老李说，他们的家人对自己的职业起初都有些抵触，“因为怕我们被人报复，但最终也都尊重了我们的选择，因为能够维持生存”。

“我们不喜欢说高尚的话，‘自己是为了净化市场’什么的。但是确实这些过期的产品国家规定不允许销售，但是有些商家可能是因为管理疏忽或者为了蝇头小利，造成了销售行为。我们根据国家规定找到问题，然后获取赔偿，用获赔养家糊口。这并不缺德！”老李说。

行业揭秘：常见组团打假收入平均分配

老李和老张告诉记者，据他们所知，在北京城里，和他们一样的专业打假人能有六七十人，也有人说人数已上千，但他们并不认同。

打假人在超市相遇后，并不过多寒暄，而是各干各的。“我们这行谁也不挡谁的财路，你挣你的钱，我挣我的钱，不会因为我可能和这家超市的人经常索赔认识，就帮助超市砍价什么的。”

现在京城打假圈形式已经多元化。老李介绍，多数打假人都是各自几人为战，打假人很少有一个人干活，多数都结伴，取证索赔时也有个照应，收入基本是平分，除非老人带新人的特殊时期。也有打假人会七八个人一起干，他们往往几人一组，多组散出去同时工作，然后找到问题产品获赔后大家一起分钱，“当然干得好的也会有相应的提成，多拿一些。”

老张说，也有的打假人成立了公司，集体分工，有的人负责出去打假，有的人负责向食药监部门举报，有的人负责向法院起诉，这样有规模的公司并不多。还有一些例如王海等打假成名的人，他们成名之后，成立综合的维权公司，帮助指导别人维权，业务更广。

老李和老张表示，在京城的打假人中，有少数群体会有微信群互相联系，有时候一起聚会喝酒，聊聊新规定、聊聊最近打假遇到了哪些事。“我们并不特意打听别人怎么干活怎么挣钱，有的打假人一次起诉商家售假，能够获赔20多万，这也是特例，如果我们发现了这么多问题产品，我们也会去起诉商家。但更多的时候，我们想的是自己起床了以后，今天要去工作，要去养家糊口，为了生存而打假。”

两人在接受采访时，均表示不会向别人介绍自己是职业打假人，“最起码在现如今的中国，这行业多少还带有一些‘颜色’。”

超市看法：对打假人作假后索赔很挠头

某大型超市相关负责人告诉记者，从他们日常工作接触来看，职业打假人没有一个是奔着公众监督或者说是为了消费者的利益去打假的，都是为了谋取个人私利。

新的相关法规支持“知假买假”，支持数倍赔偿，由此甚至产生了一些不法团体，他们自身造假，将超市购买的商品更换包装、篡改日期，然后再去投诉，而超市方面又很难抓到证据。

该负责人举例称，譬如某日用品厂家对某一款商品促销，做了三联包促销装，为防止收银台扫码错误，多收钱，三联包在工厂包装时就将其中一个产品的条形码反过来然后封口，以便正确扫码结账，可是有职业打假人认为该产品包装是属于“三无”商品，于是分7次购买了相同商品，然后找商家索赔3500元，而且要挟企业不赔钱就向相关部门投诉。

“说实话，对于职业打假人，我们真的没法评价他们。”另一家大型超市相关负责人表示，自去年以来，职业打假人数量突然大量增多，尤其是在北京以外的地区，他们有的甚至将有问题的产品带进超市掉包然后投诉。

“作为零售商家，如果要承诺销售的商品100%没有问题确实很难，出了问题，也要分两个方面看。”一家大型超市负责人表示，如果产品质量出现问题，那么就要溯源追究，是属于零售终端的问题，还是运输或者生产加工过程的问题；如果卖了过期商品，那么超市确实要承担责任，“但是自去年以来，有关食品过期的投诉量完全达到了一个不正常的峰值，而且职业打假人投诉的基本都是食品过期”。

该负责人表示，我们不敢保证超市会有疏漏，未及时处理过期商品，但是如此高的量太不正常了。“对于职业打假人的行为，我们也在搜集发达国家的一些经验”，上述负责人表示，譬如有些国家对商家销售的问题商品，会给予严处，但是这个处罚金额不会给到个人。
