报告称我国食品安全信息不透明 29个省会不及格

  央广网北京3月16日消息(记者白杰戈)据中国之声《新闻纵横》报道,昨天是第34个国际消费者权益日。食品安全是消费者最关心的问题之一,北京大学公众参与研究与支持中心昨天公布的报告显示,中国食品安全监管的信息公开程度普遍较低,尤其体现在动态信息的更新上。全国人大常委会去年就颁布了新的《食品安全法》,但是从北京大学的报告来看,实施效果并不理想。食品安全信息的透明度低,食品消费者的权益就会受到侵害。


  这份报告评测了中央、省级和省会城市59个食品安全监管部门的信息公开水平,只有国家食药监总局和山东、湖北等六个省级食药监局超过60分,最高分是69.75.最低分是7.5分。29个省会城市的食药监局全都不及格。北京大学公众参与研究与支持中心高级研究员彭錞介绍,整体情况不容乐观。


  从行政层级的角度来看,从中央到地方到省再到省会城市,食品安全监管信息的透明度是递减的趋势,行政层级越低,越不透明。


  把透明度按颜色标注在地图上,大致呈现出东部、南部得分高,西部、北部得分低的趋势,与经济发展水平正相关。但是东部的浙江排名靠后,西部的四川和甘肃得分较高。彭錞说,即便是经济可能发达程度没那么高的地区,在这方面的信息公开其实也是可以做得很好的。


  根据新《食品安全法》和《政府信息公开条例》的要求,评测指标包括食品安全监管信息的主动公开情况、网络平台建设,以及依申请公开情况。在主动公开信息中,动态信息公开程度不如静态信息。


  静态信息指的是监管结果化、固定化的信息,比如说食品安全的标准、许可的名目等等,动态信息则是那些更加能够直接反映监管流程一线动态的实时信息,比如说安全的风险警示,比如说食品的召回信息,比如说食品的处罚、查处等等。观察发现我国食品安全监管信息是重完成时、轻进行时,也就是说动态信息的公开效果要比静态信息要差很多。


  北京大学法学院25名硕士、博士研究生组成的测评团队,通过浏览网页、拨打电话、在线平台留言和发出检测性公开申请等手段实施评测。他说,食品安全监管信息跟每一个普通老百姓是息息相关的,所以除了法定要求以外,还有一块指标的来源就是食药监部门官方网站的便民性,或者说是用户体验。


  在这一项中,上海市食药监局得分率70.83%,排名第一,超过国家食药监总局。兰州市得分率54.17%,在省会城市中排第一。经济欠发达的江西、甘肃,排名高于北京。依申请公开的成功率比较高,但是仍然有新《食品安全法》明文要求的内容被拒绝公开,主要的拒绝理由是“内部管理信息”。评测团队介绍,观察的时段从2014-2015年,其中的大部分时间新《食品安全法》还没有生效,但是可以显示现状与新法规的差距。对于新《食品安全法》明确要求公开的“注册或者备案的婴幼儿配方乳粉目录”和“已经批准的保健食品广告目录以及广告内容”目前公开程度都不到一成,成为依法公开的“重灾区”。


  2013年以来,中国的食品安全从多头管理转为食药监部门统一管理,但是相关信息公开仍然分散,影响了一些分数。


  在观察当中也发现,确实有很多信息在网上是公开了,但不是在食药监系统的官方网站上公开,而是散布在农业、卫生、质检等部门的网站。实际上信息公开对应的是监管结构,之前的监管结构是多头管理,现在要变为统一管理,但是信息集成度还没有跟上。要求变了,但实际的做法还没有,机构的转轨在信息公开层面还没有实现。


  另外,食药监部门公开的食品安全监管工作信息比较多,比如领导讲话、会议和文件信息等等,而公众更关心的食品安全监管信息公布偏少,彭錞建议,从比例上改变,这些工作信息可以适当减少,而真正关于监管实质过程的信息要增多。


  对于有食药监部门担心公开信息过多影响形象或者造成恐慌,彭錞表示,政府或者相关部门在这方面首先要自信,要清楚地认识到自己工作的特殊条件。同时整个社会公众也应该提高自己对食品安全事件的科学认知,放出来的消息是“坏消息”,但并不意味着某地的食品安全监管工作,做得不好,可能恰恰相反,意味着食品安全监管工作做得非常好。
