1月29日，格力电器宣布，为维护名誉，已在总部所在地珠海香洲区法院起诉美的工程师李猛。不久之后，美的也宣布，在佛山市顺德区法院对格力举报人陈进提起诉讼。陈进接受《中国经济周刊》记者采访称，美的此举是对格力进行报复。
“美的在我们获奖5年以后再来告我们造假，那之前干吗去了？”他说，相反，“我们在国家奖励办没颁奖之前就告他们了。”
按陈进的说法，格力电器早于2014年便先后两次写信向国家奖励办举报美的造假，但一直未有结果。2015年，作为标准技术研究的科技人员，陈进开始以个人名义再度举报，然而仍然未有处理结果。“无奈之下，为了捍卫科技的严肃性，呼吁更多的技术专家关注此事，我才通过微博实名公开举报了美的。”陈进说。
据悉，美的获奖的空调节能关键技术研发及产业化成果，正是支撑美的空调“一晚1度电”（后改为“一晚低至1度电”）节能效果的核心支撑技术。
格力电器方面曾多次在公开场合抨击美的空调“‘一晚1度电’是欺骗消费者”。《中国经济周刊》记者获悉，这也是格力方面投诉美的的主要依据之一。
之前，也曾有媒体报道称，有购买美的“一晚1度电”空调的消费者以美的空调广告涉嫌虚假宣传欺诈消费者为由向北京市工商局投诉举报，同时起诉到法院要求美的赔偿。后经法院审理认定，“一晚1度电”广告属于虚假宣传，构成欺诈，判令支付原告空调价款一倍的赔偿金3459元。北京市工商局也认定“一晚1度电”广告构成虚假宣传，罚款10000元。
格力电器方面表示，格力投诉美的不是随意性的，而是请了专家做评估后才进行了投诉。
针对格力的举报，《中国经济周刊》记者联系美的采访，美的方面发来统一回应声明，称美的严格遵循评奖程序申报和评选。“2014年12月，该项目先后两次被投诉，美的空调均组织材料回复，并由推荐机构组织专家论证后上报评奖机构。最终，评奖机构综合评估后于2015年1月8日国家科技奖励大会上正式颁奖给美的空调。”
美的方面表示：在科技奖项举报的最终结论之前，不再就此系列事件接受媒体采访。
美的究竟有没有造假，最终需由国家奖励办来认定。
《中国经济周刊》记者试图联系国家奖励办进行采访，但该办相关负责人以未经科技部同意为由拒绝采访。《中国经济周刊》记者给科技部发去采访函，但截至发稿前未获回复。
近日，格力电器副总裁望靖东接受《中国经济周刊》采访强调，他们此举的目的是希望能够维护国家奖励项目的权威性和公信力，捍卫中国科技的尊严。
不过，对于此事件，更多的人还是将其看做两家企业为争夺市场而进行的又一次口水战。
望靖东表示，“很多人都误解了格力，我们会坚持原则，绝不妥协。格力不惧怕威胁。”

《中国经济周刊》：格力是从什么时候开始对美的进行投诉的？相关方面有没有给予回复？
望靖东：2014年11月在国家科学技术奖励工作办公室（下称“国家奖励办”）还没给美的颁奖的时候，我们就以公司的名义写投诉信给国家奖励办举报美的造假，连续写了两封投诉信给国家奖励办。国家奖励办当时说，先给美的颁奖，等查实了以后一样可以取消。但之后不明白为什么一直拖着，我们一直派人到国家奖励办去追问。在这期间，有人通过关系找到我们，让我们放他们一马。但科技本身是非常严谨的，只有对与错而没有情面之说，怎么可能放他们一马呢？后来，我们的技术人员实在看不下去就以个人名义也举报到国家奖励办去了。国家奖励办说，这个事情电器行业已经举报过了，他们会一并处理，但至今没给我们明确的回答。这迫使我们的人在微博上公布这个事情，让社会来评论。
《中国经济周刊》：为什么在2014年国家科技奖评选的公示期间不举报，而在之后举报？
望靖东：第一次举报是在2014年12月18日，那时尽管已经过了公示期，但还没有颁奖。我们除了自己申报项目外，并不总是时时刻刻关注别人申报的信息。等我们真正发现项目存在问题的时候，已经过了项目公示期。但看到国家奖励办主任邹大挺曾表示要“对学术造假无限期追究”时，我们才决定举报。
《中国经济周刊》：格力举报美的造假有相关依据吗？
望靖东：我们关注美的这个项目，主要是从新闻媒体的报道中了解到他们因“一晚1度电”涉嫌虚假宣传而遭到消费者举报、投诉，甚至被诉至法院败诉。基于这些信息，我们才意识到其申报“国奖”的这项所谓的创新技术可能涉嫌造假，这才开始对此进行研究。
通过研究项目公示信息，结合国家相关标准法规，将其与国家产品能效信息进行对比后得出造假结论。我们发现，这个申报项目存在执行标准不合法、技术效果虚假等严重问题。
《中国经济周刊》：是否造假应该由谁来认定？
望靖东：我们出于行业的责任感针对国家科技奖励项目提出异议，最终是否造假需要国家奖励办来认定。
《中国经济周刊》：你对最后的结果怎么看？
望靖东：最后是否会撤销这个奖，就要看国家奖励办对该项目的评定了。我们相信国家奖励办会给出一个科学的结论。
造假最大的问题是给市场带来了破坏性
《中国经济周刊》：你怎么看美的对格力的举报？
望靖东：这个举报是无稽之谈。从2011年格力获奖到现在已经整整5年了，没有任何企业投诉我们的技术。
我们投诉美的技术造假的事情在社会上影响很大，美的反过来就举报说我们5年前造假。这个举动让我觉得可笑。我们在国家奖励办没颁奖之前就告他们了，而美的在我们获奖5年以后再来告我们造假，那之前干吗去了？既然他现在说我们造假，伤害我们的品牌、信誉、形象，那我们就要到法院去告他，让法院来评判究竟谁在造假。他们没办法应招，就也在当地法院告我们。
《中国经济周刊》：这件事情曝光后社会舆论很关注，有相当一部分人认为，这是格力跟美的在打口水仗。
望靖东：格力人天天研究技术还来不及，哪有时间跟美的去打口水仗。大部分评论是在和稀泥说，现在市场竞争很恶劣，这是两家企业之间在争夺市场。格力从来都不会干这样的事情。
《中国经济周刊》：如果不是出于竞争目的，那么，举报是出于什么样的考虑？
望靖东：出于美的“一晚1度电”技术的不真实。当时已经有消费者到法院打官司告美的这个技术虚假，美的是输了官司，赔了钱的。
中央一直号召企业走创新发展之路，但如果像这样一个伪技术能评奖的话，那对市场是多大的误导？这种评奖是对科学的不尊重。我们不是因为企业之间的竞争，更不是因为市场的压力，我们只是为了捍卫中国科技的严谨，尊重事实很重要。
《中国经济周刊》：科技奖对一个企业意味着什么？
望靖东：奖项对我们这种企业来说是一种认可，一种精神奖励。但恰恰有些企业把这个奖项当作护身符，招摇过市，欺骗、误导消费者。这也会慢慢导致消费者对所有奖项都没有信心。这种造假现象，最大的问题是给市场带来了破坏性。
政府扶持企业应该给市场而不是给钱
《中国经济周刊》：你怎么看当前的企业创新环境？
望靖东：现在中央政府呼吁企业进行技术创新，提出了供给侧改革的要求。而政府也为企业营造了很好的
外部创新环境，出台各种支持政策，例如减免税收、资金补贴等。但我觉得，如果企业本身不诚信，浑水摸鱼，即使外部环境再好，创新也很难做好的。之前已经有无数的弄虚作假的案例提供了例证。本来政府支持企业的愿望很好，部分企业却不择手段地钻政策的空子。
《中国经济周刊》：在你看来，应该如何从制度上避免这些问题的发生？
望靖东：政府对企业的创新，要用市场手段来调节而不是简单的资金支持。比如，根据企业给国家的贡献
如税收、产品技术先进性等，多方面给予合情合理的支持。政府不能简单地用钱来进行支持与奖励。事实证明，一些听都没听过的企业，把政府的钱骗完就不干了。政府应该要给予的是市场，而不是钱。给市场，就等于进入了良性循环，能创造更多的税收。政府老是靠税收来补贴企业，那谁来创造市场呢？
如果我们所有的制度，是让我们的制造业企业能成为自己具有造血功能的企业，而非一味靠政府扶持输血的企业，这才是真正好的制度。不能自己造血的企业，死了也是正常的。
