  自从“饿了么”等网络订餐平台风行以来,其食品安全问题就一直是众所瞩目的焦点,网络订餐食品安全也成了此前上海两会的一个高频词。近日,市食品药品监督管理局就起草的《上海市网络订餐食品安全监督管理办法(征求意见稿)》公开征求意见,截至日期为本月26日。


  市食药监表示,今年将联合工商、电信等部门,鼓励网络订餐平台对接监管大数据,加强对网络订餐的监管和治理。


  外卖网店应证照相符


  去年下半年,本市抽检互联网订餐平台发现,不少平台上有店家涉嫌无证经营或证照信息与实际并不相符,甚至还有假借他人证照实际上并无实体店的案例。


  此次征求意见稿规定,从事网络订餐的餐饮服务经营者应当按照《食品安全法》及食品经营许可有关规定,取得食品经营许可证以及网络经营许可项目。从事网络订餐的餐饮服务经营者实际经营地址、经营项目等应当与其取得的许可证核准的一致。


  从事网络订餐的餐饮服务经营者应当按照在其网站首页或者经营活动主页面醒目位置公示营业执照、食品经营许可证和经营地址。公示的信息应当真实准确,画面清晰,容易辨识。当规定公示的信息发生变化的,餐饮服务经营者应当及时在相关信息的公示网页更新。


  无冷链条件不得送冷菜


  在网络订餐的过程中,送外卖是很重要的一个环节。征求意见稿要求,送餐人员应当按规定取得有效健康证明后上岗工作,一旦出现发热、腹泻、皮肤伤口或感染、鼻咽部炎症等有碍食品安全病症的,不得从事相关送餐活动。


  除了送餐人员的资质和身体状况外,在送餐过程中不具备冷链配送条件的,不应当配送冷菜、生食、冷加工糕点、预拌色拉等需要冷藏保存以保障安全的食品。也就是说,如果“外卖小哥”仅仅是提着饭盒塑料袋上门送饭,那这家店就没有资格送餐醉泥螺、醉虾、醉蟹等腌制生食水产品、生鱼片、拌黄瓜等食品,也不能送奶油糕点、提拉米苏、芝士蛋糕、寿司等糕点。


  对于委托第三方平台或者第三方物流送餐的,网店经营者也应负起责任,对其是否具备上款规定的条件进行检查; 不应当委托不符合条件的第三方平台或者第三方物流送餐。


  另外,意见征求稿鼓励在送餐容器的外包装上标示食品制作烹饪时间和安全食用时限,如10-60℃条件下,烹饪至食用时间应在2小时以内;并鼓励从事网络订餐的餐饮服务经营者在其网站或第三方平台公布厨房照片或者实时视频,即“明厨亮灶”。


  应建店家信用评价体系


  在此前的抽检中,一批网络订餐的第三方平台屡次申辩称证照不全或不符是因核对的工作量太大,整改需要时间。此次意见征求稿再度强调了网络订餐第三方平台的义务。


  第三方平台应当建立入网餐饮服务经营者主体资质审查及其经营活动检查、交易管理规则、食品安全应急处置、投诉举报处理、消费者赔偿等食品安全管理制度,并按照规定在平台上公开这些制度。


  第三方平台应当对申请加入平台的餐饮服务经营者进行资质审查,并及时更新食品经营许可证等资质证明材料。必要时,应到餐饮服务经营者所在地进行现场核实。此外,应当对入网餐饮服务经营者进行实名登记,记录其社会信用代码、食品经营许可证号、许可证有效期、核准名称、地址、经营项目等信息。同时,应当设立专门的管理部门或者指定专门的管理人员,对入网餐饮服务经营者在平台上发布的食品安全信息进行检查,并在开展入网餐饮服务经营者资质现场核实和平台送餐人员到入网餐饮服务经营者取食品时,对其实际加工地点与平台标示的地址是否一致进行核对。


  一旦发现入网餐饮服务经营者存在超范围经营、发布虚假信息等违法行为的,第三方平台应当及时制止并向监管部门报告;发现入网餐饮服务经营者存在无许可证经营、经营禁止生产经营食品、发生食品安全事故等严重违法行为的,应当立即停止提供网络交易平台服务。


  第三方平台还应当建立平台内入网餐饮服务经营者信用评价体系,鼓励将食品药品监督管理部门对入网餐饮服务经营者的监督管理情况作为评价体系的重要内容; 对于存在食品安全违法行为的入网餐饮服务经营者,应采取调整搜索排名、暂时或永久停止提供平台服务等措施。
