　　法制晚报讯（记者 温如军）《法制晚报》记者从海南省高级人民法院获悉，该法院已受理陈满国家赔偿申请。陈满的国家赔偿申请书中，列出了包括侵害人身自由、误工费、精神损失赔偿等在内，共计966万余元。

　　两会期间，海南省高级人民法院院长董治良在接受记者采访时表示，对于陈满的案子，他表示“非常痛心”，并要吸取教训。

　　对于是否启动问责机制，董治良表示需要按照程序来。

　　今年全国“两会”，在最高法和最高检的工作报告中，都提到了陈满案。

　　最高法工作报告中说，加强审判监督，各级法院再审改判刑事案件1357件，依法纠正陈夏影绑架案，陈满故意杀人、放火案等一批重大冤错案件。

　　最高检工作报告中说，对检察机关从当事人申诉或办案中发现的“陈满故意杀人放火案”、“钱仁风投放危险物质案”、“许金龙等4人抢劫案”、“杨明故意杀人案”等冤错案件，分别提出抗诉或再审检察建议，人民法院已依法再审改判无罪。

　　申请书中称，陈满在被剥夺人身自由时，就已经开办了一家装修公司并初具起色，其工资水平远远超过普通职工，以2015年最高人民法院公布的职工日平均工资为基数，请求人的误工费按照普通职工年平均工资的2倍计算。

　　同时，陈满还要求海南高院在央视、《人民日报》等媒体公开赔礼道歉，消除影响。申请书中称，1992年发生的杀人焚尸案性质恶劣，造成了全国、尤其是案发地海南省和陈满老家四川省媒体的高度关注，并广泛报道。该案的相关司法人员被高度褒奖；赔偿请求人却背负着故意杀人、放火的恶名被极度贬斥，受世人所唾弃，名誉受到了严重影响。

　　王万琼：说实话，如果完全按照目前国赔法的规定，确实赔不了这么多。不过，对本案成为目前“国赔之最”我还是有信心的。希望通过本案，能让更多的人来关注刑事案件中的国家赔偿，推动其完善和发展。

　　法制晚报：怎么理解您提到的“按照目前国赔法的规定，确实赔不了这么多”？

　　王万琼：目前国赔法的规定还存在许多明显的问题。比如对申诉的实际成本支出完全无视，对误工损失的规定不明确，对蒙冤者出狱后如何融入社会正常的工作和生活没有衔接性的规定。所以，如果只是拘泥于目前存在瑕疵的国赔法的规定，对陈满的赔付就远远不够弥补他及其家庭遭受的实际损害，包括精神和物质两方面。

　　王万琼：事实上我们提起的项目已经完全考虑了目前整个司法的实际情况，这个数目是务实、合理的。
