  握有知名互联网安全品牌“360”的北京奇虎科技有限公司(以下简称奇虎公司),今年2月在北京打响新年商标侵权维权诉讼第一枪。诉讼中,云南 “360贷贷网”因涉嫌“搭便车”“傍名牌”,被奇虎公司告上法庭。云南“360贷贷网”昨日回应称,目前已委托上海的律师准备应诉,公司高层认为,从生 活用品到理财产品,品牌LOGO中含“360”的商家在全国有很多,为此惹来官司,有点委屈。

  LOGO中出现360惹来官司


  今年2月,奇虎公司以商标侵权为由,将北京一家金融信息服务公司和云南“360贷贷网”告上法庭,云南“360贷贷网”为第二被告。


  奇虎公司在诉状中称,该公司2007年8月注册成立,旗下拥有“360安全卫士”、“360杀毒”等7大公众熟知的网络安全产品。经过10年发展,“360”已成无可争议的网络安全第一品牌,用户量超7亿。


  奇虎公司表示,去年11月4日,他们委托代理人,在公证员的监督下,进入云南“360贷贷网”首页,发现首页左上部显著位置显示的“360 贷贷网”LOGO标识图形和“360”均为绿色,使用的广告语为“做最安全的投资平台”。此外,两被告还以“360贷贷网”为微博名称、微信公众号,开展 业务宣传。


  奇虎公司认为,两被告作为涉案网站的实际经营人和受益人,在明知原告及原告涉案商标具有较高知名度及美誉度的情形下,未经许可,在网站突出 位置使用了原告注册商标中的显著识别部分“360”,明显具有“搭便车”“傍名牌”嫌疑。两被告的行为涉嫌商标侵权,故诉请法院判令两被告立即停止商标侵 权,停止使用并注销涉嫌侵权的域名,判赔经济损失等合理开支共计3000万元,诉求在相关知识产权报、相关网站首页连续30日刊登声明,就其侵权行为消除影响。


  目前,该案已由北京知识产权法院受理立案。

  公司已取得部分商标注册证书


  “虽然我们的LOGO与‘奇虎360’的LOGO中,都含有360这个敏感数字,但原告是做计算机安全的,我们是互联网金融服务平台。”面对诉讼,“360贷贷网”副总刘洛辰表示,他们也是通过媒体报道,才知道被奇虎公司告了,目前还未收到法院传票。


  “从‘360牙膏’到‘360互联网金融’,与‘360’这个数字有关联的商家全国有很多。”刘洛辰辩称,尽管他们与奇虎公司在LOGO上 都使用了数字“360”,色彩也是同一色系,但颜色的深浅上有差别。此外,“奇虎360”的LOGO是一个球形,里面包含十字和网址;而他们的LOGO主 体是一朵绿花形状,由数字“360”+“贷贷网”汉字+网址共同构成。“数字‘360’只是LOGO的一部分,两者的辨识度较高,最多只是在听觉上容易产 生惯性思维联想,有可能会混淆视听。”


  刘洛辰现场出示了该公司已取得的部分商标注册证书。据介绍,从2013年5月份开始,该公司就向有关部门申请注册LOGO,“这个LOGO是分开申请的,由于申请的期限比较长,部分LOGO还在申报中。”

  据媒体统计,无论是主动起诉还是被动应诉,自2010年以来,因侵权或不正当竞争,奇虎公司已与国内多家大型互联网企业对簿过公堂。

  昨日,晚报记者试图联系奇虎公司对这起侵权官司做进一步的了解,但拨打该公司多个电话均无人接听。截至发稿时,也未得到该公司任何回应。


  查阅网络获悉,在今年2月经济之声《天下财经》的公开报道中,谈及这起官司,奇虎公司诉讼总监洪成宇曾说,无论是从公司名称还是公司 LOGO上,云南“360贷贷网”都有侵权之嫌。“它在网站上,以及它们公司的经营场所和其他商业活动经营的过程中,都在显著位置突出地使用一个LOGO 叫‘360贷贷网’。这个LOGO的主体部分,也就是它显著性最强的部分,就是绿色的数字‘360’。我们认为,这种行为已非常明显地显示出‘傍名牌’的 故意。”洪成宇说。

  类似的商标侵权诉讼并非个例。为何互联网行业频发商标侵权案?中国政法大学知识产权中心特约研究员赵占领分析说,很多互联网创业者对知识产 权并不是一无所知,实际上更多的情况下,他们对知识产权有所了解,并特意去通过这种方式推广自己的产品和品牌。同时,这些公司也衡量到侵权的成本,因为我 国在知识产权侵权方面的处罚力度还不够。


  赵占领认为,创业企业“傍名牌”的做法短期内有助于实现推广目的,但是难免会诉讼缠身,而且从长期来看,不推广自己具有显著性的标识,山寨他人品牌无法打造自己的独立品牌,事实上还会有负面效果,会导致客户混淆。这种做法不应是一家志在长远发展的创业企业的所为。


  业内人士称,360公司此番发起商标侵权诉讼是其重视品牌建设、提早进行知识产权布局、开展品牌维权的重要举措,今后将有更多知名互联网企业效仿360,走上品牌维权之路,对各类“傍品牌”或“搭便车”现象予以围剿。


  在中国电子商务协会法律工作委员会主任姚克枫看来,一个企业的价值更体现在品牌上,不良企业“傍品牌”会导致品牌权利人的品牌价值减损。保 护知识产权,一方面,需要加大赔偿力度,严厉惩戒不良企业“傍品牌”等不法行为。另一方面,被侵权者应树立品牌维权意识,敢于和勇于维权,拿起法律武器, 尽量提高侵权赔偿数额要求,维护自身的合法权益,并对企图“傍品牌”或“搭便车”的潜在侵权者产生震慑力。
