永生在采访途中被抓不是事实。路志强说，调查组调取了录像和证人材料，看了洗浴中心的录像，张永生确实是1月7日在洗浴中心被抓。
武威当地公安机关已作出国家赔偿，赔偿1098元，张永生在取保候审后不久就已经领取。
对于当时“共有三名记者被警方控制，社会舆论认为当地是有所准备对付记者”的说法，路志强说，通过核查了解到，武威市在春节前对涉黄赌毒的场所进行集中整顿是例行的、正常的执法活动。基层民警可以跨警种执法，因此当时抓张永生的是当地刑警。对于另外两名记者被抓的情况，路志强说，那两名记者在公安机关调查后就被释放，未被批捕，因此他们也未做重点核查。
检察机关督促警方抓紧办案
路志强说，张永生案当地仍在继续侦查，检察机关也督促武威凉州公安分局抓紧办理。
对于有关媒体报道张永生被疲劳审讯的问题，路志强说，张永生本人没有反映，核查中也没有发现相关的事实和证据。
“检察机关的核查结论是比较客观的，我们核查时从省院和兰州市检抽了35名检察官，不允许武威任何人员和调查组接触，并让人大代表参与。我们就是要对事实负责。”
路志强说，对于张永生6年涉嫌敲诈勒索5000元是不是少了的问题，社会应该有个正确认识，“现在都要依法办事，根据最高法和最高检关于敲诈勒索的有关法律依据，敲诈2000元到5000元就属于数额较大。利用或冒充国家工作人员、军人、新闻工作人员（身份）的，数额减半。因此，张永生涉嫌敲诈勒索已够立案标准。”
