  许明说,电视安装的这个案例,最终商家赔了消费者200元,但这只是个别维权成功的案例,大部分的案例由于根本无法取证而不能维权。在许明看 来,把个人信息作为消费者的合法权益,纳入到法律里面,这是我们国家司法积极的一面。但是个人信息保护如何落实,当下最困难的就是举证难,因为个人信息在 很多地方被采集过,你自己不知道在哪个地方泄露。所以必须要完善技术手段,不能让保护条款只是“看起来很美”。


  同时,许明提醒消费者要重视对自己个人信息的保护,不能到处填信息。他举例说,小区门口常有一些推销员发两个草鸡蛋,但条件是得在领鸡蛋时填写一下个人信息。“看上去好像自己占了便宜,但其实已经把自己的信息交给了他人。”许明说。

  对于自己网络维权的经验,许明说,最重要的就是搜集证据,商家的承诺文字、商品的照片以及聊天记录都是维权的重要证据,消费者在网购的时候务必要搜集齐备。


  关于消费纠纷


  商家说“有本事去告”,怎么办?


  遭遇到消费纠纷,有些商家会牛气的给你来一句“有本事你去告我呀”,这让消费者很是气愤。商家的这种牛气能不能改?


  卢增宽律师指出,商家之所以这样说,因为在他们看来,消费者去法院打官司就得考虑诉讼成本,因为通常消费行为所涉及到的标的很小,另外在打官司过程中,一些证据的取得仍然是难题,因此商家就希望你“知难而退”。


  在许明看来,今后可以从两个方面入手让商家不再轻易说出这句“口头禅”。一是要简化司法介入消费纠纷的程序,在一些国家书记员、审判长都是一个人,这种小额仲裁的方式,简便快捷高效。第二是让商家的个人征信的污点跟他将来潜在的利益获得关联。
